‘Welcome! I congratulate my brother Rajinikanth on his political entry’, says Kamal Haasan

Rajinikanth ended 2017 with a bang by announcing his decision to enter politics. His contemporary and his colleague, Kamal Haasan congratulated and welcomed Superstar Rajiniknath’s decision. Kamal Haasan told ANI, “I congratulate my brother Rajini for his social consciousness and his political entry. Welcome welcome.” Earlier Haasan reportedly hinted that he was willing to work with Rajinikanth if the superstar ever decided to enter politics. Rajini entered films in 1975 film, ‘Apoorva Rangapal’ which also starred Haasan in the lead. The two biggest superstars went on to share screen space in over 13 films, which is a huge number for stars of their stature. Earlier in an interview to NDTV, Kamal Haasan said, “We have been taught to look in unison. We are like a 3D camera. We are been trained by K Balachander. Fortunately, even though we are stiff competitors we have stayed brothers. We carved out our own domain. We were so wise that we were made to act in many films. We have done 13 films together and then we realised they are splitting up our remuneration and giving it. That’s when it hit us, if we go separate, we can each earn the amount they pay the two of us.” After 1985’s Geraftaar, the duo announced they won’t act together again. TN begins work to convert Jaya’s home into memorial

Tamil Nadu government on Saturday begin preparatory steps to convert late chief minister and AIADMK supremo chief Jayalalithaa’s Poes Garden residence into a memorial.Chennai district collector accompanied by revenue divisional officer, public works department and police officers visited Jayalalithaa’s residence on Saturday morning. But the presence of Income Tax department officials created a flutter as the news of fresh searches spread. However, it was clarified that the IT officials accompanied the state government officials to ensure that the two rooms of Sasikala, that were sealed by them, were not opened.Chief Minister Edappadi K Palanisami in August announced that the government would take over Jayalalithaa’s residence to convert it into a memorial.Chennai collector Anbuselvan said the inspection was part of the move to take possession of the residence to convert into a memorial. “Since two rooms in the house were sealed by the IT officials, we asked them to accompany us during the inspection,” he said, adding they had taken the measurement of the extent of land and building construction.Jayalalithaa’s niece Deepa had moved Madras High Court against the government order claiming that she and her brother were successors to her estate. She had filed a petition stated that her paternal grandmother Vedavalli alias Sandhya had purchased several properties in and around Chennai and died in 1971 leaving behind her son Jayakumar and daughter Jayalalithaa as successors to her estate.Deepa claimed that her father got married after her grandmother’s death and lived in a joint family with his wife, children as well as his sister (Jayalalithaa) in the same house for a long time. She had said that it was only for the sake of convenience that the family had to move to the present residence at T Nagar.

Sibling rivalry: MK Alagir blames MK Stalin for the RK Nagar defeat

After the DMK’s humiliating loss in the RK Nagar Assembly seat bypoll, party chief M Karunanidhi’s elder son and former union minister MK Alagir blamed his younger sibling MK Stalin’s for the loss saying that he did not do enough field work.Alagiri who was expelled from the party in the run-up to the Lok Sabha polls in 2014 for anti-party activities said leave alone the RK Nagar bypoll, the party would not win any election as long as Stalin leads the party. His comments have come ahead of the party’s high-level executive committee meeting to be held here on Friday.Rejecting the Stalin’s statement blaming money power for the election defeat, Alagiri, in an interview to a Tamil magazine, said, “There is a strong resentment against both the ruling party and the main opposition party in RK Nagar. Otherwise, how come an independent candidate Dhinakaran, placed 33rd on the ballot box list, got a resounding victory?””See, you should get down to the ground and do fieldwork. Merely going around in a jeep cannot fetch you votes,” Alagiri said, recalling how his dad Karunanidhi used to call him several times in a day to keep a tab of bypoll campaigning works when he used to oversee such elections.Alagiri, the Madurai-based strongman, had helped the DMK win successive by-elections in 2006-11 when his party was in power in the state. He was then accused by opposition parties of masterminding money distribution to voters in the Thirumangalam Assembly bypoll which was infamously called as “Thirumangalam formula”.The ruling AIADMK latched onto Alagiri’s comments to take potshots at Stalin. “Alagiri has said DMK cannot win (under Stalin’s leadership)… His (Stalin’s) own brother has said so,” senior AIADMK leader and Fisheries Minister D Jayakumar said, without elaborating. After the Alagiri’s expulsion in 2014, Stalin was appointed as party’s working president in January this year.POWER PLAYAlagiri and Stalin had been involved in a long-running feud in the DMK’s first family with both contending to be their father’s political heir. A former Union minister, Alagiri had once famously asked if the DMK was a ‘mutt’ where a senior pontiff could appoint his successor, indicating that he was always in the reckoning.

Who will challenge BJP? For Arvind Kejriwal and Rahul Gandhi, one’s loss is the other’s gain

