Delhi High Court convicts man for rape of minor wife

A letter written by a minor Hindu wife from Nari Niketan to her Muslim husband lodged in jail on charges of kidnapping and raping her, led the Delhi High Court to acquit him of the abduction of his minor wife, though it upheld the sentence for raping his below 15-year-old wife.The story is a perfect plot for a Bollywood flick where a minor Hindu girl falls in love with an adult Muslim man. Both of them decide to marry but their religions were a hurdle. Madly in love, both decide to elope.However, the parents of the girl lodged a missing complaint soon after her disappearance in 2008 and after eight months their daughter was found with the man. When asked, the duo said they married each other and also gave a Nikahnama to prove their relationship.The girl said that she had gone with the accused on her own will. She also refused to go along with her parents following which she was sent to the Nari Niketan. The man was arrested and a chargesheet was filed against him under sections 363(Punishment for kidnapping), 366 (Kidnapping) and 376 (rape).The trial court found Sunil Khan, the accused, guilty and sentenced him to seven years of imprisonment for rape among other sentences. Khan filed a plea against his conviction following which Justice Pratibha Rani found that the girl had gone with her own consent with the accused, so it cannot be called abduction. The court also found that the girl had written letters to the accused while he was in jail. It said that the girl had ultimately agreed to accompany her parents only on the condition that no harm would be caused to her husband.”Her categorical admission that she was in deep love with the convict is also reflected in the letter sent by her to the convict from Nari Niketan, expressing her love and full support to him in the situation they were placed. She even informed him that she had been medically examined to ascertain her bony age, which was estimated to be 18 years,” the court said adding that the investigating officer has not preferred to clarify the situation in this regard.However, the court upheld the sentence awarded to the convict for raping his wife, who was below the age of 15. It modified the sentence for the offence to rigorous imprisonment of two years and since the convict had already served the punishment, he was let free.”It is the case of the prosecution that on the date of leaving the house she was aged about 13 years. Thus, at best, prosecution’s case can be that the convict had physical relations with his wife who was below 15 years of age,” the court said.PARENTS COMPLAINThe parents of the girl lodged a missing complaint soon after her disappearance in 2008 and after eight months their daughter was found with the man.

MSBTE told simplify process of duplicate mark sheets

The state Right to Services Commission (RTSC) has asked Maharashtra State Board of Technical Education (MSBTE) to simplify the duplicate mark sheet procuring process and make it “user friendly”. The directives were given when an applicant, who was told that his duplicate mark sheet was delivered “by post”, did not receive it for nearly five months.Prathamesh Sorte, an applicant seeking a duplicate mark sheet, had applied to MSBTE. His application was made online on June 28, 2017. When he did not get any information, he filed the first and then subsequently a second appeal. Since no decision was given, a third appeal was filed with the RTSC.While Sorte received the duplicate mark sheet before the hearing of his third appeal, the commission was informed during the hearing that he made four applications to get a copy of it.As per the information provided by MSBTE officials, the commission was informed that the applicant was told that he would get the mark sheet “by post”. However, “by post” means it is sent to a designated officer of the technical education and not to the home of the applicant, as assumed by many applicants.”The applicants assume that they would get their mark sheet at home when they read that it would be sent by post. What they have to do is go and collect the mark sheet from the place where the board sends it to. This tends to create confusion among many. Hence, we have asked for improvement in the format. We have also asked that the system of getting mark sheets be made more user-friendly,” said Swadheen Kshatriya, Chief of RTSC.Kshatriya passed the order on December 11, 2017 and directed Secretary, MSBTE to do all that is necessary.DNA could not reach Secretary of MSBTE.

Power dept pulls plug on rly stn

It was a rude shock, but it was a reality. The power company pulled the plug on Neem Ka Thana railway station at Sikar district on Friday. The department officials were anguished over electricity bills pending. Railway officials, however, denied that any dues were pending.”We have a robust system for payment of bills and they are deposited online,” said a senior officer at North Western Railway.The railway station, meanwhile, remained in the dark for a couple of hours on a wintry evening. The payment though remained pending till the supply was resumed after nearly seven hours. “The bills have been pending for several months now and total amount is nearly two lakh,” said an assistant engineer at the discom. “We have resumed the supply for now considering public interest,” he added.This is not the first time that a public office has been held a defaulter. However, as the electricity distribution companies are under financial pressure, officials are too being pushed to reduce the due.

Fire teams to conduct surprise checks at eateries

Alert and equipped, all Delhi Fire Services (DFS) officials will stand guard on the New Year’s Eve, with adequate deployment of fire tenders and emergency response vehicles. The officials have also been asked to carry out inspections and surprise visits at restaurants and pubs in their areas.A day after DNA reported that only three outlets in the Hauz Khas Village and four in the Khan Market have fire safety clearance, the Delhi Fire Services claimed to have taken sufficient preventive measures. The fact came to the fore a day after a tragic fire incident unfolded in Mumbai, killing 14 people.DFS chief fire officer Atul Garg said: “All DFS offices have been asked to carry out the inspection and make surprise visits at restaurants and pubs in their respective areas, especially at crowded places. It has also been decided that fire tenders will be placed at standby at all prominent places on the New Year’s Eve.”A day before the New Year’s bash, DNA carried out a ground reality check and visited Delhi’s party hubs to speak to owners, authorities, and Delhiites who are planning to head out to celebrate the New Year.Rajat Arora, who owns a cafe in Khan Market, said: “We have all the mechanisms ready, with fire censors in the roofs, to tackle any kind of mishap. Also, we plan to allow only a limited number of guests, so that there is no overcrowding.”Even as restaurant owners claimed to have the mechanisms in place, most of these eateries and restobars built on the first and second floors are like ticking bombs with narrow entries and only a single exit, sources said.Similarly in Connaught Place, where the civic body sealed 22 rooftop restobars earlier this year after two consecutive incidents of roof collapse, including one at the popular Unplugged Courtyard in the middle circle, only a handful have fire NOCs.Officials of the New Delhi Municipal Council (NDMC), the civic body governing Lutyen’s Delhi, said they had recieved applications from owners to de-seal the rooftops for the New Year’s Eve, but they have denied these requests.Cafe owners at Hauz Khas Village, one of the city’s most popular hang out and party zone in south Delhi, which attracts thousands of youths and families every night, have their own ways to tackle a fire mishap.Most restaurants and bars in these neighbourhoods, which are usually booked in advance for New Year’s eve, have single exit-entry points with no proper ventilation.Speaking to DNA, SK Jain, owner of building number 30 in HKV that houses more than a dozen cafes, said they have their own fire safety measures.”We know mishaps take place on New Year eve, and fire is the most common one. Hauz Khas gets really crowded as its a party hotspot for youth. But, we are well equipped and prepared,” Jain said.He further showed the fire control panel system, which is set up in the basement of the building. When DNA checked the building, it had two exits and three fire equipment were fitted in the building and all were in a working condition.Jain further stated that the building has a underground tank, which has 40,000 litre of water stored, and a rooftop tank with 30,000 litre water. All cafes in the building have ordered more fire extinguishers for safety purpose.” Hauz Khas Village is my favorite place to party and hang out as it has a lot of good cafes. We should get practical about fire incidents. Places where there are fire security measures in place can witness an incident as well,” Rachna Luthra said.CIVIC BODY ON TOESSDMC has taken many precautionary measures for New Year’s Eve celebrations. South Delhi houses the largest number of hi-end restobars and pubs. The civic body held a high-level meeting in this regard and asked the deputy commisioners of its four zones to constitute ward-wise teams to inspect all big and small restaurants, banquet halls and premises. As per a check list, the teams will find out about fire extinguishers, alarm systems, water hydrants, emergency exits, and staircases.

Prompt service commission makes lives easier

When it comes to citizens applying for services under the Right to Services (RTS) Act, the response is spot on, say many.It is so prompt that many citizens compared the speed to services under the Right to Information (RTI) Act. In both, a number of them managed to get the needful done the moment they approached the RTC commission — an independent office, as compared to appeal-stage one that are part of the government — when they did not get the services they applied for.Only RTS is a more direct Act and was enacted to ensure that notified services were delivered to eligible citizens on time, while the RTI Act entitled citizens timely information that aided transparency and accountability. Under the RTI Act, a number of citizens managed to get services the moment they sought information under the RTI, which was not delivered on time. Penal action lead to officers providing services.”In most cases, citizens have written to us stating that they managed to get services after our intimation for hearing was sent to the officers,” said Swadheen Kshatriya, chief of the RTS commission.Some cases in point are about shop licences, which were not given even after the government took several initiatives towards “ease of doing”. Rushi Chavan from Pune did not get ac shop license certificate. In the first appeal stage, order was given that services be rendered. The second appeal stage too had a similar response. However, Chavan did not get the info and officers said that his application was not available. The moment the case reached the the second third appeal (commission) stage, Chavan replied that he got the certificate.In two more cases, also from Pune, authorities did not issue a license, stating that documents were not proper. However, no such reply was given in writing to the applicants. Only when the commission sent a notice for hearing were the licenses given. In all three cases, applicants said that since they got the service, a third appeal was not needed.Shailesh Gandhi, former central information commissioner, said, “An average citizen will not pursue it but the commission should ask for explanation and penalise officers. After all, the third appeal stage is laborious. Ideally, at this stage if they feel that the designated officer has a good case, he should be spared, otherwise they should be penalised to create a fear of the law. Else, there will be cases piled up at the commission.”

