Rajasthan weapon seizure: Dealer a madarsa teacher

The illegal arms seized by the Special Operation Group (SOG) in Nimbahera of Chittorgarh district of Rajasthan were to be supplied to one Maulana Jahid. The weapons were to be sold at Rs 11 lakh.Maulana is a resident of Pratapgarh district and was living in a rented accommodation in Chittorgarh. He used to teach children at a madarsa. The three persons who were arrested by the SOG lat week gave this information during interrogation.The SOG looked for Maulana in Chittorgarh and Pratapgarh, but he had managed to flee. They are still on the lookout for him, as he would be the link to getting further information about where the illegal weapons were to be sold.Last week, acting on information obtained, the SOG had arrested three persons with 19 pistols and one revolver. The arrested — Irfan Khan, Saddam Hussain, and Firoz Khan — were in possession of the weapons and on being arrested had told the SOG that they had procured the weapons from Madhya Pradesh. The weapons had been purchased at Rs 27,000 per piece and they had struck a deal to sell them at Rs 55,000 per pistol in Rajasthan.Sleuths of SOG were into telephonic suvllience for a long time and for the past 3 months they were getting inputs on supplying of illegal weapons in Chittorgarh from the neighbouring Madhya Pradesh.Over the last year, illegal weapons have been recovered from Sawai Madhopur, Karauli, and Bharatpur. As many as 58 weapons have been recovered, while 27 persons have been arrested.Seized weaponsSeized weapons were to be sold at Rs 11 lakh. The SOG had arrested three persons with 19 pistols and one revolver.

2G scam verdict: 700 old judgments paved way for acquittal

Special Judge OP Saini read over 700 old judgments which were given as case references by various lawyers before penning down the fate of all the 21 accused, including former Telecom Minister A Raja and DMK leader and MP Kanimozhi in the 2G spectrum allocation scam.”I may note that I have carefully gone through the entire case law cited at the bar by the parties. I have also carefully gone through the written submissions filed by the parties. The case law would be referred to as and when required,” Special Judge Saini said.In the 1552 page judgment delivered by Saini, he mentioned all the case references by all the respective lawyers of the several accused. Altogether 608 case references of several cases were put forth by both the parties even though a few of them might be repeated. Besides 102 references were made as rebuttal.Advocate Vijay Agarwal, on behalf of his client RK Chandolia, gave the maximum numbers of case references during the proceedings taking the number to 134. It was again Agarwal who gave 97 references on behalf of his client Shahid Balwa. This was followed by 63 references made by the same lawyer for two of his clients Asif Balwa and Rajiv Agarwal.A little behind Agarwal was Special Public Prosecutor Anand Grover, who made 102 references during rebuttal. However, he gave just 35 references during the trial. The least number of references were given by advocate Deeksha Khurana for Swan Telecommunication who referred to just a single case.While 30 references were made for A Raja by his counsel Manu Sharma, 15 were made on the behalf of Kanimozhi by her counsel Amarender Sharan.Special Judge Saini repeated about the huge volume of records and documents involved in the case in the judgment.Even on Thursday, as he entered the court room to pronounce the judgment followed by his court staff carrying the huge pile of papers, he said, “Giving the huge records of the case, this is a very brief judgment I have written.”The judge also mentioned in his the judgment that lawyers of both the accused and the CBI filed written submissions running into 25,000 pages.”It may be noted that in view of voluminous record running into several lac pages and also technical nature of the case, oral arguments for the parties continued for about two years. Both the parties also filed written submissions in detail running into about twenty five thousand pages,” the judge said.He also appreciated the advocates for both parties for their hard work put during the trial of this voluminous, technical and complex case, the record of which runs into about three four lac pages.

Om Prakash Chautala granted parole to attend ailing wife

The Delhi High Court on Friday granted two weeks’ parole to former Haryana chief minister Om Prakash Chautala, who is serving a ten-year jail term in a teachers’ recruitment scam case, to attend to his ailing wife.Earlier on December 11, the court had issued a notice to the state government to file a response to a parole petition moved by Chautala.Chautala wanted a two-month parole to look after his ailing wife.In March, the court had cancelled the parole granted to Chautala after he violated the terms and conditions. The police raised objections that he was holding public meetings in violation of his parole conditions. The High Court also observed that Chautala was misusing his parole by attending public meetings across Haryana.Chautala, his son Ajay Singh Chautala and three others, are serving jail terms in the case.On January 22, 2013, a trial court had sentenced 55 accused in the case. Among those convicted were 82-year-old Chautala`s then political adviser Sher Singh Badshami, the then Officer on Special Duty (OSD) Vidya Dhar, IAS, and then Primary Education Director Sanjiv Kumar, besides 50 others. A total of 55 persons were convicted under the JBT scam for illegally recruiting 3,206 teachers in Haryana in 2000. The father-son duo, including two IAS officers, was among 55 persons convicted on January 16, 2013, by the trial court.

