Yet to receive proposal to fill up judges’ vacancies in SC: Govt tells Parliament

There are six vacancies of judges in the Supreme Court, while nine high courts are working without regular chief justices, but the government has not received any proposal from the apex court collegium to fill up the slots, the Rajya Sabha has been informed.Union Minister of State for Law PP Chaudhary, in a written reply, has informed the Upper House of Parliament that the “government has not received any proposal for filling up of the six vacancies of judges in the Supreme Court and for appointment of chief justices in the nine high courts, which are functioning with acting chief justices”. The approved strength of the Supreme Court is 31, including the Chief Justice of India (CJI).The high courts of Andhra Pradesh/Telangana, Bombay, Calcutta, Delhi, Himachal Pradesh, Jharkhand, Kerala, Karnataka and Manipur are working without regular chief justices. As per the procedure for the appointment of judges to the Supreme Court and the 24 high courts, the apex court collegium recommends the names of candidates to the government which, in turn, either accepts the proposal or returns it for reconsideration. The collegium comprises the CJI and four seniormost judges of the apex court.

BJP says it will go alone in the 2019 Telangana elections

BJP would go it alone in the 2019 elections in Telangana and the party is confident of winning them, state BJP chief K Laxman said on Tuesday.”We will not have any alliances. BJP will fight alone and get elected to power in the next elections in Telangana,” he told reporters.Legislative Assembly elections would be held along with the Lok Sabha polls in Telangana in 2019.People of the state are disappointed with the ruling TRS as it has failed to implement its election promises, he alleged.”People have waited patiently for over three years to see, if CM KCR (Chief Minister K Chandrasekhar Rao) would deliver on his manifesto promises, but they were left totally hopeless in this year,” Laxman claimed.The main opposition Congress has nothing to new offer to the people, he claimed.”BJP is declaring an electoral war against TRS in the year 2018. Congress has nothing new to offer to the people of Telangana, they will be rejected in this state as they are being rejected everywhere in India,” he added.BJP currently has a strength of five MLAS in the 119-member house.Saying that BJP has reached out to the masses in 2017, Laxman hoped that the new year would be good for the party.

Gujarat constructed most houses for urban poor: Official data

Gujarat has constructed the most number of houses for the urban poor under the Centre’s flagship housing scheme ‘Pradhan Mantri Awas Yojana (Urban)’ in the country, official data shows.As many as 54,474 houses have been constructed in Gujarat, Prime Minister Narendra Modi’s home state, since 2014-15 under the scheme.This accounts for 18.70 percent of the 2.91 lakh total houses constructed in 36 states and UTs in the country, according to the data of Ministry of Housing and Urban Affairs.Gujarat has received the central assistance of Rs 1,355 crore for construction of these houses.Under the PMAY(U) scheme, the government targets to construct 1.2 crore affordable houses for urban poor across the country by 2022. The government provides central assistance under various components for construction of the houses. Gujarat was followed by Karnataka with the construction of about 33,450 houses since 2014-15.Tamil Nadu constructed 32,730 houses, followed by Madhya Pradesh (27,862), Jharkhand (27,308), West Bengal (24,166), Maharashtra (22,699) and Andra Pradesh (21,794), according to the data.Delhi constructed 1,262 houses for urban poor, while Rajasthan constructed 12,274 houses.Tripura and Uttar Pradesh constructed between 5,000 and 10,000 houses, while Bihar, Chhattisgarh, Haryana, Kerala, Orissa, Punjab, Telangana and Uttarakhand constructed between 1,000 and 5,000 houses. Sikkim had just one house constructed under the scheme so far.Other states and union territories that had constructed less than 100 houses included Auranchal Pradesh, Chandigarh, Daman and Diu, Goa, Meghalaya and Puducherry.