Army Chief General Bipin Rawat reviews security situation in J&K, visits forward posts on LoC

Amid the spurt in ceasefire violations by Pakistan, Army Chief General Bipin Rawat today reviewed the operational preparedness of the force here and the prevailing security situation in Jammu and Kashmir, an defence spokesperson said.The Army Chief also visited forward posts along the LoC and interacted with soldiers in Rajouri sector, where an Army Major and three jawans were killed by Pakistani troops on December 23, he said.”The Chief of Army Staff, General Bipin Rawat, accompanied by the Northern Army Commander Lt Gen. Aligarh: Woman attacked with acid for protesting molestation attempt

A 20-year-old woman who staved off a molestation attempt, was grievously injured when the accused threw acid on her in Iglas township here, the police said today.Eight others including the family members of the victim were also injured in the acid attack yesterday as they rushed to her rescue, they police said.Circle officer of Iglas Alok Singh today said after the woman thwarted an attempt to molest her, the accused, Tilak Singh, returned to the spot along with four others and threw acid on her.When the girl raised an alarm, her family members and others who rushed to her rescue, but they too were injured by acid, he said.Four of the victims, including the girl who suffered serious burn injuries, have been admitted in the district’s Malkhan Singh hospital, the police officer said.The accused are on the run and efforts are on to nab them, Singh said.

Kamala Mills Fire: Did 1 Above have the right fire NOC?

Did 1 Above, the epicentre of Kamala Mills Fire, possess a no-objection certificate from the Mumbai Fire Brigade? The company is unable to prove it did, despite claiming otherwise.The pub, 1 Above is registered under ‘M/s Sigrid Ospitalita & Entertainment LLP’, in its statement post-incident stated that “all it’s fire safety regulations, licenses, procedures and norms (are) in place,” but when asked to substantiate their claims, they were unable to produce either NOC from the fire department, thereby raising doubts if it really had the mandatory approvals to operate a restobar.DNA sought copy of clearances, certificates and NOC for 1Above, but in response it shared fire department’s NOC for its another outlet at Bandra Kurla Complex registered under a different firm called M/s Flavour Pot Foods LLP.When specifically asked if it used Bandra Kurla Complex’s Fire NOC to operate its Kamala Mill joint, it did not respond to the question.For it’s Lower Parel’s establishment — 1 Above or Sigrid Ospitalita & Entertainment LLP, it produced clearances or NOC copies from Food & Drug Administration (FDA), civic body’s Health Department and Establishment Certificates, but not from other authorities including fire and excise departments.Though the spokesperson of 1 Above assured that they would share a copy of the fire NOC, till the time this newspaper went to print, no document had been offered.When Chief Fire Officer Prabhat Rahangdale was asked about issuance of fire NOC, he replied, “We are investigating three aspects into the incident, first, if NOC was issued or not, second, did the eatery comply to NOC norms and who is responsible to ensure that fire norms are complied with.”On the same question, Deputy Fire Officer Hemant Parab told, “I haven’t seen fire NOC as of now, so cannot comment if it was issued to 1 Above or not.”Burning questionsWhen asked to substantiate their claims, they were unable to produce either NOC from the fire department, thereby raising doubts if it really had the mandatory approvals to operate a restobar. The pub then shared fire department’s NOC for its another outlet at Bandra Kurla Complex registered under a different firm called M/s Flavour Pot Foods LLP. Allahbad University spends all its money fighting 300 legal battles

A month after the Ministry of Human Resource Development requested for a Visitor inquiry against Allahbad University Vice Chancellor Professor Ratanlal Hanglu, an audit report of the university has found that it has been fighting as many as 300 court cases and all the funds go into fighting legal battles rather than focusing on academic development.The committee appointed by University Grants Commission (UGC) was one of the committees conducting audits of ten central universities across the country. The audit team that visited the university between November 13-15 has recently submitted its report to the ministry. In the report, the committee has mentioned that the university administration is “wasting all its time, energy and funds in fighting the numerous court battles that have arisen as a result of the internal politics in the university”.”There is a group of retired teachers in the university, which has been conspiring against the Vice Chancellor and his work is getting affected because of it. There are many cases of corruption and financial irregularities levelled against the VC,” the committee in its report said.Because of the current situation, the university has been facing serious lack of funds and everything from academic development to salaries of employees is getting affected due to this. There is no co-ordination between the registrar and finance officer of the university and the university has no plans for its future, the committee said.The committee also said that law and order situation in the campus is very bad, in fact “it cannot be worse in any other university campus”, it said in its report.

Teacher sits on 6 mats, kids on floor; DEO issues notice

During winter, people seek cozy environment! But, when you are at work, this might not be possible.The District Education Officer (DEO) Mahesh Mehta has recently issued a notice to a teacher of a government school in Ahmedabad district for sitting on six mats even as 25 children of the class sat on the cold floor in winter.Interestingly, the teacher, Deepika Suthar of government primary school of Loliya village in Dholka block, had placed the mats on the top of two chairs. The mats were meant for Pragya classes.Mehta spotted this ‘insensitivity’ on a field visit and as a punishment, Suthar’s one year increment has been stalled. The episode will also find a mention in her Service Book. The officer found out that the kids were asked to bring mats from their homes if they want to sit on the same though under Sarva Siksha Abhiyan, the mats and school infrastructure has been provided to each school.The notice read that as per the disciplines and disputes, the teacher has barred the kids from their child rights. After a marathon eight-hour talk and intervention of four ministers and state BJP president, the in-service doctors agreed to call off their 12-day strike on Wednesday.As per the agreement signed between All Rajasthan In Service Doctors Association (ARISDA) ARISDA and the govrnment, demands, including removal of the officer of Rajasthan Administrative Service (RAS) Girish Parashar from the health department and adjustment of leaves taken by doctors during their agitation in earlier months of this year agitation, with their earned leaves has been accepted. The agreement also reiterates the execution of the agreement done on November 12 and withdrawal of cases registered against doctors, under Rajasthan Essential Services Management Act (RESMA), during their agitation.About the recent transfers that forced the doctors to go on strike for second time in two months, nothing was mentioned in the agreement, but later on Ashok Parnami state BJP president said that ARISDA president Dr Ajay Chaudhary will be posted as Chief Medical & Health Officer (CM&HO) in Sikar.During the talks a seven-point agreement also signed between the government and resident doctors. As per the agreement, government has given assurance to initiate proceeding over demands related to stipend appreciation, hostel or transit quarters allotment, pay fixation, revised LPC, benefits payment according to 7th pay commission and age limit increase for senior residents.In the talks with doctors and resident doctors, Health Minister Kalicharan Saraf, Health Minister (state) Banshidhar Bajiya, PWD Minister Yunus Khan, Co-operative Minister Ajay Singh Kilak, State BJP President Ashok Parnami, Principal Secretary (Health) Veenu Gupta, and Secretary (Medical Education) Anand Kumar were present. 3 men create ruckus inside Metro, held

Three men, allegedly in an inebriated state, entered the Pul Bangash Metro Station on Tuesday night and manhandled officers from the Central Industrial Security Force (CISF) after they tried to stop the trio from hurling abuses at co-passengers and creating a nuisance. The men, seeing the armed Quick Response Teams (QRT), which was called on the spot attempted to reach out to one of the officer’s weapon during the scuffle. All three have been arrested.According to the senior CISF officers, who guard the Delhi Metro, it was around 12.30 pm on Tuesday when the three men, later identified as Rahul (21), Sumit Sharma (28) and Gulshan Jacob (29), entered Pul Bangash Metro Station in an inebriated state and started hurling abuses at other passengers.”Hearing the ruckus, when the shift in-charge Head Constable Richh Pal Singh arrived at the spot, the trio got into an argument with him. On this, Singh called in the armed CISF personnel to take the trio to the station control room, but Rahul started a fist fight and even injured Singh. A Quick Reaction Team of the CISF commandos then had to be called in and the trio was detained. The Delhi Metro Rail Police (DMRP) was also informed that arrived on the spot,” a senior CISF officer said.However, the officer added that when the DMRP attempted to take the three men to Rithala Metro Police Station, Rahul could not be controlled as he turned violent.