CBI, ED to appeal against verdict

Shocked over the special court’s judgement to acquit all the accused, the Central Bureau of Investigation (CBI) stated that they had been filing monthly status reports before the Supreme Court and the investigation was appreciated at every step. However, sources said they fail to understated why the judgement went against them. The agency decided to appeal against the court order.Also Enforcement Directorate decided to appeal against the order. ED said the Special Court appears to have failed to appreciate the money laundering offence that probed by it should have held ground and not linked to CBI’s corruption case.”Besides the observation and findings of the Supreme Court in this case appear to have not been considered by the Special Court,” the ED added.Sources in the CBI said, “Our key contention was not taken into account by the special court. We are going through it for as it is lengthy judgement. The key points which struck us immediately was that there written and documentary evidence and it was not given due to importance.”Sources further pointed out that the court has relied on oral evidence of the accused and also failed to see the bribe trail wherein Rs 200 crore ‘pay-off’ happened wherein a company take loan on 14 percent and given at 5 percent. “We had documentary evidence running into lakh of pages, the court relies on accused statements,” the source said.CBI in a statement said, “The judgement relating to 2G scam case today has been prima facie examined and it appears that the evidence adduced to substantiate the charges by the prosecution has not been appreciated in its proper perspective by the Learned Court. CBI will be taking necessary legal remedies in the matter. In due course, CBI will be filing an appeal.”In the meantime, ED pointed out that the Special Court prima-facie appears to have failed to appreciate the offence of money laundering as defined under Section 3 is, based on the term proceeds of crime.ED also said the special court has appreciated the material evidence qua offence of money laundering at the time of framing of charges against the accused persons but the same material appears to have not been considered while deciding the prosecution complaint under PMLA and the accused persons have been acquitted from the offence of money laundering only on the basis of no commission of offence and not the occurrence of criminal activity.”We have decided to move in appeal against the judgement of the Special Court on a number of grounds based on the facts as well as legal provisions,” the ED said in a statement.

2G case verdict: Political slugfest breaks out after all accused acquitted by special court

A Special CBI court today acquitted former telecom minister A Raja, DMK MP Kanimozhi and all other accused in the 2G scam case that had rocked the Manmohan Singh-led UPA-II government, holding that the prosecution “miserably failed” to prove any of the corruption and money laundering charges.The stunning verdict came as an anti-climax in a case that had been repeatedly highlighted by the BJP during the 2014 general election campaign as the hallmark of corruption in the then UPA regime. He also debunked the presumptive loss theories in the allocation.Raja, who was the Telecom minister in the Congress-led UPA government when 122 spectrum licences were issued to 8 companies in 2008 on first-come-first-serve basis, said his actions were for the benefit of masses.Raja remained in jail for over 15 months while Kanimozhi was in prison for six months before they were granted bail.Other accused persons were also in jail for varying terms.The trial in the three cases relating to the 2G scam began after the then Comptroller and Auditor General Vinod Rai in his report alleged 122 2G licences were given to telecom operators at throwaway prices when the UPA was in power and pegged at Rs 1.76 lakh crore the loss to the national exchequer.The CBI had alleged that there was a loss of Rs 30,984 crore to the exchequer in allocation of licences for the 2G spectrum which were scrapped by the Supreme Court court on February 2, 2012.Former telecom minister Kapil Sibal demanded an apology from Rai, saying his stand on loss from the 2G spectrum allocation stands vindicated. Sibal had contradicted the CAG report, maintaining there was “zero loss” to the Government as a result of giving 2G licences to new players in 2008.The verdict also echoed in the Lok Sabha where senior Congress leader M Veerappa Moily demanded that Rai quit all posts. Rai heads the Supreme Court-appointed four-member panel of administrators to run the affairs of the BCCI and is also the Chairman of the Banks Board Bureau.Besides Raja and Kanimozhi, the other accused who were given a chit in the main CBI case included former Telecom Secretary Siddharth Behura, Raja’s erstwhile private secretary R K Chandolia, Swan Telecom promoters Shahid Usman Balwa and Vinod Goenka, Unitech Ltd MD Sanjay Chandra and three top executives of Reliance Anil Dhirubhai Ambani Group (RADAG) — Gautam Doshi, Surendra Pipara and Hari Nair, Asif Balwa, Rajiv Aggarwal of Kusegaon Fruits and Vegetables Pvt Ltd, film producer Karim Morani, Sharad Kumar, Director of Kalaignar TV were also acquitted in the money laundering case.Three companies–Swan Telecom, Unitech Wireless(Tamil Nadu) limited and Reliance Telecom limited–listed as accused in the main case were also acquitted.The acquittal of all the accused brought to end the trial that lasted nearly seven years in one of the most controvesial corruption cases that involved politicians, bureaucrats and a host of businessmen and corporate executives accused of conspiracy in the allocation of spectrum or radio waves used to offer mobile servies.Raja and Kanimozhi were also let off in another case lodged by the ED under the money laundering law arising out of the 2G scam.

Although drunk driving-related deaths have reduced, two people die every hour, LS told

In India, two people die every hour in road accidents for driving under the influence of alcohol, the Lok Sabha was informed on Thursday.The good news, however, is that the number of alcohol-related deaths on roads has reduced sinec 2014. In 2014, the number of deaths was recorded at 18,196 due to driving under the influence of alcohol, which is still a fraction of the total road accidents that year, which was recorded at 4.89 lakh.In 2015, the numbers came down by 2,000, while in 2016, the numbers were recorded at 14,894.In November this year, the Delhi Traffic Police have launched a special drive to curb drunken truck driving in the city. Special check points have been set up at city borders between 11 pm and 1 am, and drivers are being stopped for breathalyser tests. If the drivers fail the test, their trucks will be impounded.The step comes after an analysis conducted by cops revealed that 54 per cent of accidents involving Heavy Traffic Vehicles (HTV) this year took place between 11 pm to 2 am.Several teams have been constituted under the supervision of traffic inspectors to conduct random checking of heavy vehicles at borders. In fact, as many as 22 drivers were prosecuted on the first night, according to a statement by the Traffic police department.As per cops, action has been taken against 26,491 drunk drivers, including 197 HTV and 949 LGV, till November 15 this year. The heavy goods vehicles were found involved in 136 cases of fatal accidents till November 15, compared to 148 last year .”Analysis indicates that 54 per cent accidents involving HTY took place at night between 11 pm and 2 am. As many as 35 per cent of the hit-and-run cases also took place between 10 pm and 4 am.”Regular checking of these vehicles is expected to effectively reduce the number of accidents. Similar action will also be taken against dangerous driving in near future,” the statement added.