Bill on two-fold salary hike of Supreme Court, High Court judges tabled in Lok Sabha

Law Minister Ravi Shankar Prasad on Thursday introduced a bill in the Lok Sabha that allows for a two-fold hike in the salaries of judges in the Supreme Court and in all the High Courts across the country. If passed, the High Court and Supreme Court Judges (Salaries and Conditions of Service) Amendment Bill, 2017 could increase the monthly salary of the Chief Justice of India from the present Rs 1 lakh to Rs 2.8 lakh.The bill, which will have a retrospective effect from January 2016 will benefit the 21 judges currently in the Supreme Court and over 682 judges in over 24 High Courts. The hike will also benefit over 2,500 retired judges.Currently, SC judges and High Court chief justices draw Rs 90,000 per month. If the Bill comes into legislation, they will earn Rs 2.5 lakh per month. HC judges, who now earn Rs 80,000 will earn Rs 2,25,000 per month.When Prasad introduced the bill in the House, Mahbubnagar MP Jithender Reddy took exception to the legislation and opposed it. “I oppose the introduction of the Bill. We have been fighting for the bifurcation of Telangana High Court,” Reddy said.Speaker M Thambidurai, however, said that for Reddy to oppose, he will need to file a note first.

BJP tears into ‘clueless’ Rahul Gandhi for attacking PM Modi despite wins

A day after Gujarat’s election results were announced, a fierce war of words broke out between the Congress and the BJP.Rahul Gandhi said on Tuesday that the outcome was “a moral victory” for the Congress and “a massive jolt” for the BJP, and has “raised questions on Prime Minister Narendra Modi’s credibility”. The BJP won a sixth straight term, but got 16 seats less, compared to the 2012 Assembly elections. The saffron party ridiculed Rahul, saying he was “clueless on how to compete with Modi”, and that it was the Congress leader’s credibility that was at an all-time low.In a stinging response, two Union Ministers, Ananth Kumar and Prakash Javadekar, said Gandhi was probably trying to redefine the meaning of “setback”.”Frankly, Modi ji has a credibility problem. His party repeats whatever he says, but the nation is not listening to it. Gujarat polls showed it and it would be clearer in the times to come,” Rahul said outside Parliament, in his first interaction after the verdict came on Monday.Rahul said he learnt only in Gujarat that people actually do not accept the so-called “Modi model” of development as it is “a very good propaganda, very good PR (public relations) stunt, very good marketing” but the model is “khokhla” (hollow) from inside.Ananth Kumar said that PM Modi’s credibility was at its peak, not just in India but globally. He also reminded Rahul that the BJP was in power in 19 states. Kumar said the BJP’s vote share of 49.1 per cent in these polls is an improvement over the 47.9 per cent it achieved in 2012.Javadekar also said, “Yesterday (Monday) the BJP won Gujarat for the sixth consecutive time and also got the mandate in Himachal Pradesh. But today (Tuesday) a new definition has emerged as Rahul Gandhi described the results as a setback for the BJP.”He said that if Rahul thinks that it was a jolt for the BJP, then either “he is changing the definition of jolt or trying not to understand it”.”Those who were saying that development has gone mad, people gave them a severe jolt by reposing their faith in the BJP,” he said.The BJP leader said that since 2014, BJP has formed governments in Haryana, Jammu and Kashmir, Maharashtra, Manipur, Assam, Uttarakhand, Jharkhand, Andhra Pradesh and Telangana. “While under Rahul Gandhi’s leadership they have lost since 2014,” he said.Javadekar further reminded Rahul that his party has not only been losing state elections, but was also defeated recently in civic polls in Rahul’s pocket borough Amethi.

Woman kills husband, pours acid on boyfriend’s face for plastic surgery but gets nailed by Aadhaar

61,974 cases of riots, group clashes in 2016; highest in Bihar: NCRB

A total of 61,974 cases of riots and group clashes took place in the country in 2016, down five per cent from the previous year, National Crime Records Bureau data said today.According to it, 35 cases of sedition were also registered in 2016 out of which Haryana accounted for the highest number of 12 cases followed by Uttar Pradesh with six.Among the 61,974 cases of riots and group clashes, the highest — 11,617 cases — were registered in Bihar, 8,018 in Uttar Pradesh and 7,898 in Maharashtra.There were 61,974 cases of riots and group clashes in the country in 2015.The 35 sedition cases registered in 2016 included three each in Karnataka and Kerala, two each in Delhi, Telangana and Madhya Pradesh and one each in Andhra Pradesh, Himachal Pradesh, Odisha and West Bengal.Also readWith 16%, UP accounts for most murders in country: NCRBAs many as 60 cases of custodial deaths or disappearance from lock-ups were reported in the country in 2016 of which 12 were in Maharashtra, nine each in Gujarat and Uttar Pradesh, five in Madhya Pradesh, four in Punjab, three each in Tamil Nadu and Chhattisgarh and two in Rajasthan.A total of 32 people also died or disappeared in the country last year while they were under the remand of the police. He was carrying a reward of Rs 5 lakh, including 2 lakh each from Delhi and Haryana police.Police officials said the gang was active in highway robberies in Delhi, Haryana, Rajasthan, Madhya Pradesh (MP), Uttar Pradesh (UP), Maharashtra, Hyderabad and Telangana.Sahun was a truck driver and aware of all the highway routes. “He targeted vehicles through trucks. He parked his truck before the vehicle to stop them. After committing the crime, he fled. He never used mobile phones. To call a meeting, he would use cryptic messages like “we would meet at the place where we had tea last year”. Hence, it became more difficult to nab him,” said Kushwaha.Police said the accused has escaped from police custody thrice. He escaped twice (2009 and 2011) from the custody of UP police. In 2015, Sahun, along with his gang members, escaped the custody of MP police from Nooh. The accused had fired six times on the police. “He is a very shrewd and dreaded criminal. He was involved in an MCOCA case in Delhi. We have been looking for him for 2 years,” added Kushwaha.