Parliament takes on Pak dirty tricks

Political leaders cutting across party lines in Parliament condemned Pakistan’s mistreatment of Kulbhushan Jadhav’s family in Islamabad and demanded efforts to bring back the former Indian Naval officer who has been captured and sentenced to death on charges of espionage and terror. External Affairs Minister Sushma Swaraj said she will make a detailed statement on the issue in both Houses on Thursday. Jadhav, 47, was allowed to meet his mother Avanti and wife Chetana Jadhav across a glass screen on Monday. India has maintained he was kidnapped and implicated. India has said Pakistan had the mangal sutras, bangles and bindis of Jadhav’s mother and wife removed, disregarding cultural and religious sensibilities. The Pakistani press also harassed the two women. During Zero Hour in the Lok Sabha, members of Congress, Shiv Sena, TMC and AIADMK protested against Pakistan. Congress leader in the Lok Sabha, Mallikarjun Kharge, demanded that Jadhav be brought back. The issue was initially raised by Shiv Sena’s Arvind Sawant who questioned the government silence. TMC leader Saugata Roy described Pakistan as “hypocritical”. AIADMK’s M Thambidurai said that asking a woman to remove her ‘mangal sutra’ is an insult to the country. Shiv Sena members raised slogans against Pakistan in the House.Outside Parliament, Congress leaders Veepara Moily and Salman Khurshid called it a diplomatic failure on the part of the government. “MEA should have ensured a protocol for the family,” Moily told reporters. He said that the issue should have been taken up with Pakistan before Jadhav’s kin went to Islamabad. Khurshid, a former External Affairs Minister, said the meeting between Jadhav and his family was distressing and disturbing. “We expected better from Pakistan, the situation is unfortunately very grave,” he said. Senior BJP leader Subramanian Swamy reacted sharply on Wednesday and said that India should go to war with Pakistan and split it into four parts. The Rajya Sabha MP said that “serious homework” for the war should begin “right now”. “The treatment given to the mother and the wife is akin to Draupadi’s vastraharan that resulted in Mahabharat,” he said.Union Minister of State for Home Affairs Kiren Rijiju also slammed the “very irresponsible” Pakistani media over the heckling of Jadhav’s mother and wife. “Pakistan media is very irresponsible, it is not responsible like the Indian media,” Rijiju told reporters outside Parliament, assuring action by the External Affairs Ministry.India has moved the International Court of Justice (ICJ) in The Hague, on grounds that procedures were not followed under international law when Jadhav was convicted, a rare contest by the two nuclear-armed rivals at the top UN legal body whose rulings are binding, but occasionally flouted. In May, the world court put the sentence on hold till the case is conclusively heard.

No parking at Gateway & Marine Drive on New Year’s eve

In order to ensure a peaceful and less congested New Year, the Mumbai Police has made special security & traffic arrangements at the iconic Gateway of India and Marine Drive.There will be a segregation of the crowd — that is, there will be a different walkway for families and another one for youths who are not accompanied by women. Also, at these places, no vehicles, including two-wheelers will be allowed to park near the Gateway of India or at Marine Drive. This is mainly to keep roads free of vehicles and from a security point of view.Every year, thousands of citizens visit the Gateway of India and Marine Drive for New Year celebrations, thereby posing a great challenge for the police to provide adequate security. The area is considered to always be one of the targets for terrorists and anti-social elements and had also witnessed the deadly 26/11 terror attack.”All seven police stations from Zone I will be kept on toes for New Year. Quick Response Teams and Combat Vehicles of police will be posted at Gateway and Marine Drive. We will be conducting anti-sabotage checks to ensure no abandoned vehicles or goods are lying that can pose any security issue at these places,” said a police officer, requesting anonymity.He added, there has been a tendency among citizens to casually park their vehicles anywhere on the road and go for a stroll. “Keeping this tendency in mind, we have decided that on December 31, from 5 pm till the morning of the next day , no vehicles, including two-wheelers, will be allowed to park on Marine Drive and near Gateway. Vehicles can ply here, but can’t be parked during the said period. Citizens can park their vehicles at authorised parking space near Vidhan Bhavan and Mantralaya,” the officer said.HIGH SECURITYAround 400 CCTV cameras in South Mumbai to keep check on vehicular traffic & revellers activities Over 10,000 citizens expected to throng Gateway of India. Karnataka: Over 3,500 farmers committed suicide in five years, says state report

As many as 3,515 farmers in Karnataka committed suicide between April 2013 and November 2017, out of which 2,525 were due to drought and farm failure, statistics provided by the State Agriculture Department said.”3,515 farmers were reported to have committed suicide from April 2013 to November 2017, and from April 2008 to April 2012, as many as 1,125 farmers were reported to have committed suicide,” it said.Out of the 3,515 suicide cases reported, agriculture department accepted 2,525 cases which were due to drought and crop failure, the data said.From April 2015 to April 2017, as many as 2,514 suicide cases were reported, of which 1,929 cases were accepted, it added.From April 2017 to November 2017, when the state received sufficient rainfall, as many as 624 suicide cases were reported. Of these, 416 cases were accepted, it said.Agriculture Director B Y Srinivas told PTI that as many as 112 suicide cases were pending for the want of ratification by a state government panel since 2013.”There are 105 pending cases this year till November, and seven cases the previous year,” he said.The highest number of suicides (1,483) were reported during 2015-16 and lowest (106) during 2013-14, Srinivas said.”Sugarcane growers top the list of suicides, followed by cotton and paddy cultivators,” he said.The government has taken relief measures asking banks not to force farmers to repay their dues and turn their short and medium-term crop loans into long-term loans with waiver of interest, he added.?Agriculture Officer Kumaraswamy said the government has registered cases against private money lenders, who give loans at exorbitant interest rates, ranging from 30 to 40 per cent.”As many as 1,332 cases have been registered against money lenders, of which 585 have been arrested in last three years,” he said.The government has also hiked compensation from Rs 1 lakh to Rs 5 lakh to families of farmers who committed suicide.Chief Minister Siddaramaiah had in 2015 made the announcement before a public rally in Ranebennur taluk.

Health centre chief suspended for cataract operations under ‘torch’

After reports surfaced that eye surgeons at Nawabganj Primary Health Centre (PHC) in Unnao district allegedly performed cataract operations on 32 patients in ‘torchlight’ on Monday, the Yogi Adityanath government has ordered a probe and suspended the PHC in-charge, Dr Dinesh Dass. Chief Medical Officer of Unnao, Dr Rajendra Prasad, who gave the permission for these operations even when there was no electricity at the PHC has also been transferred.”No one involved in this kind of medical negligence will be spared. It is the height of medical negligence,” said Ravi Kumar, District Magistrate, while ordering the probe.A two-member team including additional Chief Medical Officer Unnao R.K. Gautam and Joint Magistrate Mankish Bansal has been formed to probe the incident.Initial investigation suggests that due to erratic power supply at the PHC during the time of the surgeries, a three-member team, headed by Dr Nutan Saxena, performed the cataract operations under two torchlights. “Since there was no power, doctors asked us to hold torchlights and conducted the cataract operations on patients,” said a peon.

A day after wife and mother of former Indian Naval officer Kulbhushan Jadhav met him in Islamabad , India on Tuesday took serious objections to the conduct of Pakistan and the way its officials arranged the meeting disregarding all “sensibilities”. A statement issued by the Ministry of External Affairs (MEA) said the exercise lacked credibility and during the meeting Jadhav was under considerable stress and speaking in an atmosphere of coercion. “Most of his remarks were clearly tutored and designed to perpetuate the false narrative of his alleged activities in Pakistan,” it said. Pakistan’s public relations (PR) pitch coming ahead of the top UN court, the International Court of Justice (ICJ) begins to hear India’s appeal against Jadhav’s death sentence took new heights, when its Foreign Office not only made meeting of mother Avanti and wife Chetana with a death-row prisoner a media spectacle, but also used the occasion to release his second video and a medical report showing him healthy and fit.In a strongly worded statement, MEA said not only Pakistani media was unleashed to harass visiting relatives, but prior to meeting their cultural and religious sensibilities were also disregarded, by forcing them to remove mangal sutra, bangles and bindis. They were also asked to change their attire that was not warranted by security. They were also asked to put off their shoes. The MEA noted with regret that the Pakistani side conducted the meeting in a manner which violated the letter and spirit of our understandings.“The Pakistani press was allowed on multiple occasions to approach family members closely, harass and hector them and hurl false and motivated accusations about Shri Jadhav. This was despite a clear agreement that the media would not be allowed close access,” the statement added. It further stated that under the pretext of security precautions, the cultural and religious sensibilities of family members were disregarded. This included removal of mangal sutra, bangles and bindi, as well as a change in attire that was not warranted by security.Further,Jadhav’s mother was prevented from talking in her mother tongue Marathi, although this was clearly the natural medium of communication. During the meeting, she was repeatedly interrupted while doing so and eventually prevented from proceeding further in this regard. India’s deputy high commissioner JP Singh, who was tasked to accompany family members in the alien land was initially separated from them. Once inside Foreign Office building, they were taken to the meeting without informing Singh. The meeting started without his presence. Two men held for raping teen

Two men allegedly raped a 19-year-old woman after offering her lift from Gurugram on Saturday. Police said the two men dropped the woman in Dwarka after the assault and sped away. Both have been arrested, they added.The incident took place when the woman, who works at a shopping mall in Gurugram, was returning home in the evening. She told the police that the two men offered her a lift, to which she agreed.”She said in her complaint that the men started touching her inappropriately. When she objected, they forced themselves upon her and raped her. After driving up to a Metro station in Dwarka, they dropped her and sped away,” a police officer said.Based on her complaint, a raid was conducted and the two accused were arrested, the police said. A medical examination of the victim was carried out and a counsellor has been arranged for her, the police said.HOW IT HAPPENEDThe two men had offered the girl a lift and then started touching her inappropriately. Army for stricter scrutiny to weed out tainted during promotions

