Activists file police complaint against bullock cart race

An animal rights activist has lodged a complaint with Kashimira police station after a video of bullock carts racing on the Mira-Bhayander Road went viral on social media. The 28-second long video was shot on December 25.”I was shocked on watching the video as the race was being carried out on the busy Mira-Bhayander road at around 4.30 pm. It was fortunate that an animal lover who saw this happening decided to shoot the video otherwise there would have been no proof. What is even more appalling is the fact that the police had no information about it,” said Shakuntala Majumdar, President of Thane Society for the Prevention of Cruelty Animals (TSPCA) who submitted a formal written complaint on Sunday.The video captures two bullock carts racing on the stretch of road between D-Mart towards Silver Park signal, while the audience shouts and cheers. One cart has three men riding it while the other has four. As they ensure that the bullocks run as fast as they could, the cart with four men skids and one by one all the four fall even as the bullock with the cart swerves left.Majumdar said that the entire act is not only a violation of the order dated October 2017 of PIL No 23132 of 2017 of Bombay High Court which bans bullock cart racing in Maharashtra unless permissions have been granted by the authorities.”Apart from being a contempt of court, this activity is completely illegal as per the Prevention of Cruelty to Animals Act 1960. Going by the fact that there is evidence that the bullock cart slipped and people fell off, I have also asked the cops to register a case under Section 188 because the race on a public road could have caused danger to human life and safety,” added Majumdar and stated that the cops now need to investigate the matter and take action as per law.A cop from Kashimira police station said that they were busy with security deployment for New Year’s Eve and would investigate the matter from Monday.

MSBTE told simplify process of duplicate mark sheets

The state Right to Services Commission (RTSC) has asked Maharashtra State Board of Technical Education (MSBTE) to simplify the duplicate mark sheet procuring process and make it “user friendly”. The directives were given when an applicant, who was told that his duplicate mark sheet was delivered “by post”, did not receive it for nearly five months.Prathamesh Sorte, an applicant seeking a duplicate mark sheet, had applied to MSBTE. His application was made online on June 28, 2017. When he did not get any information, he filed the first and then subsequently a second appeal. Since no decision was given, a third appeal was filed with the RTSC.While Sorte received the duplicate mark sheet before the hearing of his third appeal, the commission was informed during the hearing that he made four applications to get a copy of it.As per the information provided by MSBTE officials, the commission was informed that the applicant was told that he would get the mark sheet “by post”. However, “by post” means it is sent to a designated officer of the technical education and not to the home of the applicant, as assumed by many applicants.”The applicants assume that they would get their mark sheet at home when they read that it would be sent by post. What they have to do is go and collect the mark sheet from the place where the board sends it to. This tends to create confusion among many. Hence, we have asked for improvement in the format. We have also asked that the system of getting mark sheets be made more user-friendly,” said Swadheen Kshatriya, Chief of RTSC.Kshatriya passed the order on December 11, 2017 and directed Secretary, MSBTE to do all that is necessary.DNA could not reach Secretary of MSBTE.

Sources said that with the four new Bombardier rakes coming in, not only will the commuters get newer rakes but also more services.Confirming the same, SK Jain, Divisional Railway Manager (Mumbai), Central Railway said, “We will be introducing 24 new services on the Harbour line by the end of this month.”Currently, the CR operates 590 services on the Harbour line, 232 on the Trans Harbour line and 838 services on the Main line daily. Fail to treat wet waste? No water, power for you: MPCB

Housing societies in the city that have not yet started treating wet waste at source or set up facilities for the purpose in their premises can now prepare to face the music as the Maharashtra Pollution Control Board (MPCB) threatens to cut power and water supply to these residential units.The MPCB has sent notices to 76 large housing societies that have not yet established facilities to treat wet waste in their premises. From the original deadline of October 2, the Brihanmumbai Municipal Corporation (BMC) extended it to January 2, 2018 for the around 3,200 bulk generators of waste in the city. Once the deadline is passed, the civic body has stated that it will stop collecting untreated waste from the premises of these bulk generators.”We have issued notices to 76 societies for flouting the Solid Waste Management Rules, 2016. This list was given to us by the BMC… (in case of further default) we will submit a proposal to the Board asking for the power and water supply to be disconnected,” said Madhukar Lad, Regional Officer (Mumbai), MPCB, adding that the notices were sent in the third week of December. Lad noted that these bulk generators must establish facilities like Organic Waste Composters (OWC) for treating wet waste which aims to reduce the burden of solid waste that is dumped at the three dumping grounds in the city. He added that these societies will be given a hearing following which a period of 15 days to a month will be offered to take the necessary measures.The MPCB is in the process of sending show cause notices to more societies, many of which are in areas like Mahim, Dadar and Parel, according to MPCB officials. “These entities must segregate their waste at source and establish vermicomposting or OWC facilities to treat wet waste,” stressed Lad.Meanwhile, a senior BMC official said that the number of bulk waste generators treating their wet waste was gradually increasing. “Some have established OWCs or are doing so. Some societies have already taken permissions from their managing committees,” he explained, adding that an extension for the deadline for not lifting wet waste would be granted based on this progress. The official admitted that the 100kg average was decided on a thumb-rule basis after considering the number of size of families and average garbage generation of 450 to 500gm per head.The Mulund, Deonar and Kanjurmarg dumping grounds see around 7,300 metric tons of garbage being dumped there daily.The official said building projects of an over 20,000 square meter area needed environment clearances with a condition that all solid waste would be processed in the premises. The state had issued guidelines under which premises over 5,000 square meters are to treat their own wet waste. Though this was a condition for granting the occupation certificate, it was breached later with these spaces being used for purposes like parking, he admitted, adding that they would propose action against these violators.MATTER OF WASTEUnder the SWM Rules, 2016, all gated communities and institutions with an area of over 5,000 square meters shall segregate, process and treat waste at source. It defines bulk generators as buildings occupied by the central and state government or local body departments or undertakings, public sector undertakings, private companies, hospitals, educational institutions, hotels, commercial establishments, markets, places of worship, stadiums and sports complexes with an average daily waste generation rate exceeding 100kg.

Prompt service commission makes lives easier

When it comes to citizens applying for services under the Right to Services (RTS) Act, the response is spot on, say many.It is so prompt that many citizens compared the speed to services under the Right to Information (RTI) Act. In both, a number of them managed to get the needful done the moment they approached the RTC commission — an independent office, as compared to appeal-stage one that are part of the government — when they did not get the services they applied for.Only RTS is a more direct Act and was enacted to ensure that notified services were delivered to eligible citizens on time, while the RTI Act entitled citizens timely information that aided transparency and accountability. Under the RTI Act, a number of citizens managed to get services the moment they sought information under the RTI, which was not delivered on time. Penal action lead to officers providing services.”In most cases, citizens have written to us stating that they managed to get services after our intimation for hearing was sent to the officers,” said Swadheen Kshatriya, chief of the RTS commission.Some cases in point are about shop licences, which were not given even after the government took several initiatives towards “ease of doing”. Rushi Chavan from Pune did not get ac shop license certificate. In the first appeal stage, order was given that services be rendered. The second appeal stage too had a similar response. However, Chavan did not get the info and officers said that his application was not available. The moment the case reached the the second third appeal (commission) stage, Chavan replied that he got the certificate.In two more cases, also from Pune, authorities did not issue a license, stating that documents were not proper. However, no such reply was given in writing to the applicants. Only when the commission sent a notice for hearing were the licenses given. In all three cases, applicants said that since they got the service, a third appeal was not needed.Shailesh Gandhi, former central information commissioner, said, “An average citizen will not pursue it but the commission should ask for explanation and penalise officers. After all, the third appeal stage is laborious. Ideally, at this stage if they feel that the designated officer has a good case, he should be spared, otherwise they should be penalised to create a fear of the law. Else, there will be cases piled up at the commission.”

Corporator pitches converting junked buses into mobile toilets

Convert discarded BEST buses into mobile toilets and let it be used at highways and other places in the city, including the crowded streets of Mumbai, a notice of motion by a Corporator in the BrihanMumbai Municipal Corporation (BMC) said. The motion was filed by Shiv Sena Corporator Sachin Padwal from ward number 206 in the BMC. The proposal will be discussed in the House of the BMC on January 5. If passed and later on approved, the discarded BEST buses may soon be used as toilets in the city. BEST keeps on discarding buses as they get old or if they are not required. Recently, it stopped using air-conditioned bus services in its fleet. BMC, on the other hand, uses mobile toilets excessively, especially on roads, near highways, slums and even during large gatherings in the city. The proposal by the Corporator reads, “Converting buses, which according to the BEST undertaking has been discarded as scrap, into well equipped mobile toilets, and then making them available on highways, major roads and small-big crowded streets in Mumbai.”Padwal claims that he has spoken to the BEST committee chairperson seeking details on the number of discarded buses and is getting the response soon. He also says that instead of hiring mobile toilets for big events, these toilets can be used, saving a lot of revenue.