They are roughly the same age, both have been lampooned mercilessly on social media and are hoping to oust the BJP from power. But the similarities, perhaps, are not the link between Aam Aadmi Party (AAP) leader Arvind Kejriwal, 49, and Congress president Rahul Gandhi, 47. What threads their fates together is that one man’s success could spell the other’s failure.”Rahul Gandhi’s gain is Kejriwal’s loss,” said rebel AAP MLA Kapil Mishra. “Both parties vie for the same vote base.”Delhi Chief Minister Kejriwal’s attempts to establish himself as an alternative to the Congress seem to be running into rough waters with the party’s improved performance in the recent Gujarat polls under the leadership of its president. The two parties are vastly different, of course. The Congress is 132 years old; AAP has just celebrated its fifth anniversary. The former has a pan-Indian presence, while AAP rules Delhi and is present only in patches in the north. But when AAP came to power in Delhi, it did so by engulfing Congress votes. In 2015, the Congress couldn’t win a single seat. Its vote share dipped to 9 %, whereas the BJP’s remained more or less the same. Now a string of ignominious defeats has battered AAP’s image, posing a threat to the image of its leader, Kejriwal. The chief minister’s influence now seems to be on the wane, while the Congress president’s is on an all-time high.AAP’s success was linked to Congress defeat. Will the Gujarat elections, fought by the Congress leader with such vigour that it upped its 2012 tally of 61 seats to 78, spell bad news for AAP?”Gandhi is yet to make a mark if you compare him with Modi’s electoral performance since 2014. But his rise will have an impact on Kejriwal,” said a former AAP leader.Centre for the Study of Developing Societies (CSDS) director Sanjay Kumar points out that the AAP leader’s popularity has already taken a hit.?Kejriwal?s ratings have already gone down drastically, as has his popularity in the last few months,? Kumar said.A recent survey by the Pew Research Center, a US-based fact-tank, states that in 2017, 39 % of the people had a favourable view of Kejriwal, down from 60 % in 2015.Born out of the anti-graft movement, four years ago Kejriwal seemed to have captured the imagination of the people, fatigued by the corruption charges that mired the then UPA government led by Mammohan Singh and the Delhi government of three-time chief minister Sheila Dikshit. The Congress’s vote share in the 2008 polls was 40.31 %, which earned it 43 seats in the Delhi Assembly. In 2013, when Kejriwal’s AAP’s stormed to power in Delhi, the Congress was down to eight seats. A year later, in the Lok Sabha polls, Gandhi’s party managed a mere 44 seats. In the Assembly polls in 2015, AAP decimated the opposition, bagging 67 seats with a vote share of 54.3 %. That it won from all the minority dominated areas in Delhi indicated it had ousted the Congress from its bastions.Kejriwal?s visit to the Hyderabad University campus where Dalit scholar Rohith Vemula had committed suicide and a job offer to his brother in the Delhi government were also seen as moves to attract Dalit votes, traditionally won by the Congress, at the national level.AAP’s strategy was to attack BJP leader and Prime Minister Narendra Modi and establish itself as an alternative to the Congress. But while Kejriwal took Modi on, his campaign sought to project Gandhi as an ineffective rival. In an interview to NDTV, Kejriwal, attacking Modi over the turf war between the Delhi government and the Centre, had said, “Narendra Modi, get this that I am not Rahul Gandhi”.At a press conference in 2016, he said, “Modi ji I am not Rahul Gandhi whom you can scare off.”But then the tables turned. In 2017, the party had expected to do well in Punjab and Goa, which, AAP leaders believed, would help it in Gujarat and the 2019 elections. But the party failed to make a mark in the states, and lost ground in Delhi — where it lost the Rajouri Garden bypoll and the MCD elections. In the traditionally bipolar states of Goa and parts of Gujarat, Kejriwal campaigned hard to make AAP replace the Congress, but his attempts failed, with almost all candidates losing their deposits. While Gandhi may be getting his mojo back after Gujarat, is brand Kejriwal, carefully crafted on the weakness of the Congress president, now under threat?AAP leader Ashutosh does not believe Gandhi’s electoral success will impact Kejriwa’s national ambitions.“We have a very competitive climate in our polity. Rahul’s rise will not have any effect on Kejriwal,” he said.

HP’s next CM Jai Ram Thakur’s Jaipur connection unfolded

There is joy and celebration in the air. Thumping beat of the drum, happily dancing people and endless rounds of mithai are all indications of the joy the Rao family in Jhotwara feels as their son-in-law is all set to take charge as CM of Himachal Pradesh. The entire neighbourhood is celebrating because, for them, Jai Ram Thakur is Jijaji, the humble, affable and friendly son-in-law of the family who has a friendly smile and a warm word for all.Thakur was married to the daughter of veteran RSS leader from Jaipur, Shrinath Rao in 1995. The doyen leader who had joined Sangh in 1942, is now 87 and watches the celebration with a look of satisfaction. Speaking to DNA he said, “The ideology for which we struggled all our lives is being taken forward. It is heartening to see people who believe in the ideology for which we struggled all our lives taking up responsible positions across the country.” He then mumbled a few lines of a song, “Wo adhoori sadhna purn bas ho jaaye…”Thakur had lost his first election in 1993 by mere 400 votes. But he has been winning the same seat since 1998. He had been in contact with Narendra Modi when Modi was in charge of HP from 1997 to 2002. “The alliance between him and my sister Dr Sadhna was suggested by senior RSS leaders and had blessings of Sheshadri Ji,” recalls Pramod Rao, Thakur’s brother in law. “We had gone to Mandi for the wedding and all arrangements were made by his friends,” he adds. “My late mother was very apprehensive and sent my father to HP to check on the boy and the family. But over years he was her favourite jamai,” recalls Praveen Rao.Dr Vrinda Rao, the daughter in law of the family recalls, “My husband’s younger brother had a spinal injury and he was being treated at the ISIC, New Delhi. The family would sit and even sleep in the corridors on durries. Jai Ram Ji who was then a minister in HP would do the same. When the members of the staff hailing from HP came to know that it was their minister, they went out of their way to help us.”The children of the family though are a worried lot. Their favourite Phoopha Ji always take them out to watch movies, visit malls and tourist places whenever he came to Jaipur or they visited Shimla. But now they know he is poised for larger responsibilities, and they wonder if would be able to spare time for them.

Congress votes jumped sharply in Saurashtra

If there was any region in Gujarat that voted in a totally different way in 2017 as compared to 2012 was Saurashtra-Kutch. While both the major parties added voters to their previous tally, it was 27.43% gain on the part of Congress to remove the deficit of 21 seats over rival BJP in 2012 to take a seven-seat lead in recent elections. The results also witnessed the resurgent party to narrow the vote lead of 4,30,749 votes in 2012 to 49,351 votes. The prime reason is the addition of 8,14,614 votes by Congress as compared to 3,14,165 votes by BJP in terms of previous elections. The net result was that Congress increased its tally from 16 to 30, while BJP dropped its tally from a massive 35 to 23. Saurashtra region has 48 seats, while Kutch has six seats in the 182-seat Legislative Assembly of Gujarat. Congress was able to regain 16 seats from BJP by conceding only four seats in the region. Seats that Congress wrested from BJP include predominantly rural seats of Dhrangadhra, Morbi, Tankara, Chotila, Wankaner, Jasdan, Kalavad, Jamjodhpur, Khambhaliya, Junagadh, Mangrol, Kodinar, Una, Dhari, Gadhada and Talaja. While the four seats have more urban aspect to it. These include Rajkot-East, Jamnagar-North, Palitana and Jetpur.Saurashtra-Kutch region is the least urbanised among all the regions and this has been one of key reason why BJP suffered a severe setback. With predominantly agrarian economy, the region suffered two erratic monsoons in past three years. What added to the natural calamity was administrative indifference in terms of timely intervention, whether it was ensuring drought and flood relief or remunerative prices for crops like cotton and groundnut. Last minute move to declare MSP for groundnut was too late and too less for the farmers. This region also witnessed the most high profile contest between Chief Minister Vijay Rupani and Congress rival Indranil Rajguru from Rajkot-West Constituency. What was supposed to be a keen contest saw Rupani winning by a healthy margin of 53,755 votes. However, former ministers Dilip Sanghani and Bavku Undhad lost their respective battle. Former Finance Minister Saurabh Patel managed to win from Botad by a narrow margin. While Koli heavyweight Purushottam Solanki won, his younger brother Hira Solanki suffered a setback. In fact then Congress vice-president had kicked off his campaign from religious place of Dwarka and his soft Hindutva got reception from the masses. In Amreli, Morbi and Gir Somnath, Congress swept and the contest was absolutely one sided.Even Prime Minister Narendra Modi had come to Saurashtra on multiple occasions to woo the voters. In Bhavnagar district, from where state BJP President Jitu Waghani had contested, Modi had addressed two rallies and just after Diwali, he had inaugurated the Dahej – Ghogha RO-RO service. BJP won in most the seats in the district.