The Indian Army has put in place a stringent disciplinary policy for stricter scrutiny, when it promotes officers, to ensure those tainted do not move up in its hierarchy.The regime will keep a record of even minor offences, including misconducts of at least 10 years, and in some cases, the entire service duration, if the condemnation has been awarded by the Chief or the Central government.This is in wake of senior officers found involved in cases of misbehaviour or un-officer like acts early in their careers and reaching high ranks. Land scams, involving senior officers, scandalous affairs and sexual misconduct in some cases have dented the Army’s image.Sources said several cases at higher levels showed officers who had committed serious misdemeanours managed to go past scrutiny and got promoted. This triggered a change in the Army’s policy.”An in-house review suggested that more scrutiny is needed to make sure serial offenders don’t rise in service as many such cases were identified recently,” said an Army source.There were many instances when wrongdoings of the past were not detected and officers went on to hold high offices.”The change in policy will make sure that an officer’s shady past will not go unnoticed,” the source added.The disciplinary policy is divided into two: Court Martial for serious offences, including criminal acts, and Administrative Action in the form of a Censure, which till now was recordable and non-recordable.Non-recordable offences were minor in nature and were not part of Annual Confidential Reports (ACRs) or a dossier maintained for every officer.”The customs of service of the Army demand the highest standards of personal conduct and respect for military law. The selection of officers now requires the past disciplinary and administrative record of officers to be placed before the selection boards,” a letter circulated to all sections of the Army said.With the new policy in place, non-recordable offences are a thing of the past. Every censure will be part of records for a period of at least 10 years and will reflect in ACRs that could impact future promotions.Censures are awarded for acts considered “minor in nature” and don’t involve criminality or moral turpitude. According to the new policy, cases that do not fall under the minor offence category but are not criminal acts to be tried under a Court Martial can be forwarded to the headquarters for award of a censure by the Army Chief.Censures will be of two types: severe displeasure or displeasure.While the award of a censure will not debar an officer from being considered for promotion but it will be taken note of as part of the overall record of service in assessing the credentials of the officer. This will ensure that the entire record of the officer will be placed before the selection board.

After 2 year delay, Panchyat polls in J&K in Feb

Ending the long wait and suspense, Jammu and Kashmir government has decided to hold the panchayat elections from February 15, in the strife-torn state.The decision to hold the panchayat polls after a gap of two years was made in the cabinet meeting chaired by J&K Chief Minister Mehbooba Mufti a few days ago.Mehbooba, on Monday, drove to Raj Bhavan to inform Governor NN Vohra about the dates for the panchayat elections. “During their half hour meeting, the Chief Minister informed the Governor about several important matters with regard to which the Cabinet had taken decisions a few days ago. She also informed about her Government’s decision to commence the panchayat polls from February 15, 2018,” said an official spokesman.The Governor, the official spokesman said, reiterated his concern about the vital importance of ensuring prompt redressal of public grievances and for the entire administrative system to function in a truly transparent and accountable manner, to promote public welfare.Seen as one of the biggest achievements of the Omar Abdullah government, the panchayat elections were last held in 2011, after a 33 year hiatus in Jammu and Kashmir.More than 80 per cent people had defied the terrorists and cast their votes in the panchayat elections in 2011. More than 33,000 panchayat representatives were elected in the 2011 polls.The panchayat elections were due last year, but due to the post-Burhan Wani killing unrest, they got postponed indefinitely.Last month, Vohra had set the ball rolling for holding the elections in the winter of 2017-18.Since the Assembly was not in session, Vohra had promulgated the ordinance, so that no time is lost in commencing preparations for the conduct of the pending elections.Considering the time-frame for the forthcoming elections, the Governor issued the J&K Panchayati Raj (Amendment) Ordinance, 2017, to empower the State Chief Electoral Officer to determine and delimit Halqa (block) panchayats and conduct panchayat polls.

After 19 months of captivity in Pakistani jail, former Indian Navy officer Kulbhushan Jadhav is scheduled to meet his family in Islamabad today.According to latest reports, Pakistan Foreign Minister Khawaja Muhammad Asif has confirmed that Islamabad has ‘finally granted consular access’ toJadhav.New Delhi, however, has downplayed the development and said that Indian diplomat accompanying Jadhav’s mother and wife can’t be seen as consular access.In preparation for the meeting, Pakistan has deployed heavy security and traffic personnel within and outside their Foreign Office. Pakistani diplomatic sources said the meeting will last for an hour. Pakistan has offered to arrange media presence, if Jadhav’s mother and wife want to speak to media. But the offer has been rejected by India, reports said.Pakistani sources indicated that the meeting between Jadhav and his family members will not be the last, raising hopes that his death sentence may be deferred. The Pakistani High Commission in New Delhi had issued visas to Jadhav’s mother and wife earlier in the week. The visas were issued after Pakistan decided to allow Jadhav’s wife to visit him. But later, it agreed to allow his mother to join, who had originally applied for the visa. Pakistan later agreed to Indian condition — to allow an Indian diplomat to accompany the two women and also to provide a sovereign guarantee to their security and safety. Maha asks IAS officers to declare properties online

Maharashtra government has issued a fresh notification reminding IAS officers to submit Immovable Property Returns (IPR) online and not manually by January 31, 2018 for the calendar year 2017 to the state government and Cadre Controlling Authorities. Officers are expected to forward the copy to the Department of Personnel & Training.Even though the Centre had made online filing of IPR mandatory from 2017, the state government came across some cases where some officers due to technical glitches were unable to file online but submitted it manually.Senior state government officer from the General Administration Department told DNA, “A fresh notification has been issued on December 20, 2017 giving details with regard to the online submission of IPR by IAS officers. Filing of IPR is binding since 2011 but it was done manually until 2016. The Centre shifted to online submission after it found out that IPRs filed manually are lost in transition in few cases while in several other cases despite IPR submitted to the state government or Cadre Controlling Authority it was not uploaded on the website of Department of Personnel and Training. It was also found that IPRs were filed but without any date.’’The officer said the notification has explained the methodology of online filing of IPR and also details with regard to IPR module.He informed that the application is available on the e-office SPARROW (Smart Performance Appraisal Report Recording Online Window) which is a part of Centre’s Digital India Initiative. ISenior IAS officer, who is of the rank of additional chief secretary in Maharashtra, said if anybody fails to upload IPR or hide some information the government can initiate a disciplinary action.

38-year-old man killed after being hit by speeding car

A 38-year-old man was killed after he was hit by a speeding car on Outer Ring Road near Mukundpur Chowk on Saturday evening. It was found that the errant driver was in an inebriated state at the time of the accident and even tried to flee from the spot. However, he was caught by the public and his vehicle was set afire.The deceased was identified as Sanjeev Singh, who worked as a labourer and was a resident of Jahangirpuri. According to the police, the incident took place around 9 pm on Saturday night when Singh was trying to cross the road near the chowk. Witnesses told the police that he was hit so hard that Singh was thrown meters away and he sustained critical injuries.”They said that the driver, who was later identified as Ashok Kumar, was drunk at the time of the accident. Kumar tried to flee from the spot after the mishap but was chased and nabbed by the locals, who first thrashed him and then set his car on fire. Kumar was coming from Burari and was heading towards Mukundpur when his car hit Singh. Locals called up the police and the victim was rushed to a nearby hospital but he had succumbed to the injuries by that time,” a senior police officer said.Police said that the accused appeared to be drunk and later a medical examination confirmed that he had consumed alcohol. A case of rash driving and causing death due to negligence and other relevant sections was registered against Kumar at the Jahangirpuri Police Station and he was arrested.Kumar works for a private company.”Singh’s family has been informed and the body was sent for a post-mortem examination,” police said.Police have also registered a separate case of arson against the mob for burning the car and said that efforts to identify the miscreants are being made.

CISF apprehends woman with pistol

A woman was caught by the Central Industrial Security Force (CISF) at GTB Nagar Metro Station after the X-ray machine detected a country-made pistol in her bag. Some jewellery and USD 100 were also found in her bag after checking. This is the third incident in the past two weeks where a commuter has been caught with a pistol, trying to sneak into the Delhi Metro train.According to senior CISF officials, the matter came to light on Saturday at around 4:35 pm when during the baggage screening of a lady passenger, through X-ray machines at GTB Nagar Metro Station, Constable Milan Ghose detected the image of a pistol and some live rounds.“The constable immediately stopped the conveyer belt as well as the passenger was stopped, and he informed the matter to his senior officers. The bag was then physically checked in presence of the lady passenger and a country-made pistol along with eight live rounds of 3.25 bore was recovered. The woman was identified as Inder Pal Kaur (36), a resident of Mukherjee Nagar area,” a senior officer said. The matter was then conveyed to the senior officers and station controller. The woman was brought to the station control room along with her bag. Del ADJ under scanner for disrespecting HC Judge