MahaRERA allows early possession

When a group of home buyers approached the Maharashtra Real Estate Regulatory Authority (MahaRERA) for an early possession from a builder, the authority actually heard them and allowed it, too. Nearly a dozen home buyers approached the authority earlier this month against Kumar Builders Mumbai Realty Pvt Ltd to get possession in a building named Kul Tulip in Ghatkopar.The complainant had stated that the date of possession as per agreement was March 31, 2015, however, till date no possessionis were received. The developer has also put the revised proposed date of completion on the MahaRERA website as December 2019. The buyers informed the authority that they had no intention to wait so long and therefore approached the authority for and early and exact possession date. They have also sought an interest on the payments made so far and compensation for the delay in possession. The developer, in response to the complaint, had cited reasons beyond his control which delayed the completion of the project. Further, the developer also stated that since the matter was in arbitration, he had to approach the arbitrator for any construction work of the project. The construction work is still in progress and will be ready for possession by December 2019, the developer had said. The complaint was heard by Chairman MahaRERA, Gautam Chaterjee. “On the basis of the mentioned facts, we feel that the developer should hand over the possession of the said apartments to the home buyers on or before September 15, 2018, which is a reasonable time for completion of the pending work in the project along with OC and the same is also commensurate with the extent of development work pending, in accordance with rule,” Chaterjee said in his order.The authority further ruled that if the developer fails to hand over possession by September 15, 2018, the developer shall be liable to pay interest to the home buyers from September 16, 2018 till the actual date of possession, on the entire amount paid by the complainant to the developer.CASE DETAILSThe date of possession was March 31, 2015. The developer revised the date of completion on the MahaRERA website as December 2019. The authority directed the builder to handover flats on or before Sept 15, 2018. In case of delay, the builder shall be liable to pay interest to buyers.

Kamala Mills Fire: Hookah bars may fizzle out after new BMC rules

After a devastating fire in Kamala Mills compound killed 14 and injured several others, hookah parlours may now get a new set of rules and regulations. The state government has been considering laying down stricter rules for establishments serving hookah to its customers. The fire is said to have been caused by one of the burning coals used in a hookah. The new set of rules will include licensing of such establishments and an age bar on patrons that they can serve.“Though the Supreme Court had struck down a ban on hookah parlours, we are looking at regulating them… the question is what kind of regulation is feasible. We are planning to amend the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003. This will regulate the sale and advertisements of tobacco products (including hookah) for the state with the consent of the Centre,” said a senior home department official, adding that they had recently held discussions in this regard.The BMC had imposed a ban on hookah parlours in 2011 in restaurants where smoking otherwise was permitted. This was challenged in the SC which struck it down in 2014.“We can, however, regulate these hookah parlours by laying down a set of rules on the minimum age of their patrons (after concerns that even those who were under-age had access to hookahs), the amount of nicotine used and the number of people to be accommodated in an establishment,” said another official from the department.A senior official said that as of now, these hookah parlours lacked separate licensing or regulatory mechanism. “There is a thin line as on today… Some sort of regulation for hookahs is necessary. You need permissions to start restaurants and even a shop act registration for a xerox centre but no special license for a hookah bar. There must be some system to give licenses and regulate them,” the official admitted, stating that these hookah bars, which were proliferating in Mumbai and also in areas like Pune, fell in a legal twilight zone.“These hookah bars invariably serve liquor,” he said, adding that minors also accessed these spaces leading to public health, and law-and-order concerns.Meanwhile, a senior state excise official said that 1 Above and Mojo Bistro were serving liquor outside the area for which they had been given a license. “They were serving alcohol outside the designated area for which they had a permit room license. The service area had been extended to the terrace where liquor was served. This is a violation,” the official claimed.A home department official said a private member bill seeking to ban hookah bars had also been moved in the state legislature during the recent winter session at Nagpur.State excise commissioner Dr Ashwini Joshi had cracked down on one-day liquor party permits in restaurants as these temporary club licenses, which are meant for functions, were used by rooftop restaurants and eateries to serve liquor across the year.

Kamala Mills Fire: Eatery owners fear loss of business

The Kamala Mills fire has soured the last day of the year, feel many restaurant owners. The fear of losses that they may incur is slowly rippling through the sector. According to the Indian Hotel and Restaurant Association (AHAR), many restaurants in the city have already accepted the fact that there will be a huge business loss on New Year’s eve. They claim that patrons will have the Kamala Mills fire, which killed 14, in mind.”The loss of lives is so fresh in everyone’s mind. It happened on Thursday night and made the front pages everywhere. On Friday itself, many restaurant owners expressed the fear that they will suffer a loss of up to 20 per cent as people might not turn up on New Year’s eve,” said Niranjan Shetty, Chairman of MCGM committee of AHAR.According to the association, on December 31, a lot of people venture out and it is a very important day in terms of business. People visit restaurants where they are regulars, and also get guests including friends, family and relatives, which helps the restaurants earn extra bucks.Another restaurant owner said, “We are hoping for great takeaway orders at least. People normally go out, but then visiting a restaurant after the Kamala Mills fire wouldn’t be the first thing on their minds. So we are prepared for lesser business in terms of walk-ins. But we may see a larger business in terms of takeaway or home deliveries.”Apart from this, authorities have started visiting restaurants and action has been started. The associations have asked their member restaurants and hotels to cooperate. “We have directed all hotel and restaurant owners to not create any hassles and let the authorities do their work and cooperate. If they have any doubts, they should seek the help of authorities and understand what should be done to rectify the issue,” said Shetty.FALSE ALARM?After the fire engulfed the restaurants in Kamala Mills, a series of messages started doing the rounds. One such message was about parties at restaurants beings called off and it was signed by Congress leader Charan Singh Sapra. When contacted, Sapra denied sending out any such message and said it was a mischief and should be ignored. Even AHAR denied sending out any message about any party cancellation and asked people to not pay attention to rumours.PARTY STILL ONImmediately after the fire, Riyaz Amlani of Social had said that there were no party cancellations. “The parties are mostly personal ones and we cannot cancel any parties until the person who booked the place, does,” said Shetty. According to both of them, New Year’s eve will be celebrated as every year in the city too. However, till Saturday night, there were some restaurants and pubs that sent out messages about party cancellations but they were related to action taken by authorities.

Kamala Mills Fire: BMC bulldozes into eateries’ violations

The Brihanmumbai Municipal Corporation (BMC) went on a razing rampage on illegal extensions in hotel and restaurants across the city. However, it took action only after 14 people lost their lives. The civic administration delayed its action just to follow the standard operating procedure (SOP) against illegal use of open spaces on terraces.The BMC in full swing started pulling down illegal extensions in restaurants and shopping malls across Mumbai on Saturday morning and took action on 314 restaurants. It inspected a 624 eateries. BMC also seized more than 417 cylinders from the restaurants which were stored without permissions.In Raghuwanshi compound, four restaurants that faced action were Sheesha, P22, Hotel Payaana and Hotel Fumes.Prashant Sapkale, assistant commissioner of G South ward, who has now been transferred to K East ward said that he had taken action against Mojo’s Bistro in August and September following complaints of violation of open space on the terrace. “We had given three inspection reports to the owner of Mojo’s Bistro as part of the standard operating procedure (SOP) for violation of open space on the terrace and took action on August 2 and September 22,” said Sapkale. He added that he had no other option but to follow the SOP before taking action.Shockingly, the G South ward office forgot to follow the SoP and demolished illegal extension without even serving a notice. “Did the civic body follow SOP while action against these eateries,” said Dinesh Vaghela, a Right to Information Activist (RTI).“At any place where hookah is being served, no food item can be served,” said Vaghela. He added that the civic body violated rules and regulations while granting licence under section 394 of Mumbai Municipal Act.