India and China will hold the next round of border talks here on Friday, the first after the 73-day-long military standoff between the two countries in Doklam in summer months.Issuing a brief statement today, the external affairs ministry said at the invitation of Ajit Doval, the National Security Adviser and the Special Representative on the boundary question, Yang Jiechi, State Councillor and China’s Special Representative on the issue will visit India on December 22 to hold the 20th SR-level meeting. Ahead of the talks, Chinese foreign ministry spokesperson Hua Chunying told a media briefing that this SR meeting is not only a high-level channel for the border issue discussion but also the platform for strategic communication.”In 2017, China-India relations have maintained a good momentum generally but the Doklam incident posed a major test for the two countries. We should learn lessons from this incident to avoid any further conflict of this kind in the future,” Hua said. Chinese and Indian troops were locked in the border standoff from June 16 when Indian soldiers stopped Chinese personnel from building a key road close to India’s ‘chicken’s neck’ corridor. On August 28, India announced the “disengagement” between the soldiers of the two countries. The road was being built by China in an area also claimed by Bhutan.

PM Modi announces Rs 90,000 Cr for improving roads, highways in North East

Maharashtra to use drones for mapping 71 villages along Mumbai Pune Expressway

In order to carry out survey and map 71 villages along the 94-km-long Mumbai Pune Expressway, unmanned aerial system (UAS) known as drones will be used by the Maharashtra State Road Development Corporation (MSRDC). The MSRDC has already roped in a consultant who will prepare a development plan and chalk out future development potential of the 71 villages along the Expressway. Kiran Kurundkar, Joint Managing Director, MSRDC, said, “We have already appointed consultant who has started his work for preparing development plan for the villages along Expressway. We are using drones to conduct survey as it helps in mapping particular areas accordingly.”The project is a part of the MSRDC being appointed as Special Planning Authority (SPA) for areas two kilometre south-west from Mumbai-Pune Expressway and Mumbai-Pune Old Highway (NH-4).The plans after having prepared a development plan is to have MSRDC will look after the development of large of land parcels along the Expressway by acquiring plots from locals or villagers.The Maharashtra government had in March 2016 notified MSRDC SPA for the 71 villages. Of the 71 villages, majority of them are located in Khalapur and Panvel.

Marriage does not mortgage woman to man: Supreme Court

On Thursday, Chief Justice of India Dipak Misra observed that a woman does not mortgage herself to a man by marrying him. She retains her identity, including her religious identity, even after she exercises her right to marry outside her community under the Special Marriage Act.The top court’s observation came when a five-judge bench was hearing the matter of a Parsi woman who was barred from entering the Tower of Silence to offer prayers for her dead relatives because she married outside her faith.”Special Marriage Act confers in her the right of choice. Her choice is sacred. I ask myself a question: Who can take away the religious identity of a woman? The answer is only a woman can choose to curtail her own identity,” Chief Justice Misra said on the first day of the hearing.Couples from different faiths who wish to retain their individual religious identities may opt for a marriage under the Special Marriage Act, 1954, which ensures religious protection.Nobody can presume that a woman has changed her faith or religion just because she chose to change her name after marrying outside her community, the CJI observed.The bench — also comprising Justices AK Sikri, AM Khanwilkar, DY Chandrachud and Ashok Bhushan — then asked senior advocate Gopal Subramanium who is representing the Valsad Parsi Anjuman Trust whether it would allow petitioner Goolrukh Gupta time to respond by next week.Should the trust respond in the negative, the court will then have to decide whether a Parsi woman can hold on to her religious identity if she chooses to marry someone outside her faith.Prima facie, the top court observed that it did not adhere to the principle of merger relied upon by the Gujarat High Court in denying Gupta the right to practice her faith. Gupta has challenged the high court’s order which essentially suggested that by the principle of merger, Gupta became a Hindu when she married one and thus ceased to be a Parsi.Representing Gupta, Senior Advocate Indira Jaising sought the court’s indulgence to treat this case as an endorsement of inter-faith marriages. Those who marry outside their faith should be saddled with any disabilities, she added. Government data suggests that the Special Marriages Act is not used as often as it should be, she said.Every custom, usage, customary and statutory laws must stand the test of the Fundamental Rights principle, Jaising said. Article 372 (continuance of existing laws) of the Constitution is subject to Article 13, which mandates that laws should not violate the fundamental rights of an individual, she added.Suggesting that excommunicating Parsi women for marrying outside the faith tantamount to gender discrimination, CJI Misra asked: “How can you (Parsi elders) distinguish between a man and woman singularly by a biological phenomenon… If a woman says she has not changed her religion, by what philosophy do you say that she cannot go to the Tower of Silence? No law debars a woman from retaining her religious identity.””If a woman’s identity is merged, then Special Marriage Act is not required, is it not?” Justice Sikri pointed out.”The Tower of Silence is not a mutt or a citadel of a cult. It is a place to offer prayers to the dead. Can such a right of a woman be guillotined? It is part of her Constitutional identity,” CJI Misra further observed.The court’s decision favouring the Parsi woman’s right will create a paradigm shift for women within the minority community. Earlier this year, the top court recently ruled in favour of Muslim women by striking down instant triple talaq as unconstitutional.