The Delhi High Court has ordered initiation of criminal contempt against Additional District and Sessions Judge (ADJ) Kamini Lau for making allegedly “personal allegations” against a High Court Judge.Lau is currently posted as Special Judge, Tis Hazari.In an order passed yesterday, Justices Valmiki Mehta and Indermeet Kaur came down heavily on the ADJ for making allegedly “unacceptable and unfounded statements” with respect to observations contained in judicial orders passed by an HC judge.In applications filed in the HC, Lau had sought expunction of adverse remarks and observations made by a Single Judge in four orders. The remarks pertained to orders passed by her while dealing with cases before her.The HC bench cited Supreme Court judgments to underline that while high courts shouldn’t make unwarranted comments against judicial officers, the power to make critical observations was vested in the high courts.”The observations made by the high court against a judicial officer of the subordinate court however if are only in the nature of judicial comments, i.e. of judicial nature …”… and the observations made cannot be faulted for their lack of sobriety, then in such a case the observation so made by this court cannot be said to be in the nature of adverse remarks or strictures or negative, disparaging remarks personally against the judicial officer,” the bench said.In her plea, Lau had alleged that the single Judge had selectively and repeatedly targetted her.To this, the bench headed by Justice Mehta said, “We are indeed perturbed and upset at the language used by the applicant in her applications….the applicant in para 2 has stated that the learned Single judge of this court is guilty of violation of the norms of judicial propriety. Surely, it is impermissible for the applicant/judicial officer to make such observations against the Single judge of this court who is exercising appellate jurisdiction over the judgment passed by the applicant/judicial officer.”Dubbing her stance “unbelievable and unacceptable”, the HC observed, “We found it unbelievable and unacceptable that the applicant has crossed all norms of acceptable behavior and made personal allegations against learned single judge of this court.Holding Lau prima facie guilty of criminal contempt of court, the bench then issued notice to her and directed that the matter be listed on February 16 before the Bench hearing criminal contempt petitions.

Watch: Patients evacuated as major fire breaks out in East Delhi hospital

A major fire today broke out at a hospital in east Delhi’s Preet Vihar and 84 patients were evacuated from the building, officials said.Some patients suffered minor injuries in the rescue operation in the fire that broke out on the second floor of the Metro Hospital and Cancer Institute, they said. The fire started in an air conditioning vent and then spread to other floors, a senior police officer said. A senior officer from the Delhi Fire Services said a call was received at 3.20 PM alerting them about the blaze, which intensified in the next 20 minutes. Twelve fire tenders were rushed to the spot, he said.”But it was controlled by 4.15 PM and completely doused by 4.50 PM,” the official added. Police said that the 84 patients were safely evacuated from the hospital and shifted to its Noida branch. The cooling operation was underway, the police said, adding that some patients suffered minor injuries in the episode.

Farmer shot dead by unidentified persons in Bihar’s Samastipur

A farmer was shot dead by unidentified persons at Shankarpur village in Bihar’s Samastipur district today, police said.Rosra Sub-Divisional Police Officer (SDPO) Ajit Kumar said that the deceased has been identified as Hare Ram Yadav (50), a resident of Shankarpur village under Hasanpur police station of the district.The deceased was a social worker and was earlier associated with Rashtriya Janata Dal, Yadav said.Hare Ram Yadav was killed by some unidentified miscreants at Pukar chowk around half a km away from his house when he had gone for a morning stroll, the SDPO said adding that the killers fled from the scene taking the advantage of the fog.Hasanpur police station Station House Officer (SHO) Braj Kishore and other police personnel from neighbouring police stations have been sent to the spot, he said.The local villagers blocked the Hasanpur-Bithan road with the body in protest against the incident, the SDPO said.

Om Prakash Chautala granted parole to attend ailing wife

The Delhi High Court on Friday granted two weeks’ parole to former Haryana chief minister Om Prakash Chautala, who is serving a ten-year jail term in a teachers’ recruitment scam case, to attend to his ailing wife.Earlier on December 11, the court had issued a notice to the state government to file a response to a parole petition moved by Chautala.Chautala wanted a two-month parole to look after his ailing wife.In March, the court had cancelled the parole granted to Chautala after he violated the terms and conditions. The police raised objections that he was holding public meetings in violation of his parole conditions. A total of 55 persons were convicted under the JBT scam for illegally recruiting 3,206 teachers in Haryana in 2000. The father-son duo, including two IAS officers, was among 55 persons convicted on January 16, 2013, by the trial court.

West Bengal | To track big cats, Jaldapara National Park to put radio collars on 200 leopards

Authorities of Jaldapara National Park at Alipurduar district of West Bengal have decided to put radio collars on leopards to track their whereabouts. Frequent attacks of leopards who stray into human habitats have led them take such decision.There have been as many as 64 incidents of leopards entering villages this year, injuring 16 people. Forest officials said that there were about 200 leopards in Jaldapara National Park.As a pilot project, radio collars have been put on the leopard, which had entered Dalimpur village of Falakata area. It spread panic among villagers who were afraid of come out of their homes. Officials of the forest department were informed and once they arrived, they found the leopard, tranquilised it and put the collar on to it before setting it free in Jaldapara National Park.Such collars would also put on other leopards in phases. Officials said that it would be specially useful to locate these animals at night if they tried to enter villages stealthily.“It had been noticed that many leopards were entering human habitat at many villages of the vicinity and attacking people. We have put radio collars on these leopards to keep track on their movements so that other than studying these animals we can also take precautionary steps before they can cause any formidable damage,” said district forest officer Biman Biswas.

DoT, CBI fail to define ‘associate’, ‘equity’ in Essar-Loop case

The CBI judge lashed out the investigating officers and officials of Department of Telecom for failing to establish the basic premise of a link between two accused companies Essar and Loop Telecom. The CBI had alleged that Loop was a front company for Essar but judge OP Saini pulled up the investigating officer for not defining the term ‘associate’ to establish the link.The court observed that the two companies are separate identities.The CBI cited Clause 8 of Department of Telecom guidelines on 2G stating that a company is barred from participating if it has 10 per cent stake in another company that was given a licence.”None of the witnesses except Legal Advisor (DoT) (Santokh Singh) deposed anything as to the meaning and scope of Clause 8, particularly the word “Associate”. Ordinary prudence requires that decision makers must understand the law and rules that guide their decision making and must apply it correctly. When the decision maker himself does not understand a rule, how can he say that other party has violated the rule.”Also the judge said language of the clause is also not clear as it is saddled with words like “Associate”, “Promoter”, “Stake” etc., meaning of which is not known to anyone, including DoT officers. “Nor anyone tried to clarify the same,” he said.Also the court lashed out at the investigating officers including the chief investigating officer Vivek Priyadarshi failing to prove the violation made by the accused in the case.Saini said, “Similarly, five CBI officers were part of the investigation in the instant case. Inspector Shyam Prakash, DySP Rajesh Chahal, DySP SK Sinha, DySP VM Mittal and SP Vivek Priyadarshi, the chief investigating officer. None of these witnesses deposed as to what was the requirement of Clause 8 and how did they arrive at the conclusion that Loop Telecom Ltd violated the clause.”The court also said there is no material on record that DoT took any steps to do any of these things.”Instead of course correction by taking appropriate administrative action, the DoT started playing victim claiming that it has been cheated by Loop Telecom Limited as it was indebted heavily to a group, which already had more than 10% equity in an existing pan India licensee, that is, Vodafone Essar Ltd,” the judge said.Court finds no crime motiveIt is the case of the prosecution that Essar group acquired BPL companies in the name of IP Khaitan so that it can run telecom business after exiting Vodafone Essar Ltd. It is the case of the prosecution that this was the motive for Essar group to acquire these companies.However, 13 officers of DoT and chief investigating officer Vivek Priyadarshi and four other investigating officers did not depose even a word that this was the motive of IP Khaitan and Kiran Khaitan becoming benami/ front of Essar Group.

West Bengal: 84% voter turnout recorded in Sabang Assembly by-poll

An estimated 84% voter turnout was recorded till 5 pm in today’s by-poll for Sabang Assembly constituency in West Bengal which ended with spats of violence at a number of booths. Opposition parties alleged that the violence was sponsored by the Trinamool Congress (TMC), while the ruling party leaders denied the allegations. Polling started at a very slow pace at 7 am with most of the 306 booths wearing a deserted look. It picked up as the day progressed with instances of violence being reportedfrom various polling booths. At booth numbers 161, 169 and 170 of Sabang block, BJP polling agents were reportedly chased away by TMC cadres. At Bishnupur Murarichowk area, people, belived to be from the TMC, were held and firearms were recovered from their possession.At Panpara Saliara School, it was alleged that Congress polling agents were not allowed to sit in the polling booth. The matter was resolved after Congress candidate Chiranjeeb Bhowmik intervened.At booth number 160 of Sindurda Primary School, it was alleged that TMC cadres had beaten up CPI(M) polling agent. BJP leader Ananda Maiti was allegedly abducted from Pingla’s Jolchowk. At Sabang III area’s booth 57, it was alleged that perfume was applied on the button corresponding to BJP symbol on the Electronic Voting Machine (EVM).Later in the evening, at booth 291 of Sabang’s Bishnupur Primary School it was alleged that attempt to loot EVMs was made. When the attempt was foiled, offenders allegedly pelted stones at the Central force guarding the polling station. At booth 44 of Sabang III Gram Panchayat area, a clash between TMC and BJP workers broke out.In the evening, BJP youth wing members put up a demonstration in front of the office of the Chief Electoral Officer in Central Kolkata, protesting against the violence allegedly unleashed by the TMC.Later, state BJP president Dilip Ghosh said that TMC had resorted to violence as they had lost confidence on democracy. “Central force was there but they were not used and had been kept at rest. At Pingla and other bordering areas, the state police had only played the part of an audience while violence broke out. It was a pre-planned thing with political leaders and district police. Members of TMC’s bike brigade had been going around in the area creating an atmosphere of terror,” Ghosh said.Senior TMC leader and state panchayat minister Subrata Mukherjee, however, refuted allegations saying that BJP was making excuses for their imminent loss. “Going by the poll trends they know that they cannot win at Sabang and that is why they are getting excuses ready to defend their loss later,” he told DNA.