He and four others were sentenced to life imprisonment by a sessions court in the Gadchiroli district of Maharashtra in March this year. “Some of his friends and supporters in Telangana and Andhra Pradesh, who were aware of our financial situation, undertook an initiative on Friday and posted a message on the social media. They requested people to support Saibaba’s family by contributing Rs 500 in my account,” Vasantha said.She further said that though the support was overwhelming, she wanted to request people to not deposit any more money in her account. “I was not aware of the initiative. Otherwise, I would have made this request earlier. I am going to handover this money to the Saibaba Defence committee, which has been taking care of our family since my husband were framed,” she said. The Committee, which was set up in 2013 after Saibaba was arrested for the first time, consists of professors, artists, and authors.“It’s really heartwarming to receive such support and love from across the country. But, I can’t accept even a penny at an individual level as our fight for justice has always been collective,” Vasantha said.In the last seven months, Vasantha has got to visit her husband only three times. Rapid capacity addition by other states has led the prime minister’s home state to fall to the sixth position in solar power capacity.As of September 2017, Gujarat was home to commissioned solar power capacity of 1,384MW, less than half of top-ranked Telangana, where the capacity was 2,792 MW, India Solar Map 2017, a report by Bridge to India, said.Rajasthan, also one of the early states to tap solar power potential, is ranked second with 2,219MW, followed by Andhra Pradesh with 2,153MW. Two other southern states, Tamil Nadu and Karnataka, have also overtaken Gujarat in solar power in recent months. Tamil Nadu is ranked fourth, with 1,804 MW capacity, while Karnataka is fifth, with 1,649MW.Gujarat was ranked third in commissioned solar power capacity as of October last year, only behind Rajasthan and Tamil Nadu. However, other states have made significant addition to solar power capacity to overtake Gujarat. While Gujarat added just 250MW capacity since then, Rajasthan has added over 900 MW and Tamil Nadu over 300MW.“The Gujarat government is not keen on adding solar power capacity as the state already has surplus power. Moreover, states like Rajasthan and Tamil Nadu are giving land at subsidised rates for setting up solar power plants, while Gujarat charges market rate. Hence, it is natural that developers are opting for other states for setting up solar projects,” energy expert KK Bajaj told DNA. Bajaj said that state power utility Gujarat Urja Vikas Nigam Limited already has power purchase agreements with solar power producers and existing capacity is enough to meet Solar RPO (Renewable Purchase Obligation).Gujarat’s power minister Chiman Sapariya could not be reached for a comment despite several attempts. A senior government official admitted that the state is going slow on solar power, but claimed that proposals to set up Ultra Mega Solar Power Projects – projects of 500 MW and above – are under consideration. What is more is that Gujarat is likely to fall further behind the other states, many of which have huge solar capacities in the pipeline, compared with Gujarat which has hardly any project coming up.According to the report, more than 2,400MW solar power capacity is in the pipeline in Karnataka, the highest among all states, followed by Tamil Nadu and Andhra Pradesh, with 1,600MW and 1,500MW, respectively. Fresh capacity of 700-950MW is also under development in Telangana, MP and Rajasthan. At over Rs13 per unit, solar power in Gujarat is the costliest in the country, though tariffs have fallen of late. However, having signed power purchase agreements with developers under its Solar Power Policy, 2009, the state will have to continue buying expensive power for 25 years.