Envoy in Pakistan didn’t know Hafiz Saeed, says Palestine’s ambassador in India

Palestine on Friday called back its Ambassador in Pakistan after he was seen in the company of Lashkar-e-Taiba founder Hafiz Saeed. “We are supporting India in its fight against terrorism and because of that my government decided to directly call our Ambassador to go back home and not to be a Palestine ambassador to Pakistan anymore,” Palestinian Ambassador to India Adnan Abu Al Haija told ANI.His statement has come after a photograph of Palestine’s Pakistan envoy Waleed Abu Ali sharing a platform with Saeed, who is designated as a global terrorist by the United Nations, at a rally in Rawalpindi is doing the rounds on the social media. “Our Ambassador does not know this person. When he starts speaking, he asks who is this person? Our Ambassador’s speech was after him, he made his speech and left. For us, even with that, it is not accepted and a decision has been taken,” he clarified. BMC files police complaint against Mojo, 1 Above and Kamla Mills for illegal construction

The Mumbai civic body, Brihanmumbai Municipal Corporation (BMC), on Saturday filed police complaints against Kamala Mills ,’1 Above’ pub and Mojo’s Bistro for illegal construction, a day after 14 people were killed in a fire in a building at the compound. The BMC has also filed a complaint at NM Joshi Marg Police Station against P22, a food joint in Raghuvanshi Mills. Three separate FIRs are being registered under the Maharashtra Regional Town Planning Act for allegedly making illegal construction, police said. Mumbai fire: BMC’s demolition drive against illegal structures in Kamala Mills area

A day after 14 people including 11 women died in a midnight blaze in Mumbai’s Kamala Mills, Brihanmumbai Municipal Corporation (BMC) carried out demolition drive against illegal structures in the area on Saturday. BMC officials have made a list of restaurants which appear to have flouted the rules and appropriate action will be taken against these restaurants. Now, after the Kamala Mills fire, BMC officers have sprung into action. But earlier, despite BMC administration being aware that the restaurants were running illegally in Kamla Mills compound, it delayed action in the name of following standard operating procedure. While F South ward of BMC delayed action against Mojo’s Bistro and 1 Above, it took action against four such pub and bars in its jurisdiction on Friday soon after the huge fire reported on the midnight of Friday.In view of December 31 gathering in various restaurants, all concerned departments have been directed by Municipal Commissioner Ajoy Mehta to form teams which should include fire staff to inspect all restaurants. The teams must ensure that the restaurants are fire compliant. All the fire escape routes, staircases, and open spaces should be encroachment-free. Chief Minister Devendra Fadnavis has already ordered an inquiry into the incident. The police on Saturday issued a lookout notice against all the accused in the case. Kamala Mills fire: Probe on to ascertain what caused Mumbai pub blaze

A day after a devastating blaze at a central Mumbai pub claimed 14 lives, fire brigade officials on Saturday said the department was probing whether flames during a fire stunt by a bartender, burning coal used for hookah or a short circuit led to the tragedy.The blaze had started after 12.30 am on Friday at the ‘1 Above’ pub on the terrace of Trade House Building in Kamala Mills compound in Lower Parel, a commercial hub, resulting in the collapse of its bamboo-propped canopy. The fire, which left several people injured, also engulfed Mojo’s Bistro, a pub a storey below. Most of the 14 victims died of asphyxiation.”We are probing if the flames created during a fire stunt by a bartender at the pub came in contact with plastic sheets that covered the bamboo structure and triggered the blaze. We are also trying to find out whether the burning coal used for hookah at the adjacent restaurant led to the tragedy,” a fire official said.All other possibilities, including that of short circuit, is also being probed, he added.The police have booked Hratesh Sanghvi, Jigar Sanghvi and Abhijeet Manka of C Grade Hospitality, which manages the pub, along with others, under IPC sections 304 (culpable homicide not amounting to murder), 337 (causing hurt by act endangering life or personal safety of others) and 338 (causing grievous hurt by act endangering life or personal safety of others).After the fire, some escaped to safety, while others found their way blocked by fire and suffocating smoke. Many panicked patrons took shelter in a toilet, where they were asphyxiated to death.Among those killed was Khushbu Bansali, the woman who was celebrating her 29th birthday at ‘1 Above’ pub in upscale Parel’s Kamala Mill compound, and several of her friends.The Brihanmumbai Municipal Corporation (BMC) yesterday suspended five officials, including those attached to the G- South ward for dereliction of duty. Despite the Brihanmumbai Municipal Corporation (BMC) administration being aware of that the restaurants were running illegally in Kamla Mills compound, it delayed action in the name of following standard operating procedure. Even, the civic administration showed its inability to share rules and regulations regarding the permit given to serve hookah in eateries.Dinesh Vaghela, an RTI activist said that the civic administration did not provide this information as they were aware that these eateries were serving hookah. “At any place where hookah is being served, no food item can be served,” said Vaghela. He added that the civic body violated rules and regulations while granting licence under section 394 of Mumbai Municipal Act.

Kamala Mills Fire: Activist’s efforts go in vain

As the issue of poor fire prevention systems was highlighted after the Kamala Mills incident in central Mumbai, activist Vihar Durve said that the corporation and the fire department did nothing to prevent such incidents despite several requests.Since 2005, Durve has written over 100 letters pointing out the inability of the BMC and the fire department in implementation of the Maharashtra Fire Prevention and Life Safety Measures Act 2006.He also filed over 200 RTI applications to the various departments of the BMC and fire asking about the status of its implementation. “Fire safety is compromised at all levels in the city as those who run big eateries easily bribe the corporation and get away with the violation of norms. Eleven years after the act for fire safety came into effect, there has been no action on those who do not follow the requisite norms putting the lives of ordinary people at stake” Durve told DNA.In a response to one of the RTIs filed by Durve, the Mumbai Fire Brigade stated that between 2012 and 2015, a total of 1,090 people were injured while 634 people lost their lives in fire-related incidents.The response also stated that the fire department had issued notices to a total of 1,502 owners/occupiers of premises that were not complying with the fire safety norms.Durve said that when asked about the details of compliance for each of the surveyed eateries between 2012 and 2015, the reply stated that the corporation did not have the consolidated details of the same.Another RTI put before the Indian Audits and Accounts department revealed that there was no audit of the fire and disaster management department between 2013 and 2015. “Even after writing to all the authorities and the Chief Minister consistently, there was no seriousness in implementing the 2006 guidelines” he said.

Kamala Mills Fire: Cops say no, but patrons say there were hookahs

Just two days prior to the deadly fire that broke out at the 1Above pub and restaurant in Kamala mills, killing 14 and injuring many more, the NM Joshi Marg police had taken action against 1Above for operating beyond the permissible time limit of 1:30 am.However, they have repeatedly turned a blind eye to the other violations at the pub such as hookah being served illegally, and loudspeakers being used on the rooftop. The police claimed that no hookah was being served at any restaurant in the complex.According to the police, the pubs and restaurants at the Kamala mills are a constant headache for them and they have raided several places in the compound where hookah was being served illegally. The police claimed that they regularly keep watch on these establishments and would fine them for violations.”On Thursday we had taken action against the 1above for flouting the time limit of running restaurant under the Maharashtra Police Act, Rs 12.500 fine was imposed on them. This is not the first time that the restaurant has flouted the permissible time limit. In this week this was the second action,” said a police officer from NM Joshi Marg police station.Dr. Sulbha Arora who had visited the 1above on Thursday confirmed to this paper that hookah was being served at 1 Above.When asked a senior police officer they denied that hookah was being served at any of the places, However, people who visited the place admitted that there was a hookah and many hookah pots and pipes were found at both the restaurants.”We visited Mojos on Friday night and hookahs were being served. We too had it,” said Khubchandani who visited the pub along with her friends for a birthday party.

Kamala Mills Fire: As 1 Above’s owners go into hiding, police to issue LOC

NM Joshi police are on the lookout for three partners of pub 1 Above after they allegedly went into hiding following a massive fire that broke out in their premises in the wee hours of Friday. The police are trying to gather CCTV footage of 1 Above and adjacent Mojo’s Bistro to get more clues as to how the fire occurred. The police had also initiated process of issuing Lookout Circular against those named in the First Information Report (FIR).According to the police, around 12.27 am, fire occurred at 1 Above and soon spread to the adjacent’s Mojo’s Bistro. “We have booked Byculla residents Kripesh Sanghvi, Jigar Sanghvi and Abhijeet Mankar who are owners and partners in Sigrid Ospitalita and Entertainment LLP that runs 1 Above in the said case, among others,” said Senior Police Inspector Ahmad Pathan of NM Joshi Marg Police Station.In their FIR, the police had alleged that C-Grade Hospitality and Entertainment LLP, 1 Above establishment’s manager and other staffers had not taken required fire safety measures for its patrons which led to the mishap.“The accused persons had knowingly and negligently put up obstacles at the emergency exit door of the establishment due to which the patrons who had visited the premises had suffered injuries in the fire, while some of them even succumbed. The accused persons did not provided any help to the patrons and fled from the spot,” the FIR notes.“We have recorded statement of at least 20 witnesses and as per them the fire started from 1 Above and spread ahead. As of now we have not been able to establish contact with any of the owners and staffer from 1 Above. We have put their mobile numbers on surveillance and are in the process of issuing Lookout Circular against them. Kamala Mills fire: Lack of ventilation was primary reason people died, say doctors

The post-mortem report of 14 deaths due to fire at ‘1 Above’ in Kamala Mills, Lower Parel has revealed that people lost their lives due to suffocation. Doctors in KEM Hospital stated that due to lack of ventilation 14 people lost their lives. All of them were found inside the toilet and were unconscious when rescued by the fire brigade authority.“The people who died tried to save themselves from the fire by hiding in the toilet but faced suffocation due to a mixture of chemical gases. While bodies were handed over to the family members after post-mortem, blood samples were preserved for further chemical analysis. Primarily, blood samples from all the deceased were seen of cherry red color which indicates mixture of carbon monoxide combined with haemoglobin. All died due to asphyxiation, none of them have died in flames but due to fumes. A proper evacuation plan could have avoided this,” Dr Harish Pathak, head of the forensic department, KEM Hospital.Dr Rajesh Dere who performed post-mortem at KEM Hospital said, “there are hardly any burn marks on the deceased people’s body. These people would have locked themselves with an aim to saves their lives and escape a fire.”Besides KEM Hospital, injured were also shifted to other hospitals such as Masina hospital, Breach Candy hospital, Hinduja hospital, Bhatia Hospital and civic-run Sion hospital. While the majority of the injured were discharged from all the hospital, 14 injured are taking treatment at Bhatia Hospital.“Three people have been admitted to the burns unit with 15 to 30 per cent burn injuries of which two are in critical condition. The patients are showing improvement. Other 11 patients are in stable condition and will be discharged within three days,” said a spokesperson from Bhatia Hospital.”