Facebook page admin arrested for posting ‘abusive’ memes on on famous personalities

Kolkata Police on Wednesday arrested a man who allegedly posted abusive and defamatory memes about famous personalities including Netaji Subhash Chandra Bose, Rabindranath Tagore and Swami Vivekananda. The man, who ran a Facebook page, ‘Specified Tarkata’, was identified as Manimay Aich, the Indian Express reported. Police arrested Manimay Aich, 20, of West Midnapore​ on Wednesday after months of search. “He would create obscene memes of such great personalities like Netaji, Tagore, Swamiji and so on. There is a subtle difference between humour and audacity. This page has crossed its entire limit”, an official said.“Several efforts were made to identify the person behind the page but it was difficult since he would keep his identity a secret. Finally, officials of the Kolkata Police’s cyber department successfully traced the youth and he was arrested. He was staying in a paying guest accommodation near Garia station. He is a third-year physics student at a city college. A mobile phone and pen drive have been seized,” a senior police officer was quoted as saying by the daily. Another police officer said that the accused would create obscene memes of great personalities like Netaji, Tagore, Swamiji and so on.”There is a subtle difference between humour and audacity. Mumbai: 3 tonnes of meat seized by police, lab test confirms its beef

The Thane district police seized a stock of three tonnes of animal meat from a tempo with police claiming that it was beef.Police said that the vehicle was intercepted in the early hours of Wednesday within the limits of Padgha police station and two persons, the driver and cleaner of the tempo, had been arrested.The Station House Officer of Padgha police station said that the lab test of the meat had confirmed that it was beef.The official said that the tempo was coming from Nashik to Mumbai and the meat was concealed beneath scrap items loaded onto the tempo.Police said that the tip-off about the tempo allegedly transporting beef was received from Bajrang Dal activists and a trap was laid at Ajroli checkpost to intercept the vehicle.The meat was being transported from Sangamner to Govandi in Mumbai where it was to be delivered to a meat-seller, police said.

Speeding bus kills Australian biker on Yamuna Expressway

An Australian biker was killed while a few others sustained injuries when a speeding Uttar Pradesh roadways bus rammed into a truck due to dense fog and then hit the Austrailian’s two wheeler at the Yamuna Expressway on Thursday morning.According to police, the deceased have been identified as Mathew Antioredle (26), an Australian national, who was on his way to Agra on a road trip with his friends.“The incident took place at around 8 am when a roadways bus heading towards Agra rammed into a moving truck after which it lost control and hit the bike moving next to it,” said Farmood Ali Pundir, Station House officer of Dankaur police station.A school bus heading towards Agra then hit the roadways bus from behind and all the vehicles piled up, police said.The bus driver identified as Dharmendra, the bus conductor, Pushpendra, and two passengers – one a minor – were injured. They were rused to Kailash Hospital where they are undergoing treatment. Antioredle, however, was declared dead on arrival, while his friends sustained minor injuries.

Suhaib Ilyasi kept trying to explain away wife’s murder as suicide

Celebrity husband, strained relations with the wife followed by her murder are all elements of a Bollywood thriller. But this plot was very much true to real life, and more particularly the life of TV serial producer and anchor Suhaib Ilyasi.Ilyasi, who shot to fame from the crime drama show India’s Most Wanted, had murdered his wife at their east Delhi residence in 2000 and tried to cover it up as a suicide . The theories he put forth could have been taken from the many real life crime stories on his show.However, the court found several loopholes in the suicide theory given by Ilyasi thereby convicting him and sentencing him to life imprisonment on Wednesday.After the judgment was announced the TV anchor shouted “Injustice” in the courtroom.According to the theory given by Ilyasi, he had an altercation with his wife Anju on the day of the incident following which she took out a revolver and threatened to kill herself. But Suhaib snatched it and threw it on the bed.He then claimed Anju rushed to the kitchen and brought out a knife and stabbed herself. The court however was unimpressed and stated that if Ilyasi had snatched away the revolver then why had he offered no resistance when she was stabbing herself.”If accused could have snatched the revolver from the hand of deceased, he could have also snatched the knife, which was brought by deceased from the kitchen. During inquest proceedings, the revolver was found on the shelf,” the court said.Ilyasi also claimed that the suicide bid had come after a quarrel. But the court kept in mind the evidence of two barbers who had come to the house of the convict to cut his hair. The barbers stated that they did not hear any noise or sounds of fighting between the couple.The court also found that Ilyasi tried to hide his wife’s critical injury when she was taken to Virmani Hospital. It said the accused did not tell the doctor about the injury on the abdomen and just said “isne kuch kha liya hai” (she has eaten something)”In his statement he had said that there was a white mark on the abdomen, there was no blood. However there were blood spots at different places inside the house, which Ilyasi stated was ‘menstrual blood’ but the forensic report contradicted this.”The accused had given a statement to an officer as being a complainant, that the blood did not come out of the wound and instead a white liquid was seen. However, when the officer reached there, he saw the blood on the abdomen of the deceased, whereafter, he tied an old vest on her wound,” the court said.The judge held that no logical explanation was offered by the accused as to why he did not inform the doctor as to the exact facts regarding her injuries.”As per medical evidence, there are two stab wounds on the abdomen of deceased. Why did the accused not stop the deceased from stabbing herself before giving the first blow and even thereafter, when she gave the second blow, are the further questions, which were required to be answered in clear terms, however, no explanation regarding this has ever been offered by the accused,” the court said.TIMELINEJanuary 10, 2000: Anju Ilyasi was found dead at their East Delhi residence with multiple stab wounds and was rushed to a Virmani Hospital and then to AIIMS with stab wounds. She was declared dead on arrival. The couple had allegedly fought before her death.Anju’s autopsy report, however, couldn’t establish if it was a suicide or murder. Her death was treated as a suicide.March 2000: Anju’s sister Rashmi Singh and her mother Rukma accused Ilyasi of torturing Anju for dowry and also filed an FIR against him. Her sister and mother allegedly told the investigators that Anju was driven to suicide by her husband.2003 Trial court frames charges under Section 498A and 304 against Ilyasi.May 2003 Trial began.Ilyasi was also arrested for dowry harassment but he vehemently denied these charges at the time.Later, Rukma moved an application in the trial court seeking inclusion of murder charges against Suhaib but it was dismissed in 2011. Over 250 MHADA flats to be on offer

According to senior MHADA officials, the forthcoming lottery that in most likelihood will be held in May will have 278 homes in the affordable segment in the Wadala region. Sanjay Gandhi National Park initiates DNA mapping project for big cats

In one of its most ambitious projects, the Sanjay Gandhi National Park (SGNP) along with Thane territorial department has decided to initiate the DNA profiling of leopards — a project under which it plans to create a scientific database of individual leopards.The female leopard rescued from Andheri east recently is the first big cat to undergo DNA fingerprinting. DNA profiling is essentially a technique by which individuals can be identified and compared from their respective DNA profiles.Dr Shailesh Pethe, Veterinary Officer, SGNP who triggered the idea of DNA mapping said,”The big cat was not only micro-chipped but we also collected her blood sample for DNA, which will be sent to Centre for Cellular and Molecular Biology (CCMB). We also took photographs of her right and left flank and now we will have all the key data on this animal with us using which we can identify her.”Pethe said if this leopard were ever to become a problem animal they would be able to scientifically identify it after trapping.Dr Jitendra Ramgaonkar, Deputy Conservator of Forest (DCF), Thane said that similar profiling will be done on every leopard rescued. “We have to use all the scientific tools available for better wildlife management practises. We can only collect blood samples for DNA extraction of those leopards that are rescued for others we are planning to use scat or hair follicles for sampling in case a leopard is found visiting human dominated areas,” he said.