Disclose hospital fees upfront: Bombay High Court

The Bombay High Court on Wednesday suggested to private hospitals that they discuss a patient’s financial condition during the admission process and make him or her aware of the estimated cost of the treatment. This will avoid any payment discrepancies or complications later. This would not be applicable to emergency cases.A division bench of Justices Naresh Patil and N W Sambre said, “This is a sensitive issue, but some remedy has to come out. If this method is adopted, then a filter can be put in place in the initial stage only. This way, both (patient and the hospital) will benefit; and also, the bond between a patient-doctor will not break.”The court has also suggested that the Association of Hospitals and Medical Insurance companies to come out with new policies to suit patients. “Like we take travel insurance for a month or 15-days, why can’t insurance be provided to patients when (s)he enters the hospital, taking into consideration the kind of illness. This would comfort the patient.”Advocate Mankuwar Deshmukh, appearing for the State, argued that a draft policy has been formulated by the government and is yet to be finalized. To which the court replied, “All stake-holders should come to a consensus and then only proceed.” The court has now asked the director of Health Services to file a reply by next month as to what steps it plans to take to regulate hospital treatment charges. The suggestion came while the court was hearing a public interest litigation filed challenging the purported practice of detainment of patients by hospitals for recovery of dues.A Kurla resident, 54-year-old Trevor Britto, alleged that Prachin Healthcare Multi-specialty Hospital at Panvel refused to discharge his injured bus driver, Chandrakant Pawar. Another petition is filed by a Santacruz-resident alleged that Seven Hills Hospital at Marol had refused to discharge his brother for not paying disputed dues of Rs 1.80 lakh. Both the hospitals have refuted the allegations.Court suggestsMedical insurance companies invent new short-term policies to suit patients The pre-discussion of treatment fees would not be applicable to emergency cases

Divide in SC Collegium over making its decisions public

The rift and the cracks within the Supreme Court Collegium appear to have widened with the emergence of two letters penned by Justices Kurian Joseph and Madan Lokur expressing their reservations on the issue of publication of the body’s resolutions. In a bid to make processes transparent, the top court Collegium led by Chief Justice of India Dipak Misra on October 6 passed a resolution wherein the decisions taken by them would be uploaded online “to ensure transparency and yet maintain confidentiality in the Collegium system”.The historic move has come shortly after the Collegium came under fire after Karnataka High Court judge Justice Jayant Patel resigned over his transfer to Allahabad High Court. The collegium — comprising top five senior most judges of the top court — have often been criticised for its closed door decisions. In fact, Standing by his point, Justice Chelameswar refused to participate in the Collegium meetings unless the minutes of the meeting were recorded. It has now emerged that Justices Joseph and Lokur — who are the fourth and fifth senior most judges — had expressed their reservation before the resolution was passed on grounds that the rights of persons mentioned in the resolutions outweighed against the goal of transparency. In an October 7 letter, Justice Joseph wrote: “…you have in breach of the trust reposed in you, in violation of the mandate of the resolutions and in total defiance of the request of your sister and brother judges, chosen to upload the text of the resolutions which contained information which might violate human rights of some persons, if not other rights, who are still to continue as judicial officers…””If three out of five of the Collegium request you to have further discussions on the issue, are you not bound by such request?…All of us are seriously interested in transparency. But should we also not respect the rights of others affected by our attempt to be transparent? Have we not in the history of the collegium, where you are a member, made such revisits?” Justice Lokur’s letter read.If one goes by what Justice Lokur has suggested in his letter, the collegium system does not seem to be following the advise of the majority and unilateral decisions are being taken by a select few.Though it is not known if Justice Ranjan Gogoi, the third senior most judge — and possibly CJI Misra’s successor, has sent out a communiqué, from Justice Lokur’s letter it appears that he too, was not completely sold on the transparency idea and had advised “further discussion.”The resolution, which was uploaded on the SC’s official website under a dedicated tab, bears the signature of all five judges. However, every decision uploaded thereafter has been signed by the top three judges only.Justice Chelameswar, who was part of the Constitution Bench that struck down the National Judicial Appointments Commission (NJAC) Act, has been a champion for transparency in the collegium system and was the sole dissenter. In the judgment, he wrote a strongly worded observation criticizing the collegium system for its opacity.FOR TRANSPARENCYThe Supreme Court Collegium led by Chief Justice of India Dipak Misra on October 6 passed a resolution wherein the decisions taken by them would be uploaded online “to ensure transparency and yet maintain confidentiality”.