No talks with Pakistan till it stops aiding cross-border terrorism: Rajnath Singh

We invited them not just for shaking hands, but to maintain cordial relations,” the home minister said. The government is determined to stop all sorts of destabilising activities in the country, he said, and alleged that Pakistan is violating ceasefire agreements. “It started sending terrorists into our country. It violates ceasefire agreements. I want to assure you that we will end terrorism, extremism and Naxalism too,” he asserted.The situation on the border has changed as India began giving befitting reply to the enemy, which has “set an example in country’s history”, Singh said.Recalling an incident where five Indian civilians were killed in cross-border firing by Pakistan, the home minister said he had a conversation with a top official of the Border Security Force in 2014 where he asked the official to act tough on intruders and Pakistan’s anti-India activities. “I told the BSF DG not to show ‘white flag’ (signal for talks) next time but give them a befitting reply.” Singh also cautioned people against those trying to divide the country on the basis of community, caste and language. “Today, the (Telangana) Liberation Day, we have to take a pledge that we will ensure that the country will not be divided on the lines of community, caste and language. Those who try to weaken the country are anti-national forces. The percentage is significant, given that most of those procuring a learner’s licence retain the document for months before moving on to a regular driving licence.The data, released last week, also reveals that aside from the 41,405 accidents involving those holding a learner’s licence, a majority, 84.6 per cent, of road accidents involved regular driving licence holders, and 32,088 or 6.7 per cent of the total accidents involved those without any licence.Madhya Pradesh recorded the maximum number of road accidents involving learner’s licence holders at 6,068 in 2016, followed by 5,702 in Telengana and 4,627 in Uttar Pradesh. Similarly, Tamil Nadu has recorded the maximum accidents involving those without any licence at 5,610, followed by 3,082 in MP.The revelation has raised concerns in the government with officials stating that learner’s licence regulations are not being strictly implemented by states and could be issued in an ad hoc manner.”For example, anybody holding a learner’s licence should be accompanied by an adult holding a regular licence, while driving. It is the responsibility of the states to ensure such regulations are adhered to,” a senior official from the ministry said.Officials say that in many instances, minors drive vehicles for a couple of years before securing licences. As a result, they invariably get involved in several accidents.The report also reveals that 10,622 minors died in road accidents in 2016, of which 3,417 were driving the vehicle and 7,205 were passengers.The motor vehicles amendment bill, pending clearance at the Parliament also proposes a three-year jail term for parents if their minor children are caught driving vehicles.On its part, the ministry is providing funds to states for setting up of automated driving testing tracks and is planning reforms in the current licensing system by reducing human intervention in issuing licences and testing driving skills through automated driving test tracks.In the 12th five year plan, the ministry has sanctioned six additional Institutes of Driving and Research (IDTR), one each in Chhattisgarh, Telangana, Andhra Pradesh, Maharashtra, Manipur and Sikkim, for imparting driving training.

This striking fact was revealed in a report on ‘Road Accidents in India.’ The report highlights accidents’ causes, places, age group with most fatalities and what type of vehicles are more prone to meet with accidents. Apart from them, an analysis was also conducted mentioning time zones having accidents on roads in urban and rural part of the states including Rajasthan. A general perception is set that hours of late night or wee hours are vulnerable for road accidents, as it is the time of drunk and driving and rush of vehicles on the highways. The report, though, rejects this perception clearly and reveals a ‘duskier’ tragic timing zone with higher risk of human lives in contrast. 24,072 road accidents have been reported in the largest state of the country across the year. Of them, the highest number of accidents at 4,539 occurred within three hours from 6 to 9pm. It is followed by a preceding three hours zone from 3 to 6pm, recording accidents at 4,505. In contrast, the late or wee hours have less ratio of accidents. The report states that 9pm to 12 am when roads are empty inviting rash driving, people met with accidents at less. Only 2,536 accidents were reported in this dark night zone followed by next three hours at 1,051. When contacted the department transport officials explained that the highest ratio of accidents in the evening is a result of huge rush of vehicles when people start returning to their homes after finishing works. Hence, in the late hours, accidents, most of them fatal, happen but they are very few compared to the evening time zone. Furthermore, the report indicates that driving in the morning when traffic rules do not bother people is more dangerous. Nearly 2,529 accidents between 6 to 9 am and 3,865 between 9am to 12pm were reported in Rajasthan. During 2016, 13 States accounted for 86 per cent of the total road accidents in the country . These are Tamil Nadu, MP, Karnataka, Maharashtra, Kerala, UP, AP, Rajasthan, Telangana, Gujarat, Chhattisgarh, West Bengal and Haryana. Similarly, 13 States accounted for 84 per cent of the total persons killed in road accidents during 2016. These are UP, Tamil Nadu, Maharashtra, Karnataka, Rajasthan, MP, AP, Gujarat, Telangana, West Bengal, Punjab, Haryana and Bihar.The fifty Million-Plus Cities accounted for 18.7 per cent in total road accidents in the country, 11.8 per cent in total persons killed in road accidents and 16.7 per cent in total persons injured in road accidents. Chennai had the highest number of road accidents (7,486) while Delhi had the highest number of deaths (1,591)) due to road accidents.