Kamala Mills tragedy: Pub claims fire emanated from ‘adjoining quarters,’ rejects cops’ version on safety violations

Claiming that it had all the fire safety regulations in place, the ‘1 Above’ pub, where a massive blaze killed 14 people, where a massive blaze killed 14 people, on Friday said that the fire emanated from the “adjoining quarters” to the establishment. In a statement, ‘1 Above’ rejected the claims made by Mumbai police and civic officials which said that pub did not follow fire safety norms, violated regulations and its staff fled from the scene after the fire erupted. “The facts of the incident, as seen by our staff, indicate a rising fire that began to emanate from the adjoining quarters to 1Above. We presume the unmanageable nature at the preliminary source of the fire resulted in it’s escalation to our property where all owners, staff and restaurant management from 1 Above engaged immediately in clearing the crowd from the establishment,” it said.It added, “There was no escape from Mojo’s Bistro therefore we believe that all their guests were told go through the premises of 1Above as we have an emergency exit. Hence patrons from Mojo’s Bistro also began to rush into our premises as we helped the Fire Brigade that had arrived at the scene to evacuate guests. All our premises are well inspected and we have the requisite permissions for the same.” The managment of the ‘1 Above’ pub claimed that there were over 10 fire extinguishers and “adequate fire safety signatures” in the premises as is required by the authorities.”1Above has all it’s fire safety regulations, licenses, procedures and norms in place – we have been able to help save many lives thanks to our fire safety protocols and are grateful to our staff for their presence of mind and help in this time of crisis,” it said. 1Above conducts a quarterly fire safety and crisis management training, it said. Earlier, Mumbai police and civic officials said the pub did not follow fire safety norms and violated regulations on encroachment with obstructions blocking its emergency exit.Contrary to the claim by 1Above, police said, the pub’s manager and other staff fled from the spot instead of helping the customers injured in the blaze.”No fire safety norms were followed by the pub and the management did not make any arrangement for the safe exit of its customers during the blaze,” police said.They said there were hindrances created on the emergency exit way. “Negligence on the part of the pub led to the death of 14 customers and injuries to several others.” “The manager and other staff of the pub ran away from the spot without helping those injured in the blaze,” police said.Meanwhile, a civic official told PTI the Brihanmumbai Municipal Corporation (BMC) had taken action against the pub more than three times for “violations”.According to the official, the pub had obtained the fire safety and building permissions from the civic body in October 2016.”However, as ‘1 Above’ flouted the rules and regulations by way of encroachment and other violations, the BMC had taken legal action against its management on May 27 for using the open space for commercial activities,” he said.Notices had been served on the pub on August 4, September 22 and October 27 this year by the BMC, asking it to stop encroaching on the open space, he said.”On August 2, we razed a portion of the pub for encroaching upon the open space. Thereafter, on October 22, we seized the open space, where it illegally served the customers. Despite that, the owners of the pub had indulged in violations,” he added.The fire started at the rooftop of the pub which was hosting a birthday party and spread rapidly through the building, killing 14 people, most of them women, shortly after midnight.The police have booked Hratesh Sanghvi, Jigar Sanghvi and Abhijeet Manka of C Grade Hospitality, which manages the pub, along with others, under IPC sections 304 (culpable homicide not amounting to murder), 337 (causing hurt by act endangering life or personal safety of others) and 338 (causing grievous hurt by act endangering life or personal safety of others).The case has been lodged at the N M Joshi Marg Police Station. One of the victims of the Kamala Mills fire was Ahmedabad-based Yasha Thakkar. A chartered accountant by profession, Yasha was in the city and had attended a dinner event, had paid her bill and went to the washroom on her way out, when she was trapped in the flames that killed her.Yasha had even survived a brush against death last New Year’s Eve when her car caught fire. Kamala Mills Fire: Two young men enter into death trap to save aunt, never to come back

A fire that started at a rooftop pub “1 Above” spread rapidly through the building , killing 14 people, most of them women, shortly after midnight on Thursday, in a posh Mumbai locality. Amid the horror and fear, there were two young men who dared to challenge death and managed to rescue nearly eight members of their family who were enjoying a family get-together. Dharya Lalani, 26, worked in the United States. He had come to visit his family for a month before taking up a new job in US. Dharya’s younger brother Vishwa Lalani, 23, wanted to have a nice time with his brother and other family members. They were partying at London Taxi restaurant–a rooftop restaurant, adjacent to ” 1 Above” pub–when they got caught into the fire and smoke. The fire reportedly started from ” 1 Above” and soon the smoke engulfed London Taxi restaurant. Both the young men did not panic and helped all the family members get out sefely from the restaurant. Just when they were thanking God for this miraculous escape, horror visited them again. Pramila Kenia, 65, there aunt was no where to be seen. Then they realised she had gone to the washroom and was trapped there. There was nothing else but smoke. A death trap of smoke. But Vishwa and Dharya did not hesitate for a second and entered into the thick clouds of smoke, determined to bring their aunt back. The fire that engulfed Kamala Mills late Thursday and claimed 14 lives has left the city reeling and leaving its citizens asking questions.On Friday, Mumbai BJP President Ashish Shelar said that one needed to review several parameters before handing over permissions to rooftop restaurants in future, while the owners of the Mojo, which is located a floor below 1 Above, where the fire broke out said, “We are extremely saddened by the incident. Mojo’s has all its fire safety norms, certificates and procedures in place. The staff are thoroughly trained in fire drills hence our staff were able to evacuate all our guests and themselves out to safety with zero injury. There were NO cylinders on our premises. A similar case was reported when Escobar, a popular nightclub in Bandra was gutted in October 2014. Then, too, it was discovered that the pub had flouted fire-safety regulations. With Yuva Sena Chief Aaditya Thackeray announced that he was working towards making Mumbai a 24×7 city, people rejoiced. Services were stopped after a power failure near CBD Belapur. However, a video shared by veteran railway journalist Rajendra Aklekar highlighted how an accident was waiting to happen. The video shows a train moving, but the electric cables that usually power the locomotives dangerously close to the coaches, which could have resulted in a major accident.People still talk of the spirit of Mumbai. Mumbai Fire | ‘Don’t know how I got out alive,’ survivor recalls inferno horror

Mumbai woke up to a dreadful news about massive fire at a commercial complex in Lower Parel area on Friday.Latest reports say that 15 people were killed and several injured in the midnight tragedy.Amid reports of loss of lives, there were some who luckily survived the inferno.Among those was a Mumbai gynaecologist Dr Sulbha KG Arora. In her tweets, she recalled how she miraculously survived the fire.Narrating the incident, she said, “The Kamala Mills fire started at 1 Above. I was there and barely made it out alive. Some were not so lucky. Praying for the injured and the deceased. It was the scariest thing I have ever survived!”In another tweet, she said talked about stampede in the pub and scenes after that. “There was a stampede and someone pushed me. People were running over me even as the ceiling above me was collapsing in flames. Still don’t know how I got out alive. Some powers were definitely protecting me,” Dr Arora said in her tweet.The fire broke out shortly after midnight on the third floor of the four-storeyed building on Senapati Bapat Marg, a commercial hub of the city, a civic official told PTI.”The cooling operations are underway. Some of the injured people are in critical condition,” the official said.The injured are undergoing treatment at the civic-run KEM and Sion hospitals, the official from the BMC disaster management unit said.The fire that started little after 12 am on Friday was completely doused around 2:30 am.(With PTI inputs)

Kamala Mills Fire: ‘Postmortem reveals all the deaths due to suffocation’ in Mumbai