Chennai: A day before RK Nagar bypolls, video of Jayalalithaa in hospital triggers row

Setting off a political controversy a day ahead of RK Nagar bypoll, a video purportedly showing late Chief Minister J Jayalalithaa in a hospital was released by sidelined AIADMK leader TTV Dhinakaran’s loyalist today.Amid questions raised about timing of the about 20 second video, aired by TV channels and later went viral on the social media, election officials asked channels to stop it’s telecast, saying it was a violation of the model code of conduct. The footage, showing a frail looking AIADMK supremo in a nightdress and sipping what appeared to be a health drink with a straw, was released by Vetrivel, disqualified AIADMK MLA and election agent of Dhinakaran, contesting the bypoll as an independent.A police complaint was lodged by Returning Officer of RK Nagar assembly constituency against Vetrivel, who said he released it in view of doubts raised over the circumstances leading to Jayalalithaa’s hospitalisation and death.AIADMK hit out at Sasikala’s family, saying the video release was a “conspiracy” and a “demeaning” act with an eye on tomorrow’s bypoll, considered an acid test for the ruling dispensation, being the first poll after Jayalalithaa’s demise.Suspicions have been raised over circumstances leading to Jayalalithaa’s demise by several persons, including now deputy chief minister O Panneerselvam and his followers. The state government has appointed a retired Madras High Court judge as the one-man commission of inquiry to look into the circumstances leading to her death.DMK, which raised the issue of doubts over Jayalalithaa’s death during the campaign, and several others alleged that the video had been released with an eye on the bypoll.Defending the release of the video, Vetrivel said he did it on his own “out of mental agony. Later Dhinakaran called me and asked me why I did so,” he told PTI.Tamil Nadu Chief Electoral Officer Rajesh Lakhoni told reporters that TV channels were asked to immediately stop airing the clip, which they duly complied with.He said telecast or display of any election-related material 48 hours before conclusion of the poll was barred under election laws.Returning Officer Praveen Nair, in his complaint said the video release violated the model code and the Representation of the People’s Act.”Neither the candidate nor his election agent obtained any permission from the Media Certification Monitoring Committee, which is also a violation of the Code,” he said. The high stakes bypoll is being held to fill the vacancy caused by the death of sitting MLA Jayalalithaa on December 5 last year. She was admitted to Apollo Hospital here on September 22 last year after she complained of fever and dehydration. She died of cardiac arrest after 75 days in the hospital. There was no response from Apollo Hospital to a query on the veracity of the video, which showed Jayalalithaa sipping the drink with a straw from a use-and-throw glass topped with a lid. On her bedside was the portrait of a deity.Ruling AIADMK, which has sidelined the Sasikala family, said the video release amounted to bringing “disrepute” to the late Chief Minister’s fame and image.”This demeaning (act) is a planned conspiracy by the Sasikala family to bring disrepute to Amma’s fame and image, done keeping in mind the (RK Nagar) bypoll,” said senior AIADMK leader and Fisheries Minister D Jayakumar.AIADMK supporters and the people would not accept this, he told reporters here.He also asked why they did not approach the inquiry commission probing the death of the AIADMK supremo.DMK working president M K Stalin said the footage was released with an ‘ulterior motive.’In a Facebook post, he said the clip was released at a time when RK Nagar people were set to vote.”To tackle their party (AIADMK) problem and to divert people, the video has been released with an ulterior motive.. They have come forward to make Jayalalithaa a scapegoat even after her death…As usual,” he charged.Stating that the video would also raise doubts among the public as to how Jayalalithaa died after recuperating so well, he said Chief Minister K Palaniswami and Panneerselvam should answer such suspicions.Sasikala’s niece Krishnapriya claimed the video was taken by her aunt at the request of Jayalalithaa herself and it had been released without her (aunt’s) nod.Terming it as a “big mistake” and “betrayal of trust” on the part of Vetrivel, she said action should have been taken by now by Dhinakaran against him.Krishnapriya is the daughter of Ilavarasi, wife of the brother of Sasikala, who is also serving the prison term along with Sasikala in the disproportionates assets case.”Chinnamma did not release the video to defend her even when she faced many charges. We gave the video to Dhinakaran. It was Sasikala who asked us to give it to him for submission to the inquiry commission if needed and not for public display,” she said and wondered “why and how” it reached Vetrivel. On the date on which the video was shot, she said it was taken a “month or two” after Jayalalithaa was hospitalised.”First she was in ICU and later she was brought to a room and the video was shot at that time,” she claimed.

Succession battle divides Bohri community

Considered to be the largest redevelopment project in the nation, carried out at Bhendi Bazaar by the Saifee Burhani Upliftment Trust, it was envisioned by the 52nd Dai of the Dawoodi Bohra community, late Syedna Mohammed Burhanuddin,. The plan is now being taken forward by his successor the 53rd Dai, Mufaddal Saifuddin. However, the post of the 53rd Syedna is under challenge at the Bombay High Court, which has divided the community. The name Saifee Burhani Upliftment Trust, combines the Late Dr Syedna’s name with his father, Dr Syedna Taher Saifuddin. The project is inspired by the commitment and affection of both the Dai’s to the community, which they jointly led through the sweep of the 20th century. The succession battle was initiated soon after the demise of Burhanuddin, in January 2014, by the incumbent 53rd Syedna’s uncle, Khuzaima Qutbuddin. In his declaratory suit, Qutbuddin had sought to be declared as the 53rd Dai and that the opponent be restricted from having any authority over the properties.Pending the hearing of the suit, Qutbuddin passed away in April last year in the USA. His son, Taher Fakhruddin Saheb, sought to amend the original suit and add him as the plaintiff to prove the claim of his father and also lead evidence with a prayer that since before his demise he was anointed as the successor to his post (54th Syedna), the court should declare the same.Saifuddin, through his elder brother Dr Qaidjoher Ezzuddin, who is appointed as the Constituted Attorney, has opposed reliefs sought in the declaratory suit filed by Qutbuddin, stepbrother of the late 52nd Dai, Mohammed Burhanuddin.Qaidjoher has contented, “The suit is based on false and untenable cases. Bohras across the world have given misaq (oath of allegiance) to Mufaddal…only a handful from the community has not accepted him.”