Non-bailable warrant against Sasikala’s husband M Natarajan

A court here today issued a non- bailable warrant (NBW) against M Natarajan, husband of deposed AIADMK leader V K Sasikala, and three others in connection with a case of evasion of duty while importing a luxury car from the UK 23 years ago.The Eighth Additional Judge of the Principal Special Court for CBI cases, A Thiruneelaprasad, issued the NBW based on a November 17 Madras High Court order, upholding the trial court order sentencing the accused to two years in prison in the case.The counsel for the CBI approached the court, seeking issuance of NBW citing the recent Madras High Court order.Natarajan and three others were convicted for conspiracy, forgery, cheating and tax evasion and sentenced to two years in jail in the case by the court in 2010. All the accused appealed against the CBI court order.When the pleas came up before the high court on November 17, it had dismissed their petitions and directed the trial court to secure the accused and remand them in judicial custody to undergo the remaining period of the sentence, if any.The case relates to the import of a Toyota Lexus car in 1994, declaring it as a “used vehicle” and thereby allegedly evading tax to the tune of Rs 1.06 crore. The CBI and the Enforcement Directorate registered separate cases against Natarajan and three others after it was found that the documents presented by them were fabricated.According to the CBI, Natarajan, his nephew V Bhaskaran, Yogesh Balakrishnan and Sujaritha Sundararajan substituted the original sale invoice with a photocopy of an invoice fabricated by changing the vehicle’s manufacturing date to July 1993.They cleared the car under transfer of residence provision, and thereby caused a loss of Rs 1.06 crore to the exchequer by way of short levy, penalty and redemption fine, the CBI said.

1984 Sikh riots: Supreme Court to examine panel report on 241 closed cases by SIT

Year on, 5 hospitals still to deposit Rs 600-cr fine

The five private hospitals, which were fined more than Rs 600 crore by the Delhi government a year ago, are yet to pay the amount. They were fined for refusing free treatment to the poor, which was the prime condition for land allotment lease.The AAP-led government in 2016 had slapped the fine on five hospitals— Max Super Speciality Hospital (Saket), Fortis Escorts Heart Institute, Shanti Mukand Hospital, Dharamshila Cancer Hospital and Pushpawati Singhania Research Institute. These hospitals were provided land at concessional rates between 1960 and 1990 on the condition that they will treat the poor free of cost.”These five hospitals were given a chance to explain their stand.” We are hearing their reasons.Three hospitals have gone through the process. The hearing for the other two will take place in the coming week. If at fault, none of them will be spared,” said Dr Kirti Bhushan, Director General of Health Services (DGHS), Delhi government.A total of 43 private hospitals in Delhi were allotted land at concessional rates on the condition that they will keep 10 per cent of their in-patient department capacity and 25 per cent of out-patient department capacity to treat economically weaker patients for free. The penalty was imposed on the basis of a high court order passed in 2007 on a PIL demanding implementation of the provision of free treatment to poor and action against the erring hospitals.”The matter relates to an erroneous demand of Rs 32 crore from Max Hospital, East Block, Saket. This is presently sub-judice. The Hon’ble High Court of Delhi has stayed proceedings and has directed a Special Committee constituted for this purpose to hear the reasons of the concerned hospitals. The hearings continue,” a spokesperson from Max Healthcare said. There were no response from Fortis Healthcare on the matter.The government had in December 2015, sent notices to these hospitals seeking an explanation as to why they failed to treat the poor and why they should not be fined. None of them had satisfactory replies so action was initiated against them.According to sources, top officers in the Delhi government have been pulled up for not taking any decision in the matter. “The officials are sitting on it and no decision has been taken on collecting the fine,” said another health official.”We have been called by the government regularly but they have not taken any decision,” said Dr S Khanna, president, Dharamshila Cancer Foundation.Recently, the Comptroller Auditor General (CAG), who was preparing the audit report, had also pulled up the health department for failing in recover the fine. The auditor had then questioned the department for the delay. The special committee, appointed to look into the affairs of the hospitals as per a high court order of 2007, had imposed a fine of over Rs 32 crore on Max, Rs 36.30 on Shanti Mukand, Rs 10.6 on Pushpawati Singhania, over Rs 100 crore on Fortis and Rs 17.86 crore on Dharamshila.

A man was arrested today by Special Operations group of Rajasthan Police with counterfeit currency worth Rs 1.90 lakh in Rs 2,000 denomination.The high-quality counterfeit currency was seized from the possession of Rajiv Sheikh (20), a resident of Murshidabad in West Bengal, ADG Umesh Mishra said.He was arrested from Jaipur Railway Station, police said.The accused was produced in a court which remanded him to a day’s police custody.According to the police, it is one of the largest seizures of Rs 2,000 counterfeit currency note since its launch in the country.

NCRB data reveals Delhi cops go soft on own men

Data released by the National Crime Records Bureau suggests that Delhi Police is rather lenient in handling crimes committed by its own men. In a surprising revelation, 136 criminal cases were registered against Delhi Police personnel in 2016, of which only 42 were arrested. The NCRB data further shows that of these, only two cases were chargesheeted.The data also revealed that 20 persons escaped from the Delhi Police’s custody last year, of which five escapees were chargesheeted.Also, in 2016, one case of disappearance or death in the Delhi Police’s custody was recorded and a magisterial enquiry was ordered. A case was also registered against the police personnel in connection with the death. However, as per the data, no chargesheet was filed in the case, and neither was any policeman convicted.Last week, Praja Foundation had revealed that the number of complaints received in 2015 against the police force was 12,913, of which 346 were declared false. Only 145 criminal cases were registered but no policeman got arrested. The same year, of the 1,057 cases registered against the police, 62 per cent were either withdrawn or disposed of, while 69 were dismissed, and in 292 cases major punishment was awarded, it said.A number of incidents were reported in 2016 where rogue policing came to light. In December 2016, a head constable was suspended after allegedly helping women pickpockets at a metro station. The act was caught on a CCTV camera. Cancel anticipatory bail of Sajjan Kumar: SIT