Pakistan issues visa to Kulbhushan Jadhav’s family

The Pakistani High Commission in New Delhi on Wednesday granted visas to former Indian navy officer and prisoner Kulbhushan Jadhav’s mother and wife. The two women will travel to Pakistan on December 25 to meet Jadhav who is currently on a death-row. They will be accompanied by an Indian diplomat during the meeting. Pakistan has so far rejected over 20 Indian requests for consular access to Jadhav.Pakistan had initially offered a meeting between Jadhav and his wife on ‘humanitarian grounds’. But after a request from India, Islamabad agreed to permit his mother and an Indian diplomat to meet Jadhav as well. Jadhav, who was detained by Pakistani security forces on March 3, 2016, in Balochistan, was sentenced to death by a military tribunal earlier this year. His appeals against the conviction have been rejected by the military appellate court and his mercy petition has been lying with Army Chief Gen Qamar Javed Bajwa.Meanwhile, in reply to a question in Lok Sabha, External Affairs Minister Sushma Swaraj informed that there are 60 civilian prisoners including Jadhav and 416 Indian fishermen in Pakistan’s custody. She said since 2014, Indian government has provided legal assistance to 3 Indian civilian prisoners lodged in Pakistani jails.India has challenged Pakistan’s refusal to grant consular access to the spy in the International Court of Justice (ICJ). The ICJ is hearing the case and has restrained the Pakistan government from executing Jadhav till it decides the case.She said there have been reports of ill-treatment of Indian prisoners in Pakistan’s custody. “Since 2014, 10 Indian fishermen and 2 Indian civil prisoners have died in the custody of Pakistan authorities. Mortal remains of all these prisoners were brought back to India, except in the case of late Abu Bakar Nohri, who was buried in Pakistan as per the wishes of his family and as per Islamic rules,” she added.

MHADA yet to recover 13K sq m area from builders

The Maharashtra Housing Area Development Authority (MHADA) is yet to recover around 13,000 sq m area from developers who were permitted to redevelop cess buildings, mostly situated in south and central Mumbai.While replying to a Public Interest Litigation (PIL) filed by activist Kamlakar Shenoy alleging that the authority has now recovered around 30 lakh sq m causing a loss of around 14,000 crore to the exchequer, it was said that the petitioner had misread the surplus due and arrived at a wrong conclusion.Relying on a chart of the number of projects completed under rule 33 (7) of the Development Control Rules, the authority said in 17 cases redevelopment work has been completed and 5734.26 sq m which is due is yet to be received. Similarly in 33 cases, MHADA has initiated criminal proceedings against the developers who have not surrendered surplus area, which is around 7392.88 square meters.The authority also informed the court that since 2011 developers are told to give an undertaking that surplus land will be surrendered to MHADA on completion of the project.On a question by the Bombay High Court, whether it has any mechanism to recover the surplus area, it said “It was helpless and did not have any mechanism of its own but it only writes to the collector asking him to attach the concerned area. The entire process is cumbersome.”The court then asked MHADA to give suggestions on the next hearing about the ways in which the state can delegate some powers to the authority to recover the surplus and also issue a policy to ensure that in future such a situation does not arise.Box: Expressing displeasure over the reasoning given by the government that the Maharashtra Assembly Sessions was ongoing and so a reply could not be filed, the court said “So have you locked Mantralaya?” and asked a responsible officer to be present on Thursday.

Justice Karnan walks out of Presidency Jail after six months of imprisonment

Former Calcutta High Court judge, Justice CS Karnan was released from Presidency Correctional Home of Kolkata on Wednesday after serving his six months’ sentence for contempt of court.After his release on Wednesday morning, Karnan headed for his residence at Rajarhat, at the eastern fringes of the city. Justice Karnan was the first sitting judge to be jailed.Raj Kanojia, the IPS officer who was heading a team of police officers to hunt Justice Karnan down when he was on the run after Supreme Court sentenced him for six months is now the principal secretary, department of Correctional Administration, West Bengal. He told DNA that it was an interesting case. “It was an interesting case tracking down a sitting judge. We had to be careful with him at the same time we had to comply with the court order. We had to do a lot of planning and briefing. The team comprised senior officers only. Our prime objective was to pull it off without embarrassing the court or police,” he said. He also said that after he took over as the principal secretary, he used to occasionally enquire about Justice Karnan’s stay as an inmate out of his academic interest and found out that his stay at the Presidence Correctional Home was largely uneventful. “There was nothing untoward in the last six months but I was told that he had lost weight. I never heard of him complaining about the food and the stay,” Kanojia told DNA.Sources close to the judge said that Justice Karnan would not give up on his fight for the backward class and would continue to raise his voice against atrocities faced by Dalits. Justice Karnan had been hitting the headlines for several years now. He was the first judge of a High Court to write to the National Commission for SCs and STs in 2011, alleging harassment by other judges.In 2014, he had reportedly barged into a court at the Madras High Court where a hearing was in progress and hit out at the judiciary for being biased. It was then the Supreme Court had ordered his transfer to the Calcutta High Court.In 2017, he wrote a letter to the Prime Minister in which he alleged that at least 20 sitting and retired judges had indulged in corrupt practices. In March 2017, a bailable warrant was issued against him which he had termed as an ‘attempt to ruin his life as a Dalit judge. The Supreme Court also requested him for a certificate of mental fitness. He refused to cooperate with the doctors who had come to his residence for his mental check-up which led the apex court to sentence him for six months on May 9. After that he kept on evading arrest by moving from one state to another for 42 days, before he was finally arrested on June 20 from Coimbatore and brought to Presidency Correctional Home.

Shekhawati heritage needs to be promoted: CM Vasundhara Raje

Chief minister Vasundhara Raje, on Tuesday, underlined the importance of promoting the heritage of Shekhawati region. During the ‘Mukhyamantri Jan Samvad’ organised at Jhunjhunu-based JJT University, Raje said that several towns of the area, including Nawalgarh, Ramgarh, Fatehpur, and Alsisar have valuable heritage which is yet not fully explored. Information about these heritage sites should be uploaded online in order to get a global recognition.While talking about the achievements of the state government in the region, Raje said that a water pipeline has been established under Kumbharam Lift Canal from Taranagar to Malsisar. This was a Rs 172 crore project which took four years to complete. She instructed the officials of Public Health Department to find a solution to the irregular availability of water in Malsisar. She asked them to consult the residents of the area for the same.Furthermore, the chief minister instructed the officials of Public Works Department to identify the broken small roads and outline a project of development of the same in Jhunjhunu, in next 10 days. During the public meeting, she said that the state government, in addition to building large roads, is also focused on connecting the towns through small roads. The roads which need re-work, expansion or renewal will be identified. In addition to this, she instructed the Chief Medical Health Officer of Jhunjhunu to keep a proper check on the Public Health Centres of the area. This came after a complaint was filed regarding two out of five positions being vacant in the PHC. The complaint also elaborated that the doctors in PHCs were not available during their duty hours.

Full-time DG in eight weeks: Gujarat high court tells state

The Gujarat high court has ordered the state government to appoint a Director General of Police (DGP) by following the regular procedure within eight weeks of time. The order comes after a public interest litigation sought directions to the state government to appoint a regular DGP instead of running the police department with an in-charge DGP. The state had cited assembly elections as a reason for the step. Former IPS officer Rahul Sharma had moved the petition challenging the state government’s decision to continue to appoint in-charge DGP. While passing the order, first division bench of chief justice R Subhash Reddy and Vipul Pancholi on Monday has concluded, “As per the Supreme Court order in Prakash Singh Vs Union of India, and even the Bombay Police Act and the Gujarat Act, the state government is bound to appoint DGP on regular basis. So, there is no reason for the state government for not filling the post with regular DGP. Though the state government has claimed that as the elections are going on it can take any steps, but it is the state government’s obligation to appoint regular appointment. The state government should initiate the process of the selection of the regular DGP and appoint within eight weeks of this order.”The petitioner’s advocate IH Syed had submitted that since 2016 there has been no regular DGP and the state police department is run by the in-charge officer, which is affecting its operations. 20-year-old BMC cleaner dies in an accident

A 20-year-old man, who was traveling by a Brihanmumbai Municipal Corporation’s clean up van died after the vehicle was hit by a speeding trailer on Monday afternoon.The deceased has been identified as Rizvan Shaikh. a cleaner of BMC.According to the police, the incident took place around 4:30 pm on Monday when Shaikh was seated beside the driver of the vehicle. Near the Ghatkopar-Mankhurd Link road, when the cleanup van was taking right turn, a speeding trailer came from behind and hit the van injuring Shaikh fatally. The police said, Shaikh had sustained a severe head injury and was immediately rushed to nearby hospital. However he succumbed to his injuries on Tuesday morning.The driver of the trailer fled from the spot,”We have registered a case of rash driving and causing death due to negligence. The victim was a friend of the driver and would come to help him. They were going home when the incident took place. We are trying to trace the vehicle that hit the van,” said a police officer from Tilak Nagar police station.

School students made to serve snacks to MP state minister to learn ‘hospitality’

A school in Madhya Pradesh has landed in controversy after students were made to serve tea and snacks at the state government’s Balrang Samaroh in Bhopal where state education minister Vijay Shah was present.Defending the movie, Shah said that while there was staff available, students were asked to serve so that they learned the values of hospitalityHowever, Anju Bhadoria, the convenor of the Lok Shikshan Sanchalanalaya in Madhya Pradesh said that while it has been a tradition for students to serve, she felt it was wrong and she later stopped the students from doing so.In May this year, school teachers were ordered by the education authorities in Singrauli district of Madhya Pradesh to serve food to guests at a government-sponsored mass wedding.The District Education Officer (DEO), however, clarified that this order was not mandatory for the teachers. An organisation of primary and middle school teachers has termed the order as violation of Right to Education (RTE) Act, which does not allow using services of teachers for such purposes. The education department in Singrauli, in the order, had directed the teachers to serve food to the guests at the mass wedding ceremony, in which 2,400 couples tied knots in presence of the Madhya Pradesh Chief Minister Shivraj Singh Chouhan and other dignitaries.