Roads accidents claimed 17 lives per hour in 2016: report

The report revealed that 46.3 per cent people of road accident victims last year were in the 18-35 years age bracket, while as much as 34.8 per cent of total persons killed were two-wheeler riders. The maximum number of road accidents took place on two-lane roads. Drivers’ fault contributed to 84 per cent of road accidents, of which over speeding accounted for 66.5 per cent of accidents and 61 per cent of accident deaths.Other factors included intake of alcohol or drugs by drivers, which led to 14,894 road accidents (3.7 per cent) and 6,131 fatalities (5.1 per cent) in 2016. Similarly, talking on mobile phones while driving led to 4,976 road accidents, 2,138 fatalities and injuries to 4,746 number of persons in this period.As much as 11.6 per cent of the total road accidents in 2016 were hit and run cases, up from 10.9 per cent reported in 2015.The report says 13 states accounted for 86 per cent of accidents, which includes Tamil Nadu, Madhya Pradesh, Karnataka, Uttar Pradesh, Andhra Pradesh, Gujarat, Telangana, Chhattisgarh, West Bengal, Haryana, Kerala, Rajasthan and Maharashtra.Of the the list of million plus cities, Delhi topped with 1,591 road accident deaths in 2016 while Chennai had the highest number of road accidents at 7,486.Uttar Pradesh recorded the highest number of road accident deaths in 2016 at 19,320 followed by Tamil Nadu at 17,218 and Maharashtra at 12,935.A senior official from the ministry said the reason for a high number of road accidents in India is because vehicle registration which went up by 10% between 2005 and 2015 does not match with the 3.75% increase in road length during this period, adding that an increased congestion on roads has resulted in an increase in accidents.Talking to the media at the event, Gadkari said a 4 per cent decline in road accidents from 2015 to 2016 is an improvement, and another 4 percent decline in accidents this year till July as against the corresponding period of 2016 is encouraging.Gadkari said he has asked states to utilise their central road fund for improving accidents prone spots on roads.Referring to the section of the report which stated that educated drivers contribute to the highest number of road accidents, highways secretary Yudhvir Singh Malik said it proves driving is purely a skill and has nothing to do with the driver’s educational qualifications.The motor vehicles amendment bill, which aims at bringing down accidents through hefty penalties and other regulatory mechanism is yet to come to force. While 265 persons succumbed to H1N1 last year, as many as four times the number of those who died this year.In the state, with four more people succumbing on Tuesday, the death toll from the flu rose to 377 since January.Officials also said that 133 new cases were reported in the state on Tuesday, even as 124 patients were discharged during the day. “Since last week, 1,316 people have been discharged from hospital,” they said.A state government release said that the daily cases have fallen from over 200 to below 140 as a result of house-to-house surveillance.In Mumbai, Priyanka Mehta (name changed), 26, succumbed to the deadly virus at the BYL Nair Medical College last week. She was diagnosed with H1N1 on August 23, after blood reports from the Metropolis Laboratories came positive. She had been suffering from flu-like symptoms for four days before that. She was administered the Oseltamivir drug after a delay of eight hours and couldn’t survive.The highest number of cases (4,456) and deaths (467) were reported from Maharashtra, followed by Gujarat — 4,431 cases and 329 deaths. Rajasthan saw the third-largest number of deaths at 80 and recorded 847 cases. Kerala followed close on heels with 75 deaths and 1,384 cases. Two women sanitation workers killed in road accident