Congress leader Sajjan Kumar has been “erroneously” granted anticipatory bail by a trial court and it should be cancelled, the Special Investigation Team informed the Delhi High Court on Thursday.Appearing for the Centre, Additional Solicitor General (ASG) Sanjay Jain informed the court that the trial court had ignored the legal position that the anticipatory bail at the investigation stage in serious crimes should not be granted.”Additional Sessions Judge has erroneously and arbitrarily passed the impugned order (granting bail) as a blanket order and failed to consider the settled legal proposition that applicant (Kumar) must show categorically and specifically that he had reason to believe that he may be arrested in the present case,”the ASG said in a petition seeking the cancellation of anticipatory bail granted to Sajjan Kumar, in connection to the 1984 anti-Sikh riots.ASG Jain also informed Justice Anu Malhotra that due to the influential position of the accused, the witnesses are not coming forward to record their statements as the leader was not in custody.Kumar was granted anticipatory bail by a trial court on December 21 last year in a case where three Sikhs were killed during the riots, which had erupted after the assassination of the then Prime Minister Indira Gandhi by her Sikh bodyguard.The court was informed that the witnesses had fled to Punjab due to the fear of Kumar during the riots and now want to come forward to record their statements.”The memories of the mass murder will stay forever. Today if they want to come and ventilate everything that happened with them, then what is wrong in it,” Jain said, adding, the truth would always remain even after the passage of time.Two cases were filed against Kumar at Janakpuri and Vikaspuri police stations in West Delhi.

Couples getting married under Special Marriage Act can now apply online via Aadhaar-based e-registration system

He said that couples who wanted to opt for ‘court marriages’ could now serve a notice online to the department through the website of the Inspector General of Registration and Stamps instead of visiting the marriage registration offices.The Special Marriage Act, 1954, allows registration of marriages regardless of the faith of either party.According to this Act, the couples have to serve a notice with the relevant documents to the Marriage Officer 30 days before the intended date of the marriage. However, while this process will be enabled online, the couple will have to visit the marriage officer for the solemnization of marriage.“This will ensure that the couple has to visit the marriage office once instead of twice. The process will include biometric authentication. Once objections and queries are cleared, the notice will be accepted and the notice period will begin,” said an official. He added that in the old, manual system, people had to visit the marriage registration offices multiple times to serve the notice and were fleeced by agents and touts.“Since the system will be UIDAI linked, it will prevent misuse,” the official stated.Maharashtra sees over 25,000 marriages being registered under the Act.The state has designated marriage officers in Mumbai city, the suburbs and in Pune with the sub-registrar offices doubling up as marriage offices elsewhere. “The move is intended to increase the number of registered marriages and reduce ostensible expenses on these functions,” the official said.

It also added that similar incident had taken place in Jail number 1 on November 21.”Around 9 pm on November 21, the alarms were falsely set off at Central Jail no 1 and almost all the inmates of blocks C and F of the High Risk Ward were brutally assaulted by the Tamil Nadu Police and Prison officials, continuously for more than one hour,” the plea said.The plea claimed that under such circumstances there is a threat to the life of the petitioner and appropriate directions be issued that evidence of the incident of November 21 not be destroyed or tampered with.The plea also sought the 14 inmates who were allegedly assaulted on November 21 to be produced in the court and that medical aid be provided the injured inmates.On November 20, the Delhi High Court had taken cognisance of media reports where a foreign court had struck down India’s extradition request stating that there would be human rights violations at Tihar due to the conditions.

Man held with fake notes worth ‘Rs 7 lakh’

The accused Kashid said that he has been indulging in transportation and circulation of Fake Indian Currency Notes (FICN) for the last 15 years. Kashid told the police that after demonetisation in 2016, supply of FICN had stopped but from the last four to five months, the supply of counterfeit currency has once again pumped up. The currency is pumped through bordering states and being adjacent to neighbouring countries Malda has become hub of FICN. The accused stated that many persons in Malda are indulging in the circulation of FICN. Recently the NIA also apprehended a resident of Malda with FICN worth about Rs 9 lakhs. He also revealed that he procured the supply of FICN from a person from a neighbouring country who delivers the consignment at the border, by throwing the consignment packet above the wire fencing.

We managed to recover more than 650 pistols, one carbine, four modified carbines, 20 country-made guns, 6,500 cartridges,” Kushwah added.During interrogation, Kailash and Madhav disclosed that Salman was their head and a major supplier of arms to the criminals of Delhi, NCR, Agra, Jhansi, Orai, Jalon and Dhaulpur.Salman said that he joined a gang of arms supplier and had been purchasing sophisticated firearms and ammunition from Khargone and Dhar through agents.”In the last three years, he had started his own interstate gang and was supplying arms and ammunition to the criminals at the rate of Rs 15,000-20,000,” Kushwah added.Police have managed to recover a total of 37 sophisticated semi-automatic pistols and nine spare magazines while they are hunting for the other members of the gang.

CBI Spl Director in list of paid-off beneficiaries: Prashant Bhushan

The petition alleges that CBI Director Alok Kumar Verma had objected to elevation as he was being investigated in a corruption case.The veteran lawyer, who was part of the anti-corruption movement that put the Aam Aadmi Party in power in Delhi, said the CBI registered a case against Gujarat-based Sansesara group company Sterling Biotech Limited, its directors, chartered accountant and the then director of Andhra Bank for allegedly cheating public sector banks of Rs 5,383 crore. He said that the FIR mentions that on June 28, 2011, the Income Tax department had conducted a search and seizure under Section 132 during which incriminating documentary evidence was seized from the group’s premises in Mumbai and Vadodara.As per the FIR, a “Diary 2011” detailed the monthly payouts to income tax officials, several police officers, and politicians in Gujarat.The FIR states that “The documents seized revealed that the Sandesara group has been acting as a depository for receiving funds on behalf of persons including public servants…. (and) showed corruption of various public servants including three senior IRS officers”.SC PILSenior advocate Prashant Bhushan had also filed a PIL in the Supreme Court claiming Asthana’s appointment as the CBI Special Director was illegal.