SC says ‘sorry’ to woman for 13-year delay in commencement of criminal trial

The Supreme Court has made a candid admission and said it was “sorry” for the delay of over a decade in commencement of criminal trial due to two conflicting orders passed by a high court judge in a single day in two different but related cases. The apex court said this had created a “legal conundrum” as one order of the judge restricted further probe in the case while in the order, it allowed the investigation to go on.The case, which was stuck in legal tangles, had reached the apex court in 2009 and the woman, who had initially lodged the complaint in 2004 against her own brothers over alleged grabbing of her shop, had now passed away and was represented by her legal representative. Also readSupreme Court yes to Hadiya ‘freedom’ pleaA bench of justices R K Agrawal and Sanjay Kishan Kaul said, “we are sorry to note that such a confusion has caused more than a decade’s delay in even the criminal trial commencing” and allowed the appeals of the woman. In 2004, Shyam Lata, a resident of Roorkee in Uttarakhand, made a written complaint to the SSP of Haridwar alleging that her two brothers forged documents and signatures and claimed she had give her shop on rent to them.A criminal case was lodged against her brothers alleging that they had prepared a fictitious rent receipt by forging the woman’s signatures and left its photocopy at her house for laying a false claim of tenancy. On other hand, one of her brothers filed a civil suit seeking to restrain her from evicting him from the premises, claiming himself as a tenant of the shop on the basis of the alleged forged rent receipt. The complaint was probed by the police and the investigating officer (IO) applied to the civil court for sending the rent receipts filed by the brother to an expert for comparison of signatures. The civil court denied the permission but modified the relief by allowing taking of photographs of the signature by a handwriting expert for the purpose of comparison. However, when the handwriting expert from the forensic laboratory of Agra reached the court to take pictures, the permission was allegedly denied by the court. This resulted in the IO filing the final report saying in the absence of permission to get the signatures, there was no evidence to find that the signatures were forged. The woman then raised objection to the IO’s final report and simultaneously challenged the denial of permission by the civil court to the handwriting expert before a sessions court. The sessions court allowed the plea of the woman and directed for sending the entire case record to the judicial magistrate, Roorkee, so that the required photographs may be taken and further investigation takes place. The sessions court order was now challenged by the brother before the high court while parallely the judicial magistrate where the woman had filed objections to the final report of IO, allowed her plea and directed for further probe. This order of the judicial magistrate directing the police for further probe was also challenged by the brother in the Uttarakhand High Court. Now, two petitions were before the high court which were heard simultaneously and were decided by the judge in two separate judgements on the same date in 2006.In one verdict, the high court modified the sessions court order and directed that the IO should be present before the civil court along with a handwriting expert on a fixed date to take photographs of the disputes as well as specimen signatures of the woman.Virtually, this order allowed the police to proceed further in the investigation. However, in the second verdict, the high court judge set aside the order of judicial magistrate directing the police to further probe into the case. While deciding the matter, the apex court bench said that there is no doubt about the “confusing nature of contradictory orders” passed by the high court. It said that high court’s first verdict allowing the handwriting expert to take picture of signatures would in “natural corollary” mean that further investigation will be carried out.The top court held that the second verdict of the high court setting aside the order of judicial magistrate was not required at all. Gujarat elections 2017: For him, poll battle began at nomination office

Vinod Chauhan was not like any other candidate hoping to make it in the upcoming election. In fact, for Chauhan the electoral battle began right at the Mojni Seva Sadan office in Bhimjipura where he went to file his nomination from Naranpura seat for the upcoming Gujarat assembly elections.Chauhan, 39, suffers from 80% disability and has been dragging himself on all fours since his life began. He came to the office doing that- dragging himself on all four- to file his nomination as the office is not disabled friendly. Chauhan, who claims to do odd jobs, lives in Ramapir no Tekro in Nava Wadaj and has only one motive – to get the problems of disabled address. “Our prime minister has given us a fancy name- Divyang- but names alone won’t work. We need facilities and we are only talking of basic facilities,” said Chauhan as he waited to get his nominations filed. He said he had to climb two floors to reach the office. “Had there been a ramp or lift my journey to file the nomination would not have to involve me dragging myself across the floor,” said Chauhan.Chauhan who lives with his mother and elder brother said no one talks about disabled. “Only a person who is disabled can understand the problems of the community and know what they need,” said Chauhan. He said it is high time the government bring up reservation for disabled people even in the electoral process.Chauhan knows he is fighting from a seat that is considered a BJP bastion. “It does not matter whether I win or not. If I can inspire others to take up the fight for disabled people my mission will be successful,” said Chauhan. In fact, Chauhan did not inform his family about his decision to fight the polls.

Maharashtra school allegedly expels teen after she files rape complaint, probe on

<!– /11440465/Dna_Article_Middle_300x250_BTF –>A 15-year-old girl in Maharashtra’s Latur district has alleged that she was raped by an Army jawan, and when she lodged a police case, she was expelled from her school. The district administration has ordered an inquiry into the incident.”Initial information suggests that the girl was not expelled by the school but was given the transfer certificate on her brother’s request,” Latur district collector G Shrikant told PTI.”I have called the headmaster of the school to find out details,” the IAS officer said. The district administration is investigating the allegations made against the school, he added. On July 19, the girl’s brother went to the school and asked for a transfer certificate and the school handed over the certificate to him the next day, an official said. The army man, who has not yet been arrested, allegedly raped the minor girl in April after promising to marry her, the official said. The girl has claimed that the school expelled her saying its reputation would be tarnished if she continued to study there. An offence of rape was registered in August and nine persons have been arrested in the case, Police Inspector Deepak Shinde of Devani Police Station said.Deputy SP of Nilanga G G Ranjankar said the girl and the army man are from the same ‘Laman’ community and the same locality.Meanwhile, the Maharashtra State Commission for Women chairperson Vijaya Rahatkar today asked Latur Superintendent of Police Shivaji Rathod to submit a ‘factual report’ in the case.

No legal guardian, but can speak for Baby Moshe’s family: Uncle

<!– /11440465/Dna_Article_Middle_300x250_BTF –>Moshe Holtzberg, uncle of Moshe (same name) and brother of Rabbi Gavriel who was killed in Nariman House or Chabad House in Colaba said that he may not be legal guardian of his nephew but can still speak as a family after Chabad said that he did not represent his nephew’s interest.DNA had reported Moshe seeking trusteeship for his nephew in its November 26 edition. Chabad Lubavitch movement that runs Chabad services rejecting the uncle’s assertions had said that he did not represent his nephew’s interest when the former demanded that his nephew be made trustee of Nariman House.Excerpts of email reply of Rabbi Israel Kozlovsky, director, Chabad-Lubavitch of Mumbai stated: “We have resolved that if he (12-year-old Moshe) wishes to continue the selfless work of his parents here in Mumbai, we would be happy to assist him and help him integrate into this important work. His uncle in New York is not a party to the above discussion, not entitled to any of the funds set aside for Moshe, and is not the representative of his nephew’s interests where we are concerned.””I have no legal guardianship of baby Moshe so they can’t accuse me of any wrong doing. Even if Moshe was to be the trustee of Nariman House, since I am not his legal guardian, they cannot accuse me of monetary gains and nor will I gain anything financially. When it came to making peace with them, I was the one that was called to represent my family and we did. If I can speak for my family then, why can I not speak now even if I am not legal guardian of Moshe?,” said Moshe.