Fifteen people were killed and 19 others injured after a major fire broke out in a building in Kamala Mills Compound in Lower Parel. All the deaths were caused due to suffocation, reports ANI. ” 14 deaths were due to suffocation,” said Dr Rajesh Dere who performed the postmortem. According to DNA reporter, one person took shelter in the washroom but died due to suffocation. The majority of those killed were women attending a birthday party at a rooftop restaurant, police said. The 28-year-old woman celebrating her birthday was among those who died, her grandfather told news agency Reuters.According to the official, the cause of the fire remains to be ascertained. Primary observations indicate that gas leakage or short circuit could be the reason behind the fire. The fire soon spread to the media offices belonging to Times Now and TV 9 news networks. BMC officials confirmed to DNA that 11 people had died and 14 were injured. The fire broke out at 12:30 and was controlled by the Mumbai Fire Brigade by 2 am. However, rescue operations continued till late in the night. The injured were treated in the nearby KEM hospital.Anxious relatives and onlookers were seen waiting for the rescue of their near and dear ones. A senior staffer from Times Now whom DNA spoke to on the spot confirmed that all media personnel from the network were safely rescued before the fire could spread in the office.Fire brigade sources claimed they received a call around 12.30 am about the fire. Eight fire tenders, four water tankers and one ambulance were rushed to the scene immediately.The complex houses many pubs, bistros and eateries and is a popular venue for many party goers in the city. Fire breaks out in Mumbai’s Kamala Mills Compound, three injured

At least three persons were injured when a major fire broke out tonight at a building in Kamala Mills Compound in Lower Parel, an official said.The fire started after 12:30 am on the third floor of the building on Senapati Bapat Marg, a commercial hub of the city, a police official said.More than six fire tenders, four water tankers, emergency ambulance and police rushed to the spot for rescue operation, he said.The building, in Central Mumbai, houses some commercial establishments including hotels.Three persons with serious burn injuries have been taken to the Breach Candy hospital, the official said.”It’s a Level-II fire and we have mobilised our resources. The fire fighting and rescue operation is going on,” he said, adding that the exact cause of the fire is yet to be ascertained.

3 gangrapes in last 2 weeks, no arrests made

The last two weeks have witnessed three alleged gangrapes and two rapes of minors in the Capital. Even as the Delhi Police claims, with statistics, that the number of rapes has declined compared to the past years, some of these cases are yet to witness any arrests.On December 16, a 16-year-old girl was gangraped while her male friend was beaten up and robbed by three men in a park in northwest Delhi’s Shalimar Bagh. Police had said that efforts to identify the accused are being made. However, no arrests have been made even two weeks later.According to senior police officials, the matter was reported by the victim to her family which approached the police. According to the complaint, the minor victim used to work as a housemaid and was sitting with her male friend in the park near Haidarpur Slums in Shalimar Bagh area, when the three accused arrived and forcefully took her to a secluded corner and raped her in turns.DCP northwest, Aslam Khan told DNA that they are yet to make any arrest in the case and that the probe is on.Over the past two weeks, the Capital has witnessed many similar cases. Just five days later, on December 21, a 20-year-old woman was allegedly gangraped by five youths inside a park in northwest Delhi. Two days after this, on December 23, a 19-year-old woman was allegedly gangraped by two men who had offered her a lift from Gurugram and then dropped the woman at Dwarka.The very next day, an elderly man sexually assaulted two minor girls in southwest Delhi’s Palam area. The accused was arrested from his residence. On December 26, the police again claimed to have arrested a man who repeatedly raped a 14-year-old girl for 13 days in Madhya Pradesh, after kidnapping her from northwest Delhi. The minor was rescued and man was arrested from Chhatarpur in MP.Just a day after this, on December 27, a model alleged that she was gangraped by three men in Sarojini Nagar, whom she had met at a hotel in Mumbai on the pretext of giving her contacts in Bollywood. The police arrested three men.According to the NCRB, last year the conviction rate in crimes against women fell to 18.9 per cent – the lowest in a decade. 60% school buses don’t follow norms

More than 1,000 schools in the city have their own school buses. The School Bus Owners Associations (SBOA) have alleged that around 60 per cent of the school buses don’t follow the government norms of school bus safety for school children. The SBOA has threatened the transport department to go on strike from JANUARY 20th if they don’t do away with illegal vans that ferry school children beyond their seating capacities.The SBOA wrote a letter to Chief Minister Devendra Fadnavis stating how the school bus owners are incurring losses because of the illegal vans which are transporting children at low fare, thereby impacting their business negatively. The association has urged the transport department to take action against all school buses that have made no agreement with the schools. The association also wants the transport department to pull up vehicles like jeep, mini bus, tempo traveler and Omni, which are functioning without the permission of the schools.Anil Garg, President of SBOA, Maharashtra, said, “Several vans are ferrying without permits. They carry students inside the van beyond its seating capacity. The 11,000 vans that are given permit by transport department are illegally carrying children above 12-year-old, which is not allowed as per the rule of the transport department. There are around 40,000 mini vans that are illegally ferrying school children. With this, we would get a chance to make our stand on the issue clear in the right manner” said Tawde.On Wednesday, the NHRC issued a notice to the state Education Department taking cognisance of its decision to close down 1,300 Zilla Parishad schools with less than 10 students and shift them to other nearby schools. The Commission observed that ‘the reported decision of the State Education Department would adversely affect the students, particularly, those coming from the rural background and cannot afford education in private schools’ and asked the government to submit a detailed report within four weeks.Tawde said that despite all the criticism that the move has got, it is aimed to make education more ‘inclusive’. “Students who are studying in schools with less than 10 students have no socialisation. Month-long Pride Week from Jan 5

The Queer Azadi Mumbai (QAM), an LGBTQ movement, will have month-long events starting from January 5, 2018 till February 3.The Pride March on February 3 is expected to be bigger and have more events compared to last years. Corporate giant Godrej will be organising a number of events.”There will be queer networking and queer theatre now besides queer aethetics,” said Parmesh Shahani, head of Godrej India Culture Lab, which is a culture space that the company started to promote culture conversation in city.”Corporates have been talking to us but not many have opened up as yet,” said Harish Iyer, an LGBTQ activist.Section 377, which has often been an impediment, is the prime focus of QAM. The pride month will trend with the hashtag of #377QuitIndia. In a first, it will have a stage performance by Asmita Theatre Group and Harmless Hugs, in collaboration with Gay Bombay.There will also be plays, questions and answer sessions and ways in which people from different cities can familiarise with each other.

Declare my area as Silence Zone: Sumaira Abdulali

Anti-noise pollution activist Sumaira Abdulali has written to the Brihanmumbai Municipal Corporation Chief seeking that the Nargis Dutt Road in Bandra West, where she resides, be declared as a Silence Zone and a No-Honking Zone. This has come after the BMC failed to take any concrete steps to begin re-notifying silence zones in the city, four months after the Maharashtra State Government de-notified all the existing silence zones of Mumbai.Explaining her stand she said that under the existing Noise Pollution and Motor Vehicles Rules, citizens can apply to have their residential or mixed areas be declared as Silence Zones/No-Honking Zones.”I have recommended this road as its a residential area and the people living in various buildings here including me are getting affected by the high decibel levels and hence I have decided to take a lead. I have also made it clear that this should be done after proper consultation with the residents living here,” stated Abdulali. She has been urging citizens to make similar applications to the BMC for a declaration of their areas as Silence Zones/No Honking Zones and that authorities should realise that citizens need their silence zones back.As per State Government’s interpretation of the Noise Rules amended on August 10, 2017, silence zones earlier identified and declared by the BMC were no longer in operation as they had not been specifically notified by the State Government. “In the period from August 2017 till date, silence zones have remained unprotected and there is not even clarity about whether loudspeakers can be used or needs to be removed and in all there is lot of confusion, which has been causing great hardship to residents of Mumbai and making them vulnerable to health issues caused due to noise pollution,” shared Abdulali.Several other anti noise pollution activists also alleged that they have no clue about steps being taken by BMC doing about notifying silence and no honking zones in the city as the civic body seems to have completely forgotten about this issue.The silence zone rules were first implemented in September 2, 2003 after Bombay High Court ordered the police to verify and certify before granting any loudspeaker permissions in a Silence Zone as defined under the Noise Rules.Infact on July 18, 2005, the Supreme Court of India ordered other noise sources such as honking to be added to the prohibitions in Silence Zones. In February 2009, the Court ordered the Government to identify and put up Silence Zone boards within one week after which the Ward offices of the BMC identified more than 1200 Silence Zones in Mumbai and put up boards on site with the help of citizen groups.