Gujarat Elections 2017 | EVM-tampering charges now seem silly, but Hardik Patel still at it

The close contest between the BJP and Congress in Gujarat elections, that swung like a pendulum for most part of the day, seems to have drawn curtains on the controversy revolving around Electronic Voting Machines (EVM).The Congress, which continuously questioned the impartiality of the EVMs during the run-up to Assembly polls, did not raise the issue on counting day when it saw its tally growing. The only exception was Patidar Anamat Andolan Samiti (PAAS) leader Hardik Patel, who attributed the BJP victory to EVM tampering. “I won’t greet BJP on its victory because these victories have been won through unfair means,” said Hardik. “The public of Gujarat has awakened but is required to be awakened more. That EVMs have been tampered with is a reality.”Chief Election Commissioner Achal Kumar Joti cleared the air, saying, “No EVM has been tampered. Questions raised about EVM tampering have already been answered.” He added that voting had been conducted through Voter Verified Paper Audit Trails (VVPATs) which enabled people to see whom they voted for. “All arrangements were made in Gujarat by the Chief Electoral Officer of the state in view of the counting,” he said.To remove all doubts of tampering, the Election Commission (EC) had ensured 100% coverage of elections through EVMs fitted with VVPAT machines.Before deciding to deploy EVMs and VVPATs in Gujarat elections, the EC had even arranged a Hackathon in which it invited all political parties to try and show if tampering was possible.Former chief election commissioner, T S Krishnamurthy, said EVMs have emerged as the “real winner” in Gujarat and Himachal Pradesh elections, and their “bashing” should stop now. “They (EVMs) have done their job well,” Krishnamurthy said. “After all, the Congress has increased its position (in Gujarat, as compared to the last elections). Some BJP leaders have been defeated. EVMs have served their purpose.”Blaming both the Congress and the BJP for attacking EVMs at their convenience, he pleaded that the debate should now stop. To this end, Krishnamurthy referred to a book authored by BJP national spokesperson GVL Narasimha Rao some years ago casting doubts on EVMs. “If they (the political parties) want to show (sic) their responsibility, they have to go to court or to an independent body of technical experts and prove it,” he said.Former chief election commissioner H.S. Brahma also said that VVPATs could not be tampered with. “I firmly believe that our EVMs and VVPATs cannot be tampered with,” he said. “This matter should be closed once and for all.EVM is a standalone machine. The question of hacking doesn’t arise.” Two other former chief election commissioners N. Gopalaswami and Naveen Chawla have also said that they believe EVMs cannot be tampered with.

Gujarat Elections 2017: 100% match in random vote count on EVMs and VVPAT slips, confirms EC official

There was a “100 per cent match” in the random vote count on EVMs and paper trail slips carried out by the Election Commission in 182 Gujarat polling stations today, a senior official said.The EC had said it would conduct random vote counts on EVMs and VVPAT slips in one polling station in each of the 182 Assembly constituencies. “There was a 100 per cent match in the results of the EVM and the slips produced by the paper trail machines,” the official of the election machinery said. The polling stations were decided through a draw of lots in which the candidates or their agents were also present. The EC had decided to match the tally in select polling stations amid allegations that the EVMs were compromised to help the BJP.In Gujarat, Chief Electoral Officer B B Swain also said that the vote count through the EVMs matched with the VVPAT in all the constituencies where the paper trail slips were counted. Officials did not find any mismatch in the EVM vote count and VVPAT slip count as the counting concluded today evening, Swain said. “This was basically a confidence-building exercise. We did this at one polling booth each in all the 182 seats after the counting ended today. At all these booths, vote count of a randomly selected EVM matched with the slips of the connected VVPAT. Gujarat elections 2017: Counting of votes to begin at 8 am today, results by noon

The counting of votes for the Gujarat Assembly elections will commence at 8 am and most of the results are likely to be in by noon.State’s Chief Electoral Officer BB Swain said that counting of votes for the 182 Assembly seats will take place at 37 centres, including three in Ahmedabad. The Election Commission has set up two counting centres each in Surat and Anand, and one centre in the remaining 30 districts.”The counting of votes will begin at 8 am with counting of postal ballots. The counting of votes cast their Electronic Voting Machines (EVMs) will commence at 8:30 am once postal ballots have been counted,” Swain said. Initial trends about the winners are likely to emerge within two hours of the counting, and a clear picture is expected by noon.The counting of votes will take place in 182 halls across the 37 counting centres. In each hall, there will be 14 tables for the counting.”On each table, there will be once counting supervisor, one counting assistant, and one micro-observer. In addition, Election Commission has appointed one observer for each constituency,” he said.As many as 10,000 counting staff and 8,000 support staff have been deployed for counting of votes. More than 25,000 security personnel will be on guard during counting of votes.

Man dies in crossfire, protests rock Valley

Massive protests rocked Kupwara in north Kashmir on Sunday after a 28-year-old taxi driver was shot dead at the Thandipora village of Kralpora in the border district on Saturday night.While family and locals accused the Army troops of killing Asif Iqbal Bhat, the Army spokesperson maintained that he was killed in crossfire. The police have filed an FIR ans the J&K government has ordered a magisterial inquiry into the incident, in an apparent bid to calm the tempers.Meanwhile, Sajid Iqbal, brother of the slain taxi driver, said: “A passenger called us, requesting Asif to pick him up from the Batpora Road. Then my brother said he was leaving. I was in my room when I heard the gunshots. In a minute, my parents and sisters rushed to my room and said Asif has been killed. We went out to figure out who fired the shots but somebody fired at us as well.”According to the police, Asif got seriously injured after being hit by a bullet at Thandipora.”He was shifted to the sub-district hospital in Kralpora for treatment, from where he was referred to the Srinagar hospital for better treatment, but he succumbed to his injuries,” a police spokesman said.Senior superintendent of police, Kupwara, Shamsheer Hussain said it was an unfortunate incident and they have set up inquiry commission to investigate the circumstances in which the firing took place. “We will go to the bottom of this case. Locals are alleging that an Army party opened fire. Nobody is above law. We will investigate it thoroughly,” he said.When queried, Colonel Rajesh Kalia, defence spokesman at Srinagar, said the Army had placed ambushes in the Thandipora village to maintain surveillance over the area after receiving information about the presence of terrorists there on Saturday night.”At 10.55 pm, an ambush party observed suspicious movement of three persons near the Nallah in Thandipora village. The individuals were challenged by the troops but they did not respond. Thereafter, the terrorists opened fire at the ambush party, which was returned. In the crossfire, Asif Iqbal Bhat was killed due to a gunshot wound. It has been learnt that he was a Sumo taxi driver. Investigation is in progress,” Colonel Kalia said.Massive protests then rocked the village, with hundreds of people taking to the streets, raising pro-freedom slogans, blocking the roads, and clashing with the police. Sensing trouble, Kuopwara district commissioner Khalid Jahangir ordered a magisterial inquiry and asked the inquiry officer to submit a report within three weeks.Expressing grief over the incident, J&K chief minister Mehbooba Mufti directed the district administration to speed up the probe and punish the culprits. The main Opposition, National Conference, too, condemned the killing and demanded a thorough investigation into the incident. “The FIR registered by the police must be taken to its logical conclusion. Being killed in a crossfire can’t be a justification for Asif Iqbal’s death,” tweeted Omar Abdullah, former J&K CM.Separatists also jumped on to the bandwagon to lash out against the government. City sees a 43% rise in debit and credit card frauds

Mumbai city has seen a whopping 43 per cent rise in cases of debit/credit card fraud as compared to last year. While as many as 546 cases of credit/debit card fraud were registered in Mumbai from January till November this year, 382 cases were registered last year during the same period.Experts say that the increase was reportedly due to demonetisation as a huge number of citizens went for cashless transactions after November last year.While, debit/credit card fraud cases are on the rise, the detection of these cases have come down. According to Mumbai police’s statistics, while 50 people were arrested in these cases from January till November last year, this year, 35 people were arrested during the same period.”An increased number of citizens have gone for cashless transactions following demonetisation last year and hence the instances of debit and credit card frauds have increased. There are various modus operandis that cyber-fraudsters use to dupe citizens. The most common of them is where debit cards of users are being cloned using skimming devices,” said a senior Mumbai police officer.Speaking about what precautions one can take to ensure they are not duped, the officer said, “One must not share his/her card number, CVV number and expiry date of a card. In case of suspicious transactions, one should immediately notify the bank. Also, please beware while swiping your cards at restaurants and bars; do not share your PIN with the waiters and enter the PIN for the card yourself in the swiping machine.””Around three years ago my credit card was cloned and the bank refused to file a case in this regard. The numbers revealed in the police statistics are actually very low than what it should be. Such massive frauds are not possible without the connivance of bank officials. Madhya Pradesh: 18-year-old arrested for allegedly setting fire to car belonging to priests

An eighteen-year-old was arrested on Saturday in MP’s Satna for allegedly setting fire to a car belonging to priests who were accused of forced conversion by Bajrang Dal, reported NDTV. The incident allegedly took place on Thursday.