Remembering 26/11: Moshe should be made trustee of Nariman House, says uncle

<!– /11440465/Dna_Article_Middle_300x250_BTF –>Nine years after the terror attack took the lives of Rabbi Gavriel Holtzberg and his wife, Rivka, who ran the Nariman House or Chabad House in Colaba, Gavriel’s brother Moshe Holtzberg told DNA said that his nephew, Moshe (same name) should be made a trustee of Nariman House and that the deed should be transferred in his name.Moshe – or Baby Moshe, as the then-two-years-old toddler came to be known in the public eye – is likely to visit India sometime in the next few months. Moshe also expressed unhappiness over 26/11 mastermind being free despite a reward for him and everyone knowing where he is.The 11-year-old currently lives with his maternal grandparents in Afula, Israel. “He is doing great with his studies, thank God. He loves to play football and loves a challenge and speaks about coming to India,” said Moshe, in emailed answers from the United States.”When we made peace with Chabad, it was agreed on that baby Moshe would be the trustee and the building would be named after his parents. We are waiting for that to happen. But the most important part is that Baby Moshe is Nariman House and Nariman House is Baby Moshe…..We ask that his house – the house of kindness – be given back to him. We thank the current Rabbi Koslovski for being the caretaker till Moshe grows up. But we need to see this guarantee on the deed,” he told DNA.Two years after the tragedy, the Holtzberg family filed embezzlement cases against the Chabad Lubavitch movement, which runs Chabad services across the world. The case was later amicably resolved at the Charity Commission in India.Expressing happiness that Chabad House was partially open, Moshe added, “We would like to have more transparency and that the family plays more of an active role.”However, the Chabad-Lubavitch rejected Moshe’s assertions. Rabbi Israel Kozlovsky, Director, Chabad-Lubavitch of Mumbai, said that Moshe’s uncle did not represent the interests of his nephew. In an email, he wrote: “We have resolved that if he (12-year-old Moshe) wishes to continue the selfless work of his parents here in Mumbai, we would be happy to assist him and help integrate him into this important work. His uncle in New York is not a party to the above discussion, not entitled to any of the funds set aside for Moshe, and is not the representative of his nephew’s interests where we are concerned.”An email sent to Baby Moshe’s grandparents, with whom he lives, asking for their comment on the stand-off between his uncle and the Chabad-Lubavitch remained unanswered.Sandra Samuel, the nanny of Baby Moshe who sneaked him out during terror attack and lives in Jerusalem said, “I meet him every Sunday for around two hours. Earlier he was a shy boy and would not talk to anyone. Now that he is grown up, he is more open to new people. But he still gets irritated if there are too many people around. With me, he likes talking about football, basketball, and ping-pong and we sometimes go to have Falafel and coke.”

<!– /11440465/Dna_Article_Middle_300x250_BTF –>A month after self-immolation by a four-member family in front of the Tirunelveli Collector’s office following harassment by a money lender, a Tamil film producer committed suicide at his house on Wednesday here blaming a Madurai-based film financier, who charged exorbitant interest for the loans which pushed the producer to take the extreme step. The alleged suicide of Ashok Kumar has shocked the movie industry, bringing back grim memories of the alleged suicide of well-known producer G Venkateswaran alias GV, brother of renowned film director Mani Ratnam.Kumar, who was a relative of well-known actor-director M Sasikumar, was found hanging in his apartment in Chennai on Tuesday. In his suicide note, Kumar blamed film financier Anbuchezhian for charging exorbitant interest on loans given to his production company.”The most sinful act I committed was to borrow loan from Anbuchezhian . He charged more than the interest rates over the last seven years. However, over the last six months, Anbuchezhian insulted and humiliated me. He sent his people home to threaten elders and women in my family (sic),” Kumar’s suicide note read. Stating that he was neither a coward nor a selfish person, he wrote, “I had only two options. One was to kill, and the other was to commit suicide. If I had to kill, the family will have to suffer. So, I chose the latter (sic).”

Let us join hands for securing a prosperous future for the people of our two provinces,” Shehbaz said, amidst the chill in India-Pakistan ties after a series of terror attacks launched from Pakistani soil.”You will agree with me that is essentially scientific and economic and cannot be tackled through other means,” he said in the letter – a copy of which was posted on the official Twitter account of the Government of Punjab, Pakistan. Delhi Chief Minister Arvind Kejriwal and Singh were tagged in the tweet.Shehbaz said it is in the interest of people from both Punjabs that a collective effort be made towards identifying technologies and business methods that may eliminate the need to burn rice-stubble and help control smog formation. In reply, Singh’s media advisor Raveen Thukral tweeted “@Capt_amarinder is extremely concerned about the issue and is actively pursuing it with the Indian government. He expects early resolution of the matter. He is, however, yet to receive the letter from @CM Shehbaz @GovtOfPunjab and will reply to it at suitable time.”Recently, Kejriwal and Haryana Chief Minister Manohar Lal Khattar had confabulations to tackle the problem of smog. Many cities in both sides of Punjab have been blanketed by thick smog in recent weeks, with pollution affecting normal life. Congress, BJP spar over pollution, potash and Parliament