Western Railway to deploy 232 MSSC staff for women’s safety

In the backdrop of the Elphinstone stampede killing 23 commuters and injuring to nearly 40, the Western Railways (WR) on Thursday said that it will deploy 232 Maharashtra State Security Corporation (MSSC) personnel and 97 female home guards for strengthening security and managing crowds of suburban commuters especially women commuters.This will be in addition to the existing manpower of the Railway Protection Force (RPF). A K Gupta, General Manager, Western Railway (WR), said, “Security in trains and on platforms has always been the requirement. We hope that deployment of the additional security staff will help the RPF to monitor security more efficiently.”Gupta added, “Prior to this, we installed CCTV cameras. We also have a dedicated application and a 24-hour helpline for the safety of commuters, especially women commuters. With the additional security arrangements, we are going to increase our security by nearly 33 per cent.The additional security force was given a two-day induction by the RPF before their deployment. The additional security force will also control and monitor crowds during morning and evening peak hours, apart from guarding isolated spots on the western line.The WR said that it has identified around 37 vulnerable stations. The stations where additional security force will be deployed include Churchgate, Grant Road, Charni Road, Mumbai Central, Elphinstone Road, Dadar, Mahim, Bandra, Khar Road, Santacruz, Jogeshwari, Andheri, Goregaon, Malad, Borivali, Bhayandar, Nalasopara and Virar.SAFE COMMUTE PLANThe additional security force was given a two-day induction by the RPF before their deployment. The WR has identified 37 vulnerable stations. Some of them incude Churchgate, Grant Road, Charni Road, Mumbai Central, Elphinstone Road, Dadar, Mahim, Bandra, Khar Road.

ATS used Rakesh Dhawade to invoke MCOCA charges, says NIA

The Special National Investigation Agency (NIA) court in its detailed order copy, talking about stringent Maharahstra Control of Organised Crime Act (MCOCA) charges being dropped against the accused arrested in the Malegaon 2008 case has pointed out how Maharashtra Anti-Terrorism Squad (ATS) used the accused Rakesh Dhawade to invoke MCOCA charges in the case. The court, in its 130-page order copy mentioned that though Abhinav Bharat was not existent in 2003-2004, even then Dhawade was shown as a member of Abhinav Bharat and was dragged into the case.The court on Wednesday dropped the stringent MCOCA charges off all the accused and held them guilty of the Unlawful Activities Prevention Act (UAPA). Meanwhile Dhawade and one more accused were let off from the MCOCA charges and were only charged with the Arms act case. While three more accused were totally let off from the charges, whereas accused like Sadhavi Pragya Singh Thakur and Lt.Col. Prasad Purohit were charged with UAPA and other IPC charges.The court held that according to the ATS, Dhawade was involved in the bomb blasts at Parbhani in Mohamadiya Masjid which took place on November 21,2003 and the blast in Kadariya Masjid at Jalna which took place on August 27,2004. ATS claimed that Dhawade was the member of the Abhinav Bharat, the crime syndicate and that there was a prima facie evidence against him.”However it is to be noted that Dhawade was never ever arrested in the case anytime earlier, nor was he ever shown absconding or wanted by the ATS when the agency had charge sheeted other accused in the Jalna and Parbhani matters. However suddenly after Dhawade was arrested in the Malegaon 2008 blasts case on November 2,2008, he was immediately implicated in Jalna and Parbhani matters,” the order copy stated.”It appears from the recitals in the charge sheet in both cases that according to the prosecution the accused who were arrested and chargesheeted in those offences were connected with either Bajrang Dal or RSS.SIGH OF RELIEFATS claimed that Dhawade was the member of the Abhinav Bharat Dhawade and one more accused were let off from the MCOCA charges and were only charged with the Arms Act case.

Fadnavis govt offers cash incentives to Maharashtra cities that perform well in Swachh Bharat rankings

After discouraging performance in the ‘Swachh Survekshan’ or cleanliness survey last year, Maharashtra government has decided to offer cash incentives to rank holder cities in clean city initiative. Chief Minister Devendra Fadnavis has proposed to give incentive to municipal corporations and local bodies for scoring a good place in the Swachh City rankings.The state government would be offering incentives to cities from the state which would secure place in the first 50 clean cities. Last year, Navi Mumbai was on rank 8 and it was the only city from Maharashtra in the list of ten cities at the national level. The second dirtiest city was Bhusawal from Maharashtra , after Gonda in Uttar Pradesh last year. Mumbai’s position dropped to 29 in 2017 from 10 in 2016. These rankings are a part of the Swachh Bharat initiative launched by Prime Minister Narendra Modi.Chief Minister Devendra Fadnavis on Wednesday reviewed Maharashtra’s preparedness for the survey which would start in January and is conducted by the Quality Council of India (QCI). Fadnavis has announced a prize money of Rs 20 crore to the cities that are covered under the scheme Atal Mission for Rejuvenation and Urban Transformation (AMRUT) and Rs 15 crore for cities securing a rank from 4 to 10. For cities like Mumbai which are not part of AMRUT scheme, the three toppers would win Rs 15 crore, top 10 would get Rs 10 crore and cities securing rank between 11 and 50 would get Rs 5 crore as incentive.Fadnavis has also announced a ‘Swachh Ward,’ or clean ward competition and said that a third party survey for all Municipal corporations in the state would be conducted between January and February 2018. The first three wards of ‘A’ and ‘B’ category corporations would be given Rs 30 lakhs, Rs.20 lakhs and Rs.15 lakhs, respectively and ward from the C and D corporations would get Rs.50 lakhs, 30 lakhs and 20 lakhs and wards of ‘C’ and ‘D’ category corporations respectively.This would be the third survey to be conducted in 2018, first was conducted in 2016.The Department of Industrial Policy and Promotion (DIPP) under the Ministry of Commerce and Industry is the nodal ministry for the QCI. They have covered 434 cities and towns with a population of 1 lakh and above. The survey aims at capturing the outcomes of ongoing efforts to stop open defecation in urban areas and to improve the door-to-door collection, processing and disposal of Municipal Solid Waste.

Cong city chief writes to CM Devendra Fadnavis over Metro mess

The Mumbai Regional Congress Committee president Sanjay Nirupam has appealed to Chief Minister Devendra Fadnavis to convene an all-party meeting to discuss huge traffic snarls caused by the ongoing construction of the Metro line between DN Nagar and Dahisar. In a letter to Fadnavis, the city Congress chief said that he was not against the work being carried out which will to improve Mumbai’s infrastructure but hourly traffic snarls along the entire stretch have elongated a simple 30-40 minutes journey to a two-and-a-half hour ordeal.Nirupam said the traffic has also jacked up commuting cost in areas seeing maximum congestion. These include Infinity Mall, Inorbit Mall Meeth Chowki, Goregaon, Charkop and Borivali West. Double parking adds to the woes, he noted, adding, “The traffic police is not taking any action to solve this problem.”Nirupam said due to ongoing construction it has become impossible for residents to manage even a good night’s sleep. He iterated that the CM needs to convene meeting with representatives of all political parties and officers from the Brihanmumbai Municipal Corporation, traffic police and Mumbai Metropolitan Region Development Authority to ensure a comprehensive solution to end these problems.

CBI officer held for illicit Tatkal software scam

The CBI busted a railway ticketing racket on Wednesday by arresting one of its own programmers. The scam impacted lakhs of citizens across the country as many failed to get confirmed tickets, especially tatkal ones, because of it. It also exposes the vulnerability of Indian Railway Catering and Tourism Corporation (IRCTC) software.Ajay Garg, an assistant programmer with the CBI since 2012, was arrested from Delhi. His associate Anil Kumar Gupta was nabbed from Uttar Pradesh’s Jaunpur and is being brought to Delhi on transit remand.The agency has registered a case of criminal conspiracy under Sections of the Information Technology Act for making an illegal railway ticketing software. The accused had developed a tatkal (ticketing at short notice) software with distributor Gupta. They sold the software to tour and travel operators across the country.Travel operators using this software booked tickets in advance and created a shortage.Garg received payments through Bitcoin and hawala routes. Before joining the CBI, he worked as a programmer with the IRCTC from 2007 to 2011, and knew the vulnerabilities of the ticketing software of the Railways. Garg knew that the software used by the Railways allowed him to book hundreds of tickets in the morning. He used 800 to 1,000 customer IDs at one go.The CBI has also identified 10 travel agents who were using this software. They include three of Mumbai and seven of Jaunpur.Garg was using proxy and foreign servers to remove any trail.It was also alleged that Garg was collecting money for the use of the software by certain booking agents and had amassed huge wealth. It was also revealed that Gupta on behalf of Garg was allegedly receiving money from dealers for the use of the software through Bitcoin and hawala networks.Searches were conducted at 14 places, including Delhi, Mumbai and Jaunpur, which resulted in recoveries of Rs 89.42 lakh, gold jewellery valued at Rs 61.29 lakh, 15 laptops, 15 hard disks, 52 mobile phones, 24 SIM cards, 10 notebooks, 6 routers, 4 dongles, 19 pen drives and other incriminating material from the premises of the accused and others.