Any thing could have happened, Dossa could have absconded. In such case officer were expected to be extra cautious, but they were extra lenient. Thus the officer who committed crime need to be dealt strictly.”On December 25, 2016, Dossa was escorted by the police to Porbandar for attending a court case filed against him.

Death penalty to three in 2012 gang rape, murder case

The court also imposed a fine of Rs 75,000 on each of them under various sections of IPC, Arms Act and SC/ST Act. The three were booked in December 2012, in Udhyog Nagar police station of the city for charges of robbery, gang rape and murder. Special SC/ST court judge Girish Kumar Agrawal convicted Kapil alias Anna, Imran alias Dilliwala, both residents of Udhyog Nagar area of Kota city and Tipu alias Sultan alias Aabeed of Tonk district to death penalty under section 302/34 of IPC, told special public prosecutor (SPP), SC/ST court, Kota Kamal Kant Sharma. All the three convicts are about 25-27 years old, he added. The court also sentenced the three to 10 years of imprisonment and imposed a fine of Rs. 20,000 over each of the three under section 376/2G and seven years of separate imprisonment under section 397 of IPC, the SPP said. The three were also convicted to life imprisonment and a fine of Rs. 20,000 under sections of SC/ST Act besides 10 years in jail and a fine of Rs. 20,000 under section 460 of IPC and three years imprisonment and fine of Rs. 5,000 under section 3 of SC/ST Act and fine of Rs. 10,000 under sections of Arms Act, SPP Sharma said.The three convicts, in December 2012 broke into the house of Shiva Koli at around 2 o’clock at night and looted the jewelry, cash and other items and gang-raped Shiva’s 30 years old wife who was sleeping with her minor son in the room, the special public prosecutor said. The three convicts then shot down the woman and the son and fled away after placing the minor son’s dead body into a box, he added. Udhyognagar police on December 6, 2012, lodged a case in this connection under various sections of IPC, SC/ST Act and Arms Act and following the investigation arrested the three who are still in jail as they were not granted the bail. Total 35 witnesses were produced and 130 documents were submitted to the court during the trial, the SPP added.​

One of the applications had also challenged the appointment of the prosecutor in the matter.Kadam, who is arrested in a case of money embezzlement, pleaded the court that he should be allowed to argue in person, which the court had allowed. He had put forth his application in which he challenged the appointment of the Special Public Prosecutor (SPP) Pravin Chavan.In his argument, Kadam claimed that the SPP was allegedly bribed. Meanwhile, when the court was about to direct the SPP to produce the required documents, Kadam interfered several times. It was then the court ordered Kadam to be in his limits.Further, the Jailor of the Byculla prison also filed an application in the court claiming that Kadam is creating nuisance in the prison and that he should be transferred to Arthur road jail and kept in ANDA cell. Chandra had recovered vital documents related to Zabiuddin Ansari alias Abu Jundal, an accused in the 26/11 Mumbai terror attack case.The subordinate officer further informed the court that in order avoid the proceedings of the non bailable warrant against Chandra, steps have already been initiated before a Delhi court. The officer also informed the court that Chandra would appear before it as a witness in the 26/11 case. “As Mr Chandra was busy in investigation of Sunanda Pushkar’s case, he was not able to attend the proceedings of Mumbai’s Sessions Court. Mr Chandra would reach the city early morning on Tuesday,” said the officer. The court, however, informed the officer that just the arrival of Chandra as a witness would not serve the purpose. The registrar of the Patiala House Court, Pankaj Bharti, also needs to appear along with the documents pertaining to Jundal’s identity that were recovered by Chandra at the time of Jundal’s arrest. Earlier, the Sessions Court had issued summons to Chandra asking him to appear before the court as a witness. However, the subordinate officer informed the court that he was unaware about the earlier orders issued by the Mumbai court and thus he could not update on that aspect.Officer saysThe subordinate officer further informed the court that in order avoid the proceedings of the non bailable warrant against Chandra, steps have already been initiated before a Delhi court.

Twin terror attacks leave cop dead, another injured in south Kashmir

International drug cartel busted, ‘Ice’ tablets worth Rs 50 crore seized

All the three were involved in sending pseudoephedrine tablets to Myanmar in order to prepare for famous rave party ‘Ice’. The police seized over 438 kilograms of tablets worth over Rs 50 crores in the market.”Various teams of the special cell were working on international drug cartels running from the national Capital to various other parts of the country, and abroad. The three accused have been identified as Sum Mang alias Pa Mang (46), Sumit Kumar (22) and Sunil Goyal alias Mukesh (51). While Mang resides in Myanmar and controls the syndicate from there, Sumit resides in Vasant Kunj area whereas Goyal is a resident of Ghaziabad,” informed Pramod Kumar Kushwah, DCP, Special Cell. The police team was first informed about Sumit running the racket and sending pseudoephedrine from Delhi. The consignment would then be sent to various North-Eastern states, and further ahead to Myanmar. Pseudoephedrine tablets are used to make methamphetamine or Crystal Meth, which is popularly known as’Ice’. The drug is famous at party circuits, especially at rave parties since it increases the energy level, anxiety and aggressiveness of an individual making them do things faster than the normal human tendency.On October 31, 2017, the police received information about Sumit arriving at a railway station with the drugs. He was arrested along with 340 kilograms of pseudoephedrine tablets. Sumit told the police that the syndicate was being run by Mang, who is based in Myanmar. On Sumit’s instance, Mang was arrested with 96 kilograms of the drug from Delhi.”Mang also had a fake voter identity card and a PAN card, as well. The drug was being sent to Myanmar to prepare methamphetamine, which is sold between 200 dollars to 650 dollars per gram all,” added the officer.Later on Thursday evening, drug supplier Mukesh was arrested from East Delhi along with two kilograms of the tablets.Mang started the syndicate in November 2016 after he came in contact with his friend Tin Tun, who was engaged in preparing the crystal. Tun further told him the entire procedure and even offered 10 per cent offer to which he agreed. He was given contacts which he elaborated further and made godowns in Delhi and Assam. He used to get pseudoephedrine from Mukesh and then stored it in his godown in Hasthsal Uttam Nagar, Delhi. This was, later, transported from Delhi to Dimapur by train in the form of parcels. Later, these parcels were sent from Dimapur to Myanmar via Moreh border up to Tun’s godown.