<!– /11440465/Dna_Article_Middle_300x250_BTF –>As election campaign for Gujarat gains momentum, the main contenders — BJP and Congress — on Monday went hammer and tongs against each other, latching on to issues ranging from air pollution, potash scam to delay in convening Parliament session.Recalling lines from a song in Bollywood film ‘Gaman’, which looked at life in a city, Congress vice-president Rahul Gandhi took a swipe at Prime Minister Narendra Modi without naming him over Delhi pollution.”Seene mein jalan/aankhon mein toofaan sa kyun hai/ iss sheher mein/ har shaks/ pareshaan saa kyun hai… Kya batayeinge Saheb, sab jaankar anjaan kyun hain (Pain in the heart, storm in the eyes/ why is everybody in the city so perturbed. Will you tell Saheb, why are you playing ignorant despite knowing everything),” Gandhi said on Twitter.Congress has frequently attacked Modi using the word ‘Saheb’, which had long back surfaced in an audio tape long back in Gujarat.Gandhi also put out with his tweet a picture of children wearing masks and a news report clipping that said 18 lakh people died in India because of air pollution. At BJP headquarters, Union Minister Prakash Javadekar held a presser bringing under his target Congress general secretary in-charge for Gujarat Ashok Gehlot, raising “taint” against his brother in potash scam.Javadekar referred to a website news that alleged that former Rajasthan chief minister’s brother was involved between 2007 and 2009 in illegal diversion of a crucial ingredient used for making fertilizers which was actually meant for alleviating the distress of farmers.”Those making statements daily in the name of farmers should now say what are their views after this act of a close relative of a Congress leader. Corruption is in the very nature of Congress,” HRD Minister Prakash Javadekar said.Accusing the Congress of practising doublespeak, the Union Minister said, “Chori aur Seenajori”(brazening out) is the habit of Congress. At the Congress headquarters party spokesperson Maneesh Tewari trained guns on government for not coming out with the schedule of Winter session amid speculations that it could even be scrapped or at least its duration would be substantially shortened.Stopping short of suggesting that Congress can even approach the court over the issue, Tiwari said that available options will be exercised to ensure that Parliament’s role is not undermined.Holding the Winter session generally takes place in third week of November and political parties are informed about it by November 3 or November 4, Tewari asked why is BJP government so “scared” that it is “running away” from convening Parliament session. He wondered whether it is due to the “completely failed” implementation of GST or because of impact of one year of demonetisation decision and other burning issues like unemployment looming large over the national horizon.Tewari’s remarks come in the backdrop of Congress attacking the government on demonetisation and GST in a big way in trader hubs of Gujarat.”Are they scared of being raked up over hot coals of truth that even the temple of democracy — the Parliament — is not being convened by the government. This shows the complete lack of respect the government has for institutions,” he said.Calling it an ‘assault’ on democracy, Tewari said “if the government still does not listen, then all democratic options are open. Whatever needs to be done to ensure that the functioning of Parliament is not subverted, would be done. Rajasthan HC pulls up cops over ‘forced conversion’ of Hindu woman; direct them to file FIR

<!– /11440465/Dna_Article_Middle_300x250_BTF –>Pulling up the state police over its handling of a case of a woman’s alleged forcible conversion to Islam and marriage, the Rajathan High Court on Tuesday directed it to register an FIR and submit a report after her family claimed that it was an instance of ‘love jihad’.A bench of justices GK Vyas and MK Garg also directed the state government to file a reply clarifying the legal provisions pertaining to religious conversion in the state.Hearing a habeas corpus petition filed by the 22-year-old woman’s brother, the bench expressed anger over the “negligence” of the police, which allegedly refused to file an FIR on her family’s complaint. The court questioned as to how the police could assume that the girl’s conversion was legal “just by way of an affidavit over a stamp paper of Rs 10″, when there was no provision in law in this regard.”By this way, tomorrow, even I could address myself as Gopal Mohammad,” it said.In his petition, the brother claimed that one Faiz Modi had been harassing his sister for long and abducted her while she was going to college. She was made to sign some papers by him and fake marriage documents were prepared, he alleged. When the family members could not find her, they approached the police which refused to file an FIR stating that Faiz Modi had already produced proof of marriage and an affidavit of religious conversion by the woman dated April 14, the brother alleged. He alleged that she was blackmailed by the accused with objectionable pictures and forced to convert to Islam and marry him.Appearing from the petitioner, lawyer Gokulesh Bohra argued that the girl was with her family till October 25, while the documents were predated by six months.”This is a clear case of ‘love jihad’ and over half a dozen such cases have already been reported in the city in the past some time due to the disinterest shown by the police in investigating these cases,” Bohra claimed. It has been alleged that Hindu girls are being lured into conversion and marriage by Muslim men and it is often termed as “love jihad’ especially by Hindu outfits.Hearing the petition, the court today asked the Rajasthan Government to specify the laws and guide lines for conversion in the state. The court directed that the girl be sent to Nari Niketan (women shelter) for seven days and instructed the police to ensure that no one meets her there.Seeking a detailed report in the matter, the court asked the police whether it tried to probe the truth of the purported affidavit by the girl.It directed the police to file an FIR and probe the matter. The matter comes in the backdrop of the controversy over a case of a Kerala Hindu woman, who had converted to Islam before marrying a Muslim man, Shafin Jahan. The Kerala High Court had annulled his marriage and described it as an instance of ‘love jihad’, which was challenged by Jahan. It was alleged that the woman was recruited by Islamic State’s mission in Syria and Jahan was only a stooge.Ashokan K M, the father of the woman, had alleged that there was a “well-oiled systematic mechanism” for conversion and Islamic radicalisation.Jahan had on September 20 approached the apex court seeking recall of its August 16 order directing the NIA to investigate the controversial case. The matter is now before the apex court.

Lt Colonel sacked for affair with 19-yr-old

<!– /11440465/Dna_Article_Middle_300x250_BTF –>The Army has sacked an officer for having an affair with his colleague’s 19-year-old daughter, calling his conduct “inappropriate,” sources said. Following the action against the Lt Colonel, his wife met Defence Minister Nirmala Sitharaman recently to discuss the matter.”The officer’s wife had met the Minister recently and the matter was being looked into,” sources in the Defence Ministry said. However, it seems his wife’s plea for intervention has failed, and the Army is not likely to reverse the decision. The officer in question can challenge the Army’s decision in a civil court.Sources said the matter was sensitive and had serious ramifications. After reviewing the situation, his actions were considered serious in nature and a decision to dismiss him was taken at the highest level. The dismissal from service was as per provisions of administrative action that is quicker than disciplinary action. There have been cases of officers being involved in illicit relationships with wives of their colleagues. “Stealing the affections of a brother officer’s wife” is considered a grave offence in the armed forces that can lead to dismissal.Such cases usually end up in civil courts after the General Court Martial proceedings. There have been instances where courts have reinstated officers dismissed for being involved in extra-marital affairs.”Such a case where an officer is involved with a colleague’s daughter is rare,” sources said. The Army was tight-lipped and did not officially comment on the decision of sacking of the Lt Colonel. The armed forces follow a strict and no-tolerance policy when it comes to extra-marital relationships and indulgences of officers to avoid grave ramifications on their functioning.