Mumbai cops refuse to file FIR against builder: Lawyer

A Sion-based lawyer, allegedly the victim of fraud builder, says his woes have been worsened by Mumbai police’s reluctance to register an FIR against the builder. Builder Uday Surve has allegedly cheated over 2,000 homebuyers and investors to the tune of Rs 150 crore under the pretext of redeveloping buildings built by the Maharashtra Housing and Area Development Authority (MHADA). Advocate Deepak Thakur, a resident of Sion, is one of the victims.He has been trying to register a case against Surve, Managing Director of Shubh Enterprises for duping his father Prem Kumar Thakur of Rs 22 lakh since 2015 when he realised that he was cheated. Prem Kumar is a retired Army office, and was promised a flat in Surve’s Shiv Shakti project at Kurar village, Malad. “We paid for the flat in 2012 and were promised possession in 2014,” says 34-year-old Deepak. “We were repeatedly given false assurances of possession, and when we asked for a refund in 2015, he refused.” Deepak said that when he approached Kasturba Marg police to register the complaint, they refused to file an FIR, saying it was a civil matter.“This is despite me telling them that its a criminal case,” says Deepak.Dr. Vinay Rathod, Deputy Commissioner of Police, Zone 12, said, “I am unaware of such an incident. I will enquire about it with the subordinates.”According to the Economic Offences Wing, Surve has been booked in 16 criminal cases across the city.The case against Surve has been probed by the Maharashtra Protection Of Interest Of Depositors and Housing Units of EOW.Surve faces charges of cheating and forgery under the Indian Penal Code and the Maharashtra Ownership of Flats Act (MOFA), 1963. Surve and two other accused ran Shubh Enterprises and had undertaken several projects to redevelop a housing society at DN Nagar. The trio sold the same flats to multiple buyers. Surve is behind the bars in Mumbai’s Arthur road jail.“Surve and his accomplices sold the sale components of redevelopment projects without procuring the requisite permission, and in some projects, constructed up to 10 storeys without procuring Commencement certificate (CC) and Intimation Of Disapproval (IOD) from the concerned authorities,” said a senior EOW officer. “We have attached the assets of the accused and both investors and flat buyers have filed the complaints and we are on the verge of recovering the money from the accused.”

ED attaches more assets, worth Rs 177 cr, in NSEL scam

The Enforcement Directorate (ED) on Wednesday provisionally attached fresh assets valued at over Rs 177 crore in connection with the money laundering case against NSEL.The officials have attached 10 immovable properties of Surender Gupta of PD Agro Processors Pvt Ltd and Dunar Foods Ltd, a major defaulter of NSEL having a market value of Rs 177.33 crore under the Prevention of Money Laundering Act.The total worth of attached assets in the case stands at Rs 2,890 crore.The ED officials said the company, P D Agro Processors Pvt Ltd, has fraudulently obtained huge funds from NSEL by trading on the exchange platform against the non-existent/fictitious sale of their commodity, which is paddy/rice. The money trail has revealed that a huge chunk of proceeds of crime has been transferred to M/s Dunar Foods Ltd, a sister concern of PD Agro Processors Pvt Ltd.”The ED, along with the Economic Offences Wing of the Mumbai Police, had registered a criminal case in 2013 under the PMLA to probe NSEL and others associated with it for defrauding 13,000 investors to the tune of Rs 5,600 crore.

Making Std XI exams tougher will not help

Educationists have slammed state education department’s efforts to make Class XI exams tougher for students to prepare them for national-level competitive entrance exams like JEE and NEET. The opposition comes in the wake of the state board’s recent decision to change the paper pattern for Class XI to make the exams tougher. DNA had earlier reported about the state’s decision to conduct the Maharashtra State Common Entrance Test (MHT-CET) for engineering and medical courses on a par with the Joint Entrance Exam (JEE) starting 2018. Following this, the state board started a preparation portal for competitive exams. And finally, the board changed the paper pattern for Class XI. Some changes included making it compulsory for students to solve all questions without being given options, not following syllabus weightage, and so on. Anil Deshmukh, general secretary of the Maharashtra Junior College Teachers Federation, said the move is causing more harm than good. “The new paper pattern has no logic. It does not follow basic things like sticking to chapter weightage. So a large number of students are failing in Class XI. If this continues, students would appear privately and stop coming to colleges,” he said. Subhash Joshi of Science Parivar, a coaching institute, said, “The government has to understand not all students sit for entrance exams. Also, any such revision requires a revision in syllabus too.”

Anti-eve-teasing squads to keep eye on eve-teasers among new year revelers

In order to avoid eve teasing instances during the new year celebrations, the Mumbai police would be setting up Anti-Eve-Teasing squads at Gateway of India and Marine Drive. The statistics provided by Mumbai Police revealed that there has been over 2000 molestation cases already registered in the city this year till November. However, police sources confirmed that the idea of using drones to keep a check on the activities of party goers at Gateway of India has been dropped.”The anti-eve-teasing squads would have women police persons too. Their primary responsibility would be to keep watch on movements of revelers and to take action against those who harass women. The utmost priority is towards women safety. Those in this squad will roam in public places like Gateway of India, Marine Drive and Girgaum Chowpatty in plain clothes and would keep eyes on anti-social elements. Action will be taken on those who are found indulging in any crime. ,” said a senior police officer.According to the statistics from Mumbai Police, from January till November this year 2046 molestation cases were registered and 1667 persons were arrested in these cases in the city.”The squad is particularly important to ensure women are safe in the crowded places as in the past there had been instances of women being groped by a group of men on New Year night in the city,” said the officer.WOMEN’S SAFETYStatistics provided by Mumbai Police reveal that there have been over 2,000 molestation cases already registered in the city this year until November. New TDR policy to way to more high rises in Island city

There will be more high-rises in South Mumbai as developers are now permitted to use the transferable development rights (TDR) in Island city that will make redevelopment projects viable there.According to the Brihanmumbai Municipal Corporation (BMC) circular, developers had sought clarifications over the use of TDR from the state. “State government informed that the developers/promoters can use TDR in Island city up to 0.67 TDR against road set back, heritage, slum TDR,” a senior BMC official said.As per the circular, TDR has been given in proportion of returning land for widening road width. In cases of redevelopment, if the developer proposes to keep 9 metre and above, and less than 12.20 metre of road width, then the permissible TDR is 0.17 in the city and 0.50 TDR in suburban district. If road width is 12.20 metre and above and less than 18.30 metre, then allowed TDR is 0.37 here and 0.70 in suburbs. The cap is 0.67 TDR is in the Island city and 1.00 in Suburb if the road width is proposed 30 metre and above.Milind Samel, senior architect said the new TDR policy is a win-win for both developers and residents. “In Mumbai, there are more than 16,000 old buildings that urgently need to be redeveloped. With the additional TDR, more developers will take up projects. Now, undertaking redevelopment project in Island city will be more feasible for developers,” Samel said.Boman Irani, CMD at Rustomjee Group welcomed the state government decision. He said that the government should provide maximum incentives so that the redevelopment of the old and dilapidated buildings can takes place. “In South Mumbai, the sizes of plots are quite small so that the developers do not offer bigger size of houses to existing tenants/residences. And that became the deadlock for the redevelopment. Now, with the higher TDR, uploading in Island city will able to put the more floors in buildings,” Irani said.

No parking at Gateway & Marine Drive on New Year’s eve

In order to ensure a peaceful and less congested New Year, the Mumbai Police has made special security & traffic arrangements at the iconic Gateway of India and Marine Drive.There will be a segregation of the crowd — that is, there will be a different walkway for families and another one for youths who are not accompanied by women. Also, at these places, no vehicles, including two-wheelers will be allowed to park near the Gateway of India or at Marine Drive. This is mainly to keep roads free of vehicles and from a security point of view.Every year, thousands of citizens visit the Gateway of India and Marine Drive for New Year celebrations, thereby posing a great challenge for the police to provide adequate security. The area is considered to always be one of the targets for terrorists and anti-social elements and had also witnessed the deadly 26/11 terror attack.”All seven police stations from Zone I will be kept on toes for New Year. Quick Response Teams and Combat Vehicles of police will be posted at Gateway and Marine Drive. We will be conducting anti-sabotage checks to ensure no abandoned vehicles or goods are lying that can pose any security issue at these places,” said a police officer, requesting anonymity.He added, there has been a tendency among citizens to casually park their vehicles anywhere on the road and go for a stroll. “Keeping this tendency in mind, we have decided that on December 31, from 5 pm till the morning of the next day , no vehicles, including two-wheelers, will be allowed to park on Marine Drive and near Gateway. Vehicles can ply here, but can’t be parked during the said period. Citizens can park their vehicles at authorised parking space near Vidhan Bhavan and Mantralaya,” the officer said.HIGH SECURITYAround 400 CCTV cameras in South Mumbai to keep check on vehicular traffic & revellers activities Over 10,000 citizens expected to throng Gateway of India. Mumbai: Man evades arrest for 15 years, found hiding inside washing machine in his apartment

In a comical incident, a man who was absconding for 15 years was caught hiding in a washing machine at his own house! A Mumbai based man, Manoj Tiwari who has been evading arrest in connection with a cheating case was finally caught trying to desperately avoid detection inside a washing machine. According to reports, the man is lawyer by profession and is based in Juhu in suburban Mumbai. For three hours, his wife managed to bamboozle the police before they discovered him under a pile of clothes inside the washing machine. Accused was wanted in a cheating case dating back to 2002, when he allegedly duped three people of Rs 1 lakh. It was in connection with admission in B-ED course. The case was registered with Azad Maidan Police. The police had to search every nook and corner of the three-bedroom apartment before finally getting whiff that the accused has find a unique spot to hide himself. Currently police have arrested the accused and a case has also been lodged against his wife for obstruction of duty.