Delhi police arrest Afghan national for smuggling heroin

The man was trying to smuggle the heroin into India by swallowing them in his stomach.Police say that the accused, who is part of an international drug cartel which has been supplying drugs to people in south Delhi, also told the police that it was his fifth trip to the country and so far he had brought three kilograms of heroin. This amounts to around six crores rupees in the market. The drug was not just being brought to India but was also being supplied to Europe and America via India.So far the Special Cell of Delhi police has seized around 35 kilograms of heroin. In all, 43 persons including six foreign nationals have been arrested by the cell, this year.The accused has been identified as Qari Mohammad Hanif alias Samadi (40). He has two Afghani passports and he travelled around five times to the country since May this year. “Hanif was doing a government job in Afghanistan and has two wives and six children. His father was in the Afghanistan Army and was killed around ten years ago while countering Taliban militants. He had earlier come to the National Capital for heart treatment and stayed in the country for two months,” said Pramod Singh Kushwah, DCP, Special Cell. A team of officers had received an input regarding the accused man. Hanif told the police that he was bringing the drug from dealers back home. “He had rented a flat in Lajpat Nagar and would keep the drugs there. The flat was raided and another 575 grams of Heroin was seized,” added the officer.Hanif revealed that in March 2017 he had gone to Jalalabad, Afghanistan on an official tour. During his stay he met a man identified as Jabatur. Jabatur offered to pay him US $800 per visit for carrying ingested heroin pellets.Jabatur later introduced him to the main peddler Mahpir who provided him the contacts of drug dealers in India. Jabatur and Mahpir have a widespread network in Asia, Europe and American Continent through India. Hanif had to undergo ingestion training at a factory before starting the work for them.

The victim, identified as Wasim Ahmad Tantray, was rescued by the police team, he said, adding Tantray is “reportedly mentally challenged”.”Tantray was immediately rushed to a hospital in Sopore.As the condition of the injured is stated to be critical, he was referred to a hospital in Srinagar,” he said. The spokesman said police have registered an FIR and identified those involved in the incident.More than 130 braid-chopping incidents have been reported from various parts of Kashmir over the past one month but police has so far failed to make any arrest. Special investigation teams have been set up to nab those involved in braid chopping, which has created fear psychosis among the people, especially the women folk. The case was registered by the CBI in December 2002 on the directions of the Punjab and Haryana High Court.A special CBI court in Panchkula has sentenced the Dera chief to 20-year-imprisonment, two sentences of 10 years rigorous imprisonment in each of the two cases.During the trial for the quantum of sentencing, a special court at Rohtak prison had compared Ram Rahim Singh as a wild beast.The court has also fined him Rs 15 lakh in each of the two cases, of which Rs 14 lakh each would go to the two victims who were part of his sect and were coerced into having sex with him.

Aditya was kidnapped and ransom was demanded from his family to pay up debts.The sessions court on Monday convicted Sanghvi on charges of kidnapping and murdering Aditya.Aditya was initially kidnapped for money, but when Sanghvi realised that Aditya’s family was approaching the police, the accused got instructions to kill him in order to close the matter.The prosecution claimed that the police probe was shoddy and the very basics of performing a proper and authenticated panchnama was done poorly.”The police had botched up with the panchnama. The police had recovered CCTV footage of the accused with Aditya in the car, in which he looked playful in Sanghvi’s company. However, the police did not authenticate the footage, which is not admissible in court,” said Special Public Prosecutor Kalpana Chavan.She added, “During trial, I sought permission from the court to get CCTV footage which clearly showed Aditya accompanying the accused in his car. We then got the footage authenticated so that they can be used as evidence in court. Also, there were several witnesses of the total 44, who had supported the prosecution’s case. The prosecution was able to prove the case right from the point when the accused had picked up Aditya by convincing him for a long drive and then later murdering him. The prosecution could also prove that the accused then stashed the body in the car and dumped it on the Mumbai-Pune Expressway. This entire chain was proved with the help of CCTV footage and call data records of the accused. She had assailed the HC finding that a woman universally loses her paternal identity just because of her marriage with a man practising the Hindu religion.She had also sought the right to visit the ‘Tower of Silence’ in the event of her father’s death to perform last rites.The Tower is used for funerary purposes by the adherents of the Zoroastrian faith, in which the traditional practice for disposal of the dead involves the exposure of the corpse to the sun and vultures.The High Court had also held that she would be deemed to have acquired the religious status of her husband unless a declaration is made by a court for continuation of her Parsi status.The woman had approached the high court contending that even after her marriage with a Hindu man, she has continued to follow Zoroastrian religion and thus had the right to enjoy all privileges under the Parsi religion, including right to offer prayers at Agiari, a Parsi temple having the ‘holy fire’ and the ‘Tower of Silence’.She contended that her rights as a Parsi Zoroastrian cannot be denied on the ground that she has married a non- Parsi man.She had also argued that a male Parsi Zoroastrian continued to enjoy all rights available to a born Parsi, even if he is married to a non-Parsi Zoroastrian woman.​