China likely to again block move to list Masood Azhar as global terrorist

<!– /11440465/Dna_Article_Middle_300x250_BTF –>China today hinted at no change in its policy of blocking efforts to list JeM chief Masood Azhar as a global terrorist during the second tenure of President Xi Jinping, as Beijing continued to harp on its familiar stand that there was no consensus among UN Security Council members.A veto-wielding permanent member of the Security Council, China has repeatedly blocked India’s move to put a ban on the Jaish-e-Mohammed chief under the Al-Qaeda Sanctions Committee of the Council. JeM has already been in its banned list. China had in August extended by three months its technical hold on the the US, France and UK-backed proposal to list Azhar as a global terrorist by the UN after having blocked the move in February this year at the United Nations.”We have made our position clear many times from this podium. The relevant resolutions of Security Council have clear stipulations as to the mandate of 1267 Committee and also clear stipulations when it comes to the listing of relevant organisations and individuals,” Chinese Foreign Ministry spokesperson Hua Chunying told a media briefing here. Replying to questions whether China will block the ban on Azhar again when the 1267 Committee of the UNSC takes up the issue on Thursday, Hua said “as for listing application by the relevant country, there are disagreements”.China’s latest hold is due to lapse on Thursday. India has identified Azhar as the mastermind of the Pathankot terror attack on January 2, 2016. It has also blamed his brother Rauf and five others for carrying out the attack in which seven Indian soldiers were killed. Hua’s remarks indicate that China will continue its policy to block moves by India and other countries led by US to list Azhar as a global terrorist by the UN during the second term of President Xi.Hua said that China had put a technical hold to allow for more time for more parties to deliberate on this matter. “To our regret the committee is so far yet to reach consensus,” she said. China in the past had asked India to discuss the issue directly with Pakistan in order to reach an understanding. In the last two years, China has stonewalled efforts by India and then later by the US, the UK and France to declare Azhar as a global terrorist, stating that there was no consensus on the issue. She also put up all familiar defence of Pakistan, shielding it against criticism for sheltering terror groups. “You mentioned Pakistan. Pakistan is also a victim of terrorism and we support Pakistan in countering terrorism in accordance with the its own national conditions,” she said, adding that China advocated international cooperation on combating terrorism. On the Azhar issue, Hua said the UNSC resolutions have clear stipulations when it comes to the mandate of 1267 Committee and the listing of terrorist groups and individuals.”So far consensus has yet to be reached by the members of the Committee and the actions taken by China are meant to safeguard the authority and effectiveness of this committee,” she said, defending Beijing’s actions. She also claimed that China’s stance showed a “sense of responsibility”. “China will continue to follow the resolutions and the rules of procedure of the Committee and remain in touch and coordination with relevant parties,” she said, adding that the Chinese actions are meant to ensure the authority and efficacy of the UN Committee.”We believe that the Committee should follow the principles of objectivity, professionalism and fairness and reach decision by a consensus based on solid proof,” she said when asked if China is blocking India’s efforts at the behest of Pakistan. Last year in March, China was the sole member in the 15- nation UN organ to put a hold on India’s application with all other 14 members of the Council supporting New Delhi’s bid to place Azhar on the 1267 sanctions list that would subject him to an assets freeze and travel ban.

Shamelessly they are lending their voice for Kashmir’s azadi: Watch PM Modi slam P Chidambaram

<!– /11440465/Dna_Article_Middle_300x250_BTF –>In a stinging attack on the Congress on the Kashmir issue, Prime Minister Narendra Modi today accused it of “shamelessly” taking a U-turn and lending its voice for “Kashmir’s azadi”, a language spoken by Pakistan.Modi’s sharp comments came a day after senior Congress leader P Chidambaram pitched for greater autonomy for the restive Jammu and Kashmir yet again. He told BJP workers here that his government would not compromise with the country’s unity and integrity.”All of a sudden, those who were in power till yesterday have taken a U-turn. Shamelessly, they are making a statement and are lending their voice for Kashmir’s azadi,” Modi said.

They don’t have any shame in saying this. The Congress party will have to give an answer for this (Chidambaram’s) statement…,” he said.Modi said, “Those brave hearts who have sacrificed their lives, mothers who have lost their sons for the country…that mother is asking the question, that sister who has lost her brother is asking the question and the child who has lost his father is asking the question.”But, he said, the Congress was “shamelessly using such language that is used by the separatists on Kashmir’s land.(They are) using the language that is spoken by Pakistan.” Underlining that this was the land of Sardar Patel, he said, “We will not compromise with the country’s unity and integrity and we will not allow it happen.” Chidambaram had told reporters in Rajkot in poll-bound Gujarat yesterday, “The demand in the Kashmir Valley is to respect the letter and spirit of Article 370, that means they want greater autonomy. My interactions in J&K led me to the conclusion that when they ask for azadi, mostly, I am not saying all… the overwhelming majority, they want autonomy.” “Yes, I do,” Chidambaram said when he was asked if he still thinks that Jammu and Kashmir should be given greater autonomy.Chidambaram had in July 2016 advocated greater autonomy for Jammu and Kashmir, saying India should restore the “grand bargain” under which Kashmir had acceded by granting a large degree of autonomy to it.He had warned that otherwise the country will have to pay a “heavy price”.The Congress, however, has sought to distance itself from the remarks of Chidambaram on Kashmir, saying the “opinion of an individual is not necessarily the opinion of the party”.Congress chief spokesperson Randeep Singh Surjewala had said Jammu and Kashmir is an integral part of India and “will always remain so unquestionably.”Reacting sharply, the BJP yesterday said it was not surprising to see Chidambaram make such comments given his leader supported those who gave slogan of “Bharat tere tukde honge”, an apparent reference to Congress vice president Rahul Gandhi backing those who protested the arrest of student leader Kanhaiya Kumar in the JNU row.Kumar, then the JNUSU president, and a few others were arrested on the charge of sedition after anti-national slogans were allegedly raised at an event on the campus in February last year to protest the hanging of Parliament attack convict Afzal Guru.”Shocking that PC bats for separatists & ‘azadi’ but then not surprising given that their leader supported ‘Bharat tere tukde honge’ naara!” Information and Broadcasting Minister Smriti Irani had tweeted.”Shameful given that PC spoke in Gujarat, the birthplace of Sardar Patel ; a man who dedicated his life for the unity & prosperity of India,” she added.Finance Minister Arun Jaitley had accused the Congress of encouraging separatism in J&K and said Chidambaram’s statement “hurt” India’s national interest which was a serious issue.”Whether this statement which has come from a prominent leader of the Congress party is the party’s official stand or not? I think the party should immediately clarify that,” he had said in Mumbai.