Mumbai Metro authorities don’t see the need to increase coaches despite commuter rise

The Reliance Infrastructure-led Mumbai Metro One Private Ltd (MMOPL) that connects Versova and Ghatkopar has seen a monthly increase in its commuters, which has resulted in a call for an increase in the number of coaches from four to six. However, MMOPL authorities have said that there is no need for the same, reasoning that the saturation point had not been reached as yet.Currently, there are 16 Metro trains that have four coaches that can be expanded to six coaches. In 2015, the average daily ridership was around 2.6 lakh, which increased to 3. lakh in 2016 on weekdays. However, this year, estimates show that the ridership is around 3.5 lakh on weekdays, with MMOPL announcing that November 2017 witnessed one crore commuters.An MMOPL, spokesperson, said, “”We are closely watching the ridership trends. At present, we are confident of meeting the increased demand and do not feel the need for additional coaches. We will increase the coaches when the need arises.”Also readMumbai Metro: Passengers take to social media to complain about ‘non-functional air-conditioning system’The spokesperson further stated that the need to increase coaches will begin only once Dahisar-DN Nagar Metro-2A and DN Nagar-Mankhurd Metro-2B will be operational.”The MMOPL’s expenditure to operate Metro-1 stood at about Rs 1,500 crore between June 2014 and June 2017. However, the latter could merely earn about Rs 640 crore in the form of ticketing and non-ticketing revenue in that period. The MMRDA owns 26% stakes in Metro-1 along with MMOPL that has 69% stake followed by Veolia that has a 5% stake.

After 7 yrs, MHADA back with lottery of 108 shops

After a lottery of nearly 820 homes, Maharashtra Housing and Area Development Authority’s (MHADA) Mumbai Board is all set to introduce an e-auction of 108 commercial premises, for which the process was initiated on Friday when MHADA published a tender seeking a bank through which it can complete the whole process.Of the total 108 commercial establishments, 36 are in Pratiksha Nagar in Sion, four in Mazgaon, 14 in Vinoba Bhave Nagar in Kurla, five in Swadeshi Mill in Kurla, seven in Mankhurd, five in Powai, 11 in Mulund, one in Jogeshwari, four in Shastri Nagar in Goregaon, one in Siddharth Nagar in Goregaon and the remaining 20 in Charkop in Kandivili.The process of finalising the bank is expected to be complete by the first week of January. On Friday, MHADA’s Mumbai Board issued a tender inviting the expression of interest from nationalised, scheduled and commercial banks for a total solution provider for an e-auction of the shops.A senior official from MHADA’s Mumbai Board said, “We are looking for a bank that will be holding the e-auction of the shops spread over Mumbai that belong to MHADA. After the bank is finalised we will carry out the e-auction.”The offset price for the 36 shops in Pratiksha Nagar is Rs 11.45 crore while for the one shop in Jogeshwari, it is Rs 41.09 lakh. The total offset price of the 108 shops is Rs 49.93 crore. While the last such MHADA lottery for commercial premises was held in 2010, this is the first time that the Authority will be holding an e-auction of commercial premises. Until now, the MHADA had always held a manual auction.Apart from this, the MHADA also recently started the construction of buildings in Wadala, where it will be constructing nearly 280 homes in the affordable segment. The Authority is trying to get these homes constructed at the earliest because the MHADA wants the homes to be a part of the forthcoming lottery. In the previous lottery, which was held in November this year, the Authority received a lot of flak because it had only eight homes in the Economically Weaker Section (EWS) segment.WHAT’S ON ANVILProcess of finalising the bank is expected to be complete by the first week of January. It’s the coolest one

It was jugaad and Prime Minister Narendra Modi’s Make in India initiative that ensured India’s first AC local train’s cost was less than half to what it would have been if the Railways had decided to buy from open markets.Sources said that these rakes are retrofitted with different parts and assembled as one piece. And so the cost is so low. “In the open market, a single fully made AC coach would cost nothing less than Rs 10 crore. This is more than double the cost at which we have manufactured this AC rake,” said a Railways official on condition of anonymity.Under MUTP-3, the Mumbai Rail Vikas Corporation will be procuring 564 AC coaches or 47 rakes of 12-car each for which tenders would be called soon. Sources said that these coaches will be more expensive than those which are being manufactured now.Despite there being 50-odd minor issues with the air-conditioned local train, the first day went smoothly. Over the next few days, railway authorities will be monitoring the social media to see how they can improve the experience for the Mumbai commuters.”We want Mumbaikars to tell us what changes they feel were necessary. They can tweet us, go to our website and give us a feedback,” said A K Gupta, General Manager, Western Railway.”This is a prototype rake and so it might have teething troubles but we are confident that people will have safe and smooth journey in it. We have addressed the issues and if in case anything arises then we will handle it. We shall iron out all those technical faults that we have encountered till now before introducing the next AC rake after 9 months,” Gupta said.Based on the feedback the WR receives from people and studying technical glitches that might arise while running of AC local; will the manufacture of second AC begin. These rakes are being manufactured by BHEL as part of 10 rakes that have been procured at Rs 54 crore per rake.COMMUTERS REVIEWI enjoyed the ride in the AC train but yes the fare needs to be lowered. The number of AC locals should also increase. Airport X’mas for stranded Air India passengers

The Christmas spirit was dampened for passengers travelling to India from the United Arab Emirates (UAE) as several flights from Sharjah, Dubai and Abu Dhabi were delayed or rescheduled owing to foggy weather conditions in the country. Flights to Mumbai and Delhi were delayed by as long as 12 hours, forcing several passengers to be stranded at the airports who then took to social media to express their displeasure over the delays.”Air India Express, terrible traveling service. Flight from Sharjah to Mumbai IX 252 delayed for more than 10 hours! No response from 24/7 helpline,” tweeted Raj Shah, one of the passengers. The Air India Express flight IX 252 was originally scheduled to take off from Sharjah Airport at 2.25 am on December 25 and reach Mumbai at 6.55 am, however, the flight took off at 4.34 pm on December 25.A source from Air India said, “The flights from Sharjah were rescheduled considering the weather conditions.” Repeated attempts to get in touch with a spokesperson of Air India Express did not yield any result.The Air India Express Mumbai-Sharjah IX 251 was also delayed by more than 12 hours. The flight was scheduled to take off from Mumbai airport on Sunday at 11.30 pm but took off 12.50 pm on Monday afternoon.Several flights were affected at Mumbai Airport on Monday as well due to traffic congestion.

Better mid-day meals soon

After a recent episode of food poisoning caused due to mid-day meal in a Jogeshwari school, the Brihanmumbai Municipal Corporation (BMC) have decided to pull up its shocks and bring the necessary changes. BMC’s education department has permitted Citizens Association Child Rights, an NGO, to hold workshop sessions for self help groups to help them improve the quality of mid-day meal, and serve variety of kichdis with the help of expert nutritionists.There are 257 self help groups in the city that serves midday meal to students of around 2,400 aided and BMC schools. The first session of the workshop was held in the first week of December in which around 70 such groups, including their helpers and cooks took part.A BMC education official said, “The self help groups are not just being given sessions by the nutritionists about how to improve the quality of food, but are also being trained to cook variety of khichdis that students will love to eat.”Nitin Wadhwani, founder director, CACR, said, “After our interaction with the groups, we will be submitting a complete proposal with suggestions to BMC for necessary improvements.”At least 27 students of Balvikas Vidya Mandir at Jogeshwari suffered food poisoning and landed in hospital due to vomiting and nausea following their mid-day meal served by a self help group, Chafai Mahila Bacchat Gat. The BMC immediately served notice to the school to stop the self help group’s service.