Shimla gang rape: 5 accused take narco test

The six arrested accused were identified as Ashish Chauhan, Rajendra Singh, Subash Singh Bisht, Suraj Singh, Lok Jan and Deepak. Thereafter Suraj, who was lodged in the Kotkhai police lockup with prime accused Rajendra Singh, died on the night of July 18 under mysterious circumstances, five days after he was arrested.They had allegedly kidnapped a teenage girl, who was on her way home from school on July 4, raped her and strangled her before disposing off her body in a forest. However, the body was found two days later. The police on Friday had questioned Kaskar’s partner, a builder from Mumbai who would take contracts of construction work for redevelopment or development projects.The police said, Kaskar was allegedly in a sleeping partnership with the builder. The latter would use Kaskar and Dawood’s name to threaten landowners or tenants, and would take help of other aides of Kaskar to forcefully vacate their premises where he would carry out redevelopment. In return, the builder would give a commission or a profit margin to Kaskar in cash.”We have questioned the builder and it has been revealed that he was running a construction business with Kaskar. Although Kaskar had not invested in the business; he would get a large profit margin in every project. All the transactions were made in cash and we are trying to trace the money trail,” said a police officer.The police are also on the lookout for one RC Angadia, who on behalf of gangster Chhota Shakeel, would collect money from the fourth accused, Pankaj Gangar arrested in the case.Gangar would provide Rs 15 lakh to Angadia for Shakeel, who is in Pakistan, through hawala channels. The police suspects that Shakeel is also running a matka betting racket in Mumbai and other cities and the money would be sent by the accused as his commission in the business.”The Angadia operator and another middleman will be arrested soon. Our team is also in Bihar to look for two of Kaskar’s shooters and raids are being conducted at several locations there with the help of a Special Task Force. On their way, the drivers delivered these consignments in Uttar Pradesh (UP), Madhya Pradesh (MP), and Delhi.The two men have been identified as truck driver Sukhwinder Singh, who has been involved in transporting drugs for seven years, and kingpin Vinay Jain. During his interrogation, Singh said he used to work as carrier for one Karu from MP earlier but Karu was arrested and charged for drug peddling.”Karu introduced Singh to Jain. Singh told us the names of his associates and that he sourced heroin from Manipur. He further disclosed that Jain used to direct him to get the drugs. He would hide the consignment in a secret cavity in his truck and deliver it in various parts of Delhi, UP, MP, and Punjab,” Special Cell DCP Sanjeev Kumar Yadav said.Yadav said Singh used to get Rs one lakh per trip as his share.According to the police, Vinay had been involved in drug peddling for the last 20 years and has previously been arrested a number of times under the Narcotic Drugs and Psychotropic Substances (NDPS) Act in UP, MP, and Punjab.”He has several contacts in Manipur from whom he procures heroin and opium. He has the novel modus operandi of using truck drivers, trucks are difficult to probe during routine checking at police pickets,” the DCP said.Jain was arrested for the first time in 2002 and booked under the NDPS Act in Indore.

Certain facts are being verified,” said the official.When contacted, SP (Detective) Harbir Singh Atwal said they have re-recorded the statements of a few close relatives of the victims this evening to double check some informations.Singh and his mother were cremated yesterday.A doctor said the victims seemed to have died between 2 am and 4 am on Saturday. The doctor said Singh was stabbed at least once close to his heart. “His throat was also slit.” Singh’s three fingers on the right hand were cut and he had multiple injury marks on his “other body parts”, said the doctor on the condition of anonymity.The Punjab Police has set up an SIT to probe the crime.

The agency arrested Wani on August 6.

His location was being traced, and following a tip-off, we arrested him,” said Deputy Commissioner of Police (Special Cell) Sanjeev Kumar.During interrogation, Alam initially tried to mislead the police officials by stating that he was somebody named Ashok Choudhary. But he eventually cracked under their questioning and revealed his real identity as Tanveer Alam. He also disclosed that he belonged to the notorious ‘Pinku Choudhary’ gang, which in Patna’s gangland is known for its fierce rivalry with the ‘Ajay Verma’ gang.In the past, each group has gunned down several members belonging to the other to settle scores and establish dominance in the Bihar capital.”Alam came to Delhi about two months ago and started residing in Mayur Vihar area under the assumed name of Ashok Choudhary. He continued running his extortion racket by making threatening calls to Patna’s affluent businessmen and demanding money,” Kumar said.Alam is wanted in more than 10 cases of crimes of the nature of murder, attempted murder, extortion, dacoity and robbery.

Both of them are absconding.”These are the people we have identified on the basis of the videography done on the day of the verdict who were seen causing violence. We are in the process of identifying more persons on the basis of photos and footage available,” DCP Panchkula Manbir Singh told DNA, adding that a WhatsApp number has been released for any information related to the accused and the information of the person would be kept confidential.The accused are seen hurling stones and holding wooden sticks, with some of them talking on cell phones in the pictures uploaded in the website of the Haryana Police. “Some of them were involved in arranging the inflammable material which they used to torch the vehicles. They were in contact with each other, while the verdict was awaited,” said police.One of the accused, Parkash, who is brother-in-law of Aditya Insaan, has also been arrested from Mohali. The police have also arrested local Dera members who were in contact with Aditya on August 25 and were involved in planning the violence. As many as 35 people had died as the mob went on rampage, torching vehicles and damaging property in Panchkula.Dismissing statements that Honeypreet has escaped to Nepal, DGP BS Sandhu said, “There is no evidence that Honeypreet has escaped to Nepal. These are just speculations. We have sent teams to various states including Rajasthan and search is on to trace her and Aditya Insan. Dera Manager Vipasna has also joined the investigation and she would be called for questioning again.”

Delhi Police arrests Al-Qaeda operative Shauman Haq
